Omni Insurance, Farmers Insurance & Credit Control Services d/b/a Credit Collection Service Class Action Lawsuit Settlement

If, while residing in Washington State, you received certain “COLLECTION” NOTICES from Credit Collection Services from May 19, 2000, to July 31, 2004, that sought payment of a claim by an insurance company arising from an automobile accident, your rights may be affected by a class action settlement.

A class action settlement has been reached in two class action lawsuits against Omni Insurance Company (“Omni Insurance”), Farmers Insurance Company of Washington (“Farmers Insurance”) and Credit Control Services, Inc. d/b/a Credit Collection Services (“Credit Control Services” or “Credit Collection Services” or “CCS”) (collectively “Defendants”) pending in the Superior Court of Washington, County of King (styled Michael Stephens v. Omni Insurance Company and Credit Control Services, Inc., Case No. 04-2-15763-3 (SEA) and Rajvir Panag v. Farmers Insurance Company of Washington and Credit Control Services, Inc ., Case No. 04-2-11732-1) alleging, among other things, that Credit Collection Services attempted to recover payments made to insureds under various insurance coverages, including uninsured, underinsured, medical payments and personal injury protection coverages, who either lacked, or appeared to lack, applicable or sufficient liability insurance and allegedly sent them a letter titled as a “Formal Collection Notice,” and followed up with other forms of correspondence purportedly in violation of Washington law, according to the Omni Insurance, Farmers Insurance and Credit Collection Services CCA class action settlement notice.

The Omni Insurance, Farmers Insurance and Credit Collection Services CCA class action lawsuit settlement class reportedly includes the following persons, unless otherwise excluded:

All persons in Washington who received notices from CCS during the Class Period, May 19, 2000 through July 31, 2004, substantially in the form of the notices sent to plaintiffs Stephens and Panag that were sent by CCS on behalf of an insurance company pursuing alleged subrogation rights arising from an automobile accident.

The Omni Insurance, Farmers Insurance and Credit Collection Services CCA settlement amount is reportedly the sum of Two Million Fifty Thousand Dollars ($2,050,000) and is available to pay timely and valid claims of Class Members, and to pay and satisfy the other obligations of the Defendants under the Settlement, including costs of the class action settlement notice, the processing of claims, Incentive Awards to the Plaintiffs, and Attorneys’ fees and expenses awarded by the Court.  The Omni Insurance, Farmers Insurance and Credit Collection Services CCA settlement also provides that an Order of Permanent Injunction will be entered that reportedly prohibits CCS from, in the future, engaging in specified conduct at issue in the Omni Insurance, Farmers Insurance and Credit Collection Services CCA class action lawsuits.

If you wish to participate in the Omni Insurance, Farmers Insurance and Credit Collection Services settlement, you must timely submit a valid Claim Form on or before November 11, 2010.  The reported deadline to opt-out or exclude yourself from the class action settlement is October 4, 2010 and the deadline to object to the class action settlement is October 4, 2010.

The Court is scheduled to hold a settlement Fairness Hearing on Friday, October 22, 2010 at 9:00 a.m., in the Courtroom of the Honorable Mary I. Yu, King County Courthouse, 516 Third Avenue, Seattle, Washington, to consider whether the proposed settlement should be granted final approval as fair, adequate, and reasonable and in the best interests of the Class as a whole, and whether an Order of Final Judgment and Dismissal should be entered.
