Privacy Class Action Lawsuit Complaint Filed Against KISSmetrics and Certain KISSmetrics Clients Over Alleged Tracking Of Users.

A class action lawsuit has reportedly been filed against Space Pencil, Inc. d/b/a KISSmetrics, a web analytics firm and several of KISSmetrics’s website clients, including Babypips.com, Involver.com, Moo, Inc., Sitening, LLC, Shoedazzle.com, Inc., 8Tracks Inc., About.me, Friend.ly, Giga Omni Media, Inc., Hasoffers.com, Konggregate Inc., Livemocha Inc., Rockettheme, LLC, Fitness Keeper, Inc., SEOMoz, Inc., Sharecash, LLC, Slideshare.net, Spokeo, Inc., Spotify USA, Inc., Visual.ly, Conduit USA, Flite, Inc., Tangient, LLC, ETSY Inc. and Ivilliage, Inc. (collectively “Defendants”) in the United States District Court for the Northern District of California (styled John B. Kim and Dan C. Schutzman v. Space Pencil, Inc. d/b/a Kissmetrics et al., Civil Class Action Case No. 11-cv-3796) alleging, among other things, that Defendants circumvented Plaintiffs and Class Members browser privacy controls, conducted tracking in unreasonable and unexpected way, used Plaintiffs and Class Members’ Computer Assets (their computers, internet connectivity and software) to store LSOs (Adobe Flash Local Storage Objects, or cookie-like files in Flash), shared common identifiers and engaged in other alleged tracking exploits, according to the KISSmetrics LSO Tracking Privacy Class Action Lawsuit Complaint class action lawsuit complaint.

All persons in the United States who visited a Website Defendant’s website and were assigned a Kissmetrics and Website Defendants’ identifier.

The KISSmetrics LSO Tracking Privacy class action lawsuit complaint reportedly asserts claims for alleged violations of the Electronic Communications Privacy Act, 18 U.S.C. § 2510, violations of the privacy act, California General Laws, Chapter 214, Section 1B, trespass to chattel and violations of the Unfair Competition Law, California Business & Professions Code § 17200.
