Court Preliminarily Approves Settlement of Dardarian v. OfficeMax North America Class Action Lawsuit Over Privacy of Zip Code Information.

A class action settlement of a privacy lawsuit against OfficeMax North America, Inc. (“OfficeMax” or “Office Max” or “Defendant”) has reportedly been given preliminary court approval. The class action case, captioned as Nancy Dardarian, et. al. v. OfficeMax North America, Inc., Case No. 11-CV-00947 YGR, was filed in the United States District Court for the Northern District of California and reportedly alleges claims under California’s Song-Beverly Act relating to the collection and recording of customers personal information, including zip codes.

The OfficeMax zipcode privacy settlement class reportedly includes, unless otherwise excluded, persons who used credit cards to make a purchase at an OfficeMax store in California between March 1, 2010 and February 22, 2011 and whose zip code was requested and recorded.

The OfficeMax zipcode privacy settlement reportedly provides that OfficeMax will provide merchandise vouchers to class members of between $5 and $10.
