Microsoft Xbox LIVE Gold Subscription Renewal Purchasers File Class Action Lawsuit Complaint Against Microsoft Over Alleged Charges For Expired Xbox LIVE Gold Subscriptions.

A class action lawsuit has reportedly been filed against Microsoft Corporation (“Microsoft” or “Defendant”) in the United States District Court for the Western District of Washington (styled Ryan Graves v. Microsoft Corporation, Civil Class Action Case No. 2:11-cv-01259-JCC) alleging, among other things, that Microsoft develops and operates Xbox LIVE, an online multiplayer gaming and digital media delivery service that users access through their Xbox 360 gaming consoles and that when Microsoft renews customers of its Xbox LIVE Gold gaming services whose payment method on file is no longer valid and who re-subscribe using a different payment method, Microsoft allegedly charges them for expired subscriptions, allegedly without authorization, by billing the new payment method for a renewal of the previous subscription at the same time the customer is billed for the new, authorized, subscription purchase, according to the Microsoft Xbox LIVE Gold Gaming renewal subscription charge class action lawsuit complaint.

The Microsoft Xbox LIVE Gold Gaming renewal subscription charge class action lawsuit complaint is reportedly brought on behalf of the following putative class of persons, unless otherwise excluded:

All persons residing in the United States who:

1) purchased an Xbox LIVE Gold subscription with one payment method;
2) subsequently purchased another Xbox LIVE Gold subscription using a different payment method; and
3) were also charged an automatic renewal charge on the new payment method, relating to the initial subscription, during the applicable statutes of limitations.

Plaintiff also reportedly asserts his claims on behalf of a subclass consisting of all Putative Class members who received an unauthorized charge through their debit cards.

The MMicrosoft Xbox LIVE Gold Gaming renewal subscription charge class action lawsuit complaint reportedly asserts claims for breach of contract, unjust enrichment, conversion, and alleged violation of the Electronic Funds Transfer Act (EFTA), 15 U.S.C. § 1693, et seq.

    I just got off the phone with them and they have charged me for 3 months that I didn’t give them authorization for They can see that no use was done on the account but, refused to return money.

    Hello,
    I would like to see a class action against EPIC GAMES`s GEARS OF WAR 2.
    The example being “Rank reset” and missing “Achievements”in the games player record.
    I have contacted EPIC GAMES regarding this,they say it has to do with offline play,well that shouldnt matter,on/offline there is no difference in the play of a purchased game.
    Please google “Rank reset Gears of War 2” (or the like) for a more indepth look at how wide spread this problem is.
    There is no official complaint department for such online gaming problems,Microsoft included,i happened to find this site in my search for such a department.
    Maybe this submission will get the ball rolling for the online gamers who have been hard done by,i.e: an official online gaming ombudsman.

    Last month I was charged by Microsoft without my approval and it costed me over 130.00 dollars due to my bank for overdraft charges so I called them and told them to cancel my account so they told that that it was cancelled but then a week later without informing me the f**(ing did it again so I was so PISSED that I called them and demanded them to reimburse me for the charge the woman on the phone was rude and told me that they will not do so I then told the women that I wanted to speak to a supervisor and the asshole tell me the same thing. His excuse was that the current monthly charge has already taken affect and he said that I was told this by the other operator over the phone. Right then and there I yelled and said to him that he did not tell me this and told me that there is nothing that can be done so I told the dickhead to fuck off and took my xbox and smashed it on the ground. ROT IN HELL MICROSOFT ALONG WITH BILL GATES!!!!!!!!!!!!!!!!!!!!

    Come on guys, do you not read the terms of use?
    Do you not read the CONFIRM PURCHASE button on the subscription? You DO know that it prompts you about your renewal.

    Do you really think canceling your Credit Card through the bank is going to stop charges?
    You do know its an automated system with MILLIONS of people playing, They are going to bill you as your subscription runs… There isn’t a group of people that go through every account and say, “oh! Their credit card expired. How about we cancel your subscription.”

    @Tammie – it actually is their responsibility to stop giving a service if you have not paid for it.

    I purchased a 2 month Gold membership or something from a deal they had going. That day, I opted out of autorenew. Thought nothing of it. A few months later, well over the date for autorenew, my BF decided to purchase some MS points for some game add ons. When he entered his credit card info it charged us back to back for 2 months of service of Gold which was not authorized on that card. We were only purchasing points and that’s all we authorized. My BF called and they talked him around in circles before he just gave up.

    What they did is illegal. And it disgusts me.

    Does anyone know what, if anything, I can legally do about this??? I’m still really mad about it.

    In 2008, I was banned from live for a period of time for whatever reason.

    I created a new account which I purchased a ONE MONTH subscription on. There was no automatic renewal agreement then, and nor was any further charging apart from the one month purchased disclosed at the time of entering my credit card details.

    Since then, it has come to my attention that I have been paying 10.95 every month for 4 years now. Further to this, the credit card in question expired but they STILL continue to charge it.

    I have today tried to update my billing details to turn the automation off, which I cant do for another month as the account is attached to an old email address I do not have access to any more, and the security update takes ONE MONTH!

    Xbox is DISGUSTING for charging like this without proper agreement.

    To the people commenting saying that there is an agreement – I am aware of one being implemented recently where you have to agree to ongoing charging however this has not always been the case.

      was charged by xbox for a membership fee that was canceled over a year they couldn’t explained how or why it was done.

    I was charged on a debit card by microft for a membership fee on and account had been cancel over a year ago and never used the xbox. microft could not explain how they got my debit number. It took them 3 phone calls to straighten it out. each timed I called they could find the records.

    I share the same sentiment as , Greg Beaman on this matter, I had unauthorised charges to my bank debit card, but because they were valid I sucked it up and accepted the charges, and the xboxlive billing rep told me that they would be closing my sons account and deleting the card numer. a few months later my son opened up another accout with the same first and last name associiated to the same debit card number, I thought their would of been some kind of red flag in their system since he used the same name and credit card number. I take responsibility for my sons actions, but what really ticked me off is the inconsistancy to really want to help the patron in such matters. xboxlive business, billing culture is terrible and I am sure you could find a bush of consumers to concure with these same sentiments

    They’re still at it!!! I went through this once already with my Visa card. Xbox said the card was removed when I called. Yet on July 8th, 2013 Microsoft Xbox made 2 unauthorized charges of $9.99 and $24.99 for Xbox Live membership. I bought my crandson a Live card, he enetered the code for that so I bsiically paid double. At first my Visa card was credited at my request. Then on 8.9.13, they reversed the $24.99 credit stating that MS Xbox had sufficient documentation. However, they did not supply me with that documentation nor did they request any documentation supporting my claim. I am debating this now.

    Report Microsoft / Xbox to the FTC.
    When you enter any credit card on the Xbox site, they have it set up that you agree to any / all automated charges from that point on unless you call (45 min.s minimum) & remove the card. Not eve an option to option for a One Time Charge. Totally illegal as I see it!!!
