TikTok, Inc. f/k/a Musical.ly, Inc; ByteDance, Inc.; Musical.ly n/k/a TikTok, Ltd. and Beijing ByteDance Technology Co. Ltd (Defendants) have reportedly agreed to a class action settlement of a data privacy class action lawsuit filed against them in the United States District Court for the Northern District of Illinois, In Re: TikTok, Inc., Consumer Privacy Litigation, MDL No. 2948, 20-cv-4699 (N.D. Ill.), alleging, among other things, that TikTok and ByteDance violated federal and state law by collecting and using, without sufficient notice and consent, Plaintiffs’ personal data in connection with their use of the TikTok -Make Your Day video-sharing application (and/or its predecessor app Musical.ly) distributed in the U.S. (the “App.”).
Defendants reportedly deny every allegation of wrongdoing, liability, and damages that were or could have been asserted in the litigation.
Who Is Included In The TikTok Class Action Settlement?
The TikTok class action settlement reportedly includes, unless otherwise excluded, the following settlement class:
All persons who reside in the United States who used the App prior to September 30, 2021.
The TikTok settlement also reportedly includes an Illlinois sub-class consisting of “all persons who reside in the State of Illinois and used the App in the State of Illinois to create videos prior to September 30, 2021.”
What Settlement Benefits Does The TikTok Data Privacy Class Action Lawsuit Settlement Provide?
Under the TikTok Data Privacy lawsuit settlement, TikTok has reportedly agreed to create a $92,000,000 Settlement Fund to pay the members of the Settlement Class who file valid claims, to pay Plaintiffs’ attorneys’ fees, costs, a service award for the named plaintiffs, and the administrative costs of the settlement.
If the TikTok settlement is approved by the Court, each Settlement Class member who timely files with the Settlement Administrator a valid Claim Form will reportedly receive a settlement payment of a pro rata share of the Settlement Fund (after payment of attorneys fees and certain settlement costs). Illinois settlement class members reportedly may be entitled to a payment of up to 6 times that of non-Illinois residents due to certain claims in the lawsuit that are specific to Illinois residents. TikTok settlement claim forms can be submitted online or via mail. The TikTok settlement claims filing deadline is March 1, 2022.
In addition, under the TikTok settlement, Defendants have reportedly agreed to provide certain injunctive relief to protect App users’ information.
