Belviq Class Action Lawsuit Complaint Filed in New York Federal Court Over Alleged Cancer Risk Of Weight Loss Drug Belviq and Belviq XR

Belviq Purchaser Brings a Class Action Lawsuit Complaint in New York Federal Court Over The Alleged Increased Risk of Cancer Of The Prescription Weight Loss & Diet Drug Belviq and Belviq XR.

On March 27, 2020, a Belviq class action lawsuit was reportedly filed in the United States District Court for the Southern District of New York (styled Barbara Zottola v. Eisai Inc, Arena Pharmaceuticals, Inc. and CVS Health Co., Case No. 7:20-cv-02600) alleging, among other things, that the prescription weight loss medications Belviq and Belviq XR (known as serotonin receptor agonists that contain the active ingredient lorcaserin) may expose users to elevated risk of cancer and that purchasers of Belviq were injured by the full purchase price of their Belviq drugs.

According to the Belviq class action lawsuit complaint, on February 13, 2020, the FDA issued a “Drug Safety Communication” about Belviq Medications stating that the FDA was requesting the withdrawal of the products from the market because the “potential risk of cancer outweighs its benefits” and that a “safety clinical trial shows an increased occurrence of cancer.”  Belviq was recalled in February 2020.

The Belviq lawsuit is reportedly brought on behalf of the following putative nationwide class members: “all persons in the United States who purchased Belviq® or Belviq XR.” The Belviq case is also brought on behalf of a NY subclass: “all Class members who purchased Belviq® or Belviq XR in New York.”

The Belviq class action lawsuit complaint reportedly brings claims for breach of implied warranty of merchantability, unjust enrichment, conversion, fraudulent concealment, fraud and violation of NY General Business Law §§ 349 and 350.

The plaintiff and the putative class members in the Belviq class action lawsuit reportedly seek, among other things, an order certifying the nationwide Class and the New York Subclass under Rule 23 of the Federal Rules of Civil Procedure, compensatory, statutory, and punitive damages, an order of restitution and other forms of equitable monetary relief, injunctive relief, prejudgment interest and reasonable attorneys’ fees and expenses and costs of suit.
