Metformin User Residing in Queens County, New York Files Class Action Lawsuit Complaint in NJ Federal Court Against Ascend Laboratories.
On April 15, 2020, a federal Metformin class action lawsuit was reportedly filed in the U.S. District Court for the District of New Jersey (styled Stelios Mantalis v. Ascend Laboratories, LLC, Case No. 2:20-cv-04329) alleging, among other things, that the type 2 diabetes drug, Metformin, used to control high blood sugar, may contain N-nitrosodimethylamine, a carcinogenic and liver-damaging impurity.
According to the Metformin class action lawsuit complaint, on March 2, 2020, Valisure, an online pharmacy registered with the U.S. Drug Enforcement Agency and Food & Drug Administration, “detected high levels of N-Nitrodimethylamine (‘NDMA’) in specific batches of prescription drug products containing metformin.”
The proposed Metformin lawsuit is reportedly brought on behalf of the following nationwide putative class members: “all persons in the United States who purchased metformin manufactured by Ascend.”
The Metformin class action lawsuit complaint reportedly claims that the putative class members were injured by the full purchase price of their metformin medications and asserts causes of action for, among other things: (i) breach of the implied warranty of merchantability, (ii) unjust enrichment, (iii) fraudulent concealment, (iv) fraud, (v) conversion, (vi) violation of New York General Business Law § 349, and (vii) violation of New York General Business Law § 350.
The plaintiff and the putative class members in the Metformin lawsuit reportedly seek, among other things, an order certifying the nationwide class, compensatory, statutory, and punitive damages in amounts to be determined by the Court and/or jury, prejudgment interest on all amounts awarded, an order of restitution and equitable monetary relief and injunctive relief.
