PEMCO Mutual Insurance Company and PEMCO Insurance Company (collectivelly “PEMCO”) have reportedly agreed to a class action settlement of a lawsuit filed against them in the Superior Court for the State of Washingon, Pierce County, styled Stier v. PEMCO Mutual Insurance Co., Case No. 18-2-08153-5, alleging, among other things, that in settling total losses, PEMCO improperly took deductions for typical negotiation and underpaid total loss claims to PEMCO insureds, in breach of contract and in violation of the Washington Consumer Protection Act. PEMCO reportedly denied any wrongdoing.
Who Is Included In The PEMCO Total Loss Class Action Settlement?
The PEMCO Insurance Total Loss class action settlement reportedly includes, unless otherwise excluded, the following settlement class:
All PEMCO insureds with Washington policies issued in Washington State, who received compensation for the total loss of their own vehicles under their First Party Coverages (Comprehensive, Collision, and UIM) and received a total loss valuation from PEMCO based upon an “Autosource” report including deductions for “typical negotiation.
What Settlement Benefits Does The PEMCO Class Action Lawsuit Settlement Provide?
The PEMCO class action lawsuit settlement reportedly provides for the payment of up to $14,110,030.44 (less legal fees and costs) to pay claims for those settlement class members who properly submit Claim Forms by June 17, 2021 and are not successfully challenged by PEMCO. The amount of settlement payments will depend on the total loss value paid by PEMCO in which an Autosource estimate used a “typical negotiation” deduction. According to the settlement notice, the average payment is expected to be approximately $550.
