HSBC Card Services f/k/a HSBC Private Label Wood Dale Call Center Employee Class Action Lawsuit Settlement

If you were employed by HSBC as an hourly paid telephone-dedicated call center employee in Wood Dale, Illinois at any time between August 17, 2002 and October 31, 2010, your rights may be affected by a class action settlement.

A class action settlement has been reached with HSBC Card Services, Inc. f/k/a HSBC Private Label Corporation (“HSBC Card Services” or “HSBC Private Label” or “HSBC” or “Defendant”) in a class action lawsuit against HSBC in the Circuit Court of Cook County Illinois (styled Oliva Pinela and Yadira Hernandez v. HSBC Card Services, Inc., f/k/a HSBC Private Label Corporation, Class Action Case No. 09 CH 16662) alleging, among other things, that HSBC failed to pay its telephone dedicated employees and workers for all work they performed throughout the day, purportedly in violation of the Illinois Wage Payment and Collection Act and the Illinois Minimum Wage Law, according to the HSBC Card Services f/k/a HSBC Private Label Wood Dale Call Center Employee class action settlement notice.

Examples of such allegedly unpaid work, according to the settlement notice, include the time employees spent booting up and shutting down the computer system, logging on and off of computer applications, checking e-mails and updates, and reviewing HSBC communications, policies and notices.

HSBC settlement class members reportedly include the following persons, unless otherwise excluded:

All Persons Who, At Any Time Between August 17, 2002 And October 31, 2010, Worked For HSBC Card Services, Inc., HSBC Private Label Corporation, Household Payroll Services, Inc. Or HSBC Pay Services, Inc. (Collectively “HSBC”) As Telephone-Dedicated Hourly Employees At The Call Center Located In Wood Dale, Illinois (The “Wood Dale Call Center”).

The HSBC Card Services f/k/a HSBC Private Label Wood Dale Call Center Employee class action lawsuit settlement reportedly provides that HSBC has agreed to create a $1,021,578.95 fund which will be used to pay Class Members who timely submit a valid Claim Form and who do not exclude themselves from the settlement.

The Court will reportedly hold a final Fairness Hearing at 11:00 a.m. on September 1, 2011 at Circuit Court of Cook County, 50 W. Washington Street, Chicago, Illinois 60602, in Courtroom 2510 to consider whether the settlement is fair, reasonable, and adequate.
