Century 21 and Cendant Class Action Lawsuit Receives Class Certification For Century 21 Real Estate Franchisees.

A class action lawsuit filed against franchisor Century 21 Real Estate Corporation and its former parent company Cendant Corporation f/k/a Hospitality Franchise Systems (collectively “Defendants”) in the Superior Court of New Jersey, Morris County (styled Frank K Cooper Real Estate#1, Inc. et al v. Century 21 Real Estate Corporation and Cendant Corporation f/k/a Hospitality Franchise Systems, Civil Action Case No. MRS-L-377-02), alleging among other things, that Century 21 and Cendant failed to provide the level of services to Century 21 franchisees required by their franchise agreements and misappropriated fees paid by franchisees into a national advertising fund (“NAF”), has been certified as a class action lawsuit by New Jersey Superior Court Judge Robert J. Brennan, according to class action lawsuit news reports.

Judge Brennan reportedly issued a ruling certifying a nationwide class of current and former Century 21 franchisees during the period from August 1995 to April 2002, whose Century 21 franchise agreements contain a New Jersey jurisdiction clause, a class  which is reportedly estimated to include between 1,000 and 4,000 Century 21 franchisees.
