Elmiron Class Action Lawsuit Complaint Filed in Pennsylvania Federal Court Seeking A Medical Monitoring Fund For Diagnostic Vision Testing of The Retina and Macula of Eyes

Elmiron User Files Class Action Lawsuit Complaint in Pennsylvania Federal Court For Cost of Medical Monitoring/Diagnostic Testing For Vision Health

On May 6, 2020, an Elmiron class action lawsuit was reportedly filed in the U.S. District Court for the Eastern District of Pennsylvania (styled Mary Lee Allen v. Janssen Pharmaceuticals, Inc. and Johnson & Johnson, Case No. 2:20-cv-02183) alleging, among other things, that the interstitial cystitis and bladder pain drug Elmiron may be linked to visual damage, including pigmentary maculopathy.

According to the Elmiron class action lawsuit complaint, the Plaintiff consumed and regularly used Defendants’ Elmiron (pentosyn polysulfate sodium) product from 2009 to the present and may be at risk of visual injuries, including but not limited to loss of vision, retinal macular dystrophy, pigmentary maculopathy, or atypical macular degeneration of the eyes.

The proposed Elmiron lawsuit is reportedly brought on behalf of the following nationwide putative class members:

“All individuals within the U.S. who were prescribed and took Elmiron who are currently asymptomatic for pigmentary maculopathy and have not received adiagnosis of retinal toxicity due to Elmiron use. Claims for actual injury from Elmiron use are excluded from the claims brought in this Class Action.”

The Elmiron suit is also brought on behalf of the following Illinois class:

All individuals in Illinois who were prescribed and took Elmiron who are currently asymptomatic for pigmentary maculopathy and have not received a diagnosis of retinal toxicity due to Elmiron use. Claims for actual injury from Elmiron use are excluded from the claims brought in this Class Action.

The Elmiron class action lawsuit complaint reportedly brings claims for medical monitoring and declaratory relief.  According to the class action complaint, monitoring procedures exist (such as Optimal Coherence Tomography (OCT) and fundus photography) that make the detection of visual injuries, including maculopathy, possible.

The plaintiff and the putative class members in the Elmiron lawsuit reportedly seek, among other things, an order certifying the proposed classes, a declaration that Defendants are financially responsible for implementing and maintaining a fund for the medical monitoring of Plaintiff and Class Members, an award to Plaintiff and Class Members of damages, costs and disbursements in the suit , including reasonable attorneys’ fees, and pre and post judgment interest.

    I was treated under my retinal specialist. But he used injections. I soon lost vision in one eye.
    I would like to know more and if I am qualified to join the law suit.

    I have been on Elmeron for approx. 3 yrs. and have notice my vision has become blurry at times and hard focusing while reading and working on the computer also I am bothered by glare. I’ve see a Retina Specialist Group) that I happen to work for) And found not having and Retinal or Macular damage. Wondering if I qualify for this class action

    I’ve been on Elmeron for approximately 3yrs
    My vision has changed. Vision is becoming blurry, having some difficulty focusing while reading or watching TV. I’m bothered by glare and having some hair loss.
