Unilever Slim-Fast Ready to Drink Shakes Recall Class Action Lawsuit Filed

Consumer Files Class Action Lawsuit  Against Unilever Over Slim-Fast Ready to Drink Shakes Recall

A class action lawsuit was filed against Unilever in the United States District Court for District of New Jersey (Newark) (Case No. 2:10-cv-01432-KSH -MAS) on behalf of persons who purchased Slim-Fast Ready to Drink Shakes and who were denied a refund pursuant to Unilever’s voluntary recall after Unilever allegedly first told consumers to immediately discard the recalled Slim-Fast Ready to Drink Shakes, and then later allegedly required that consumers provide UPC codes from Slim-Fast Ready to Drink Shakes containers or photographs of the product, according to the Unilever Slim-Fast Ready to Drink Shakes class action lawsuit complaint.

I had the same problem. I left info with number of product on their phone line and as instructed threw away the product. I heard nothing. I then contacted them several times. Recently they sent me an email after I inquired again and said I would need to fill out a claim form and provide proof of purchase. They didn’t send me a claim form and didn’t tell me to take a picture and save receipts. I have asked numerous times for a claim form and have been ignored.

i have not heard anything either, no refund check or a call back from slim fast, just a sore throat from tossing my cookies and a fever to show for my wanting to lose a couple of pounds, hope u had luck since because i still cant get anyone to answer my calls..

The same exact thing happened to my elderly 76 year old mother except she received a check dated 2/25/10 for $20.60 (NOT 4-6 WEEKS like I was promised). I then tried calling and found out that the original recall line was disconnected, had to research unilever on the internet on my time to get a new number to call and could only get a recording and no live person. When I finally got a customer service email I threated to go to the NYS Attorney General with my lack of refund within 10 days if I didnot receive a refund, then I received another letter, exactly like the one on the class action suit asking for more documentation. As frustrated as I was, I thought I smelled a RAT earlier so I never discarded my slimfast or boxes. Very Upset, I filled out the paperwork took the pictures etc…and sent it in over 2 weeks ago, and funny this is they cut a me another check to me – the 2 together equal almost what 48 cans cost. I think it was for $26.00. And even something else I noticed …. the check was dated one day after the class action suit was filed against Unilever. I deposited the checks yestrday, and hopefully they will clear. BUT… WHAT A FIGHT TO GET A REFUND. UNILEVER SHOULD HAVE TO PAY FOR THIS FRAUD BIG TIME!!!

I have had the same problem. Unfortunately, I bought about $130.00 worth of the stuff. We thought it would be a good thing to have on hand in case we had a national emergency!! I called – and was promised a refund. I asked if they wanted my UPC codes. She said no, that they would just mail me the refund based on my word. I told her that was “strange” – but never the less, I believed her. Well, this was back in February, I think. I was told to wait 6 weeks for the refund. I did – I waited 2 months – then e-mailed again and called them. They said it was coming – just give them some time. Well, here it is 3 months – and I don’t believe they have any intention of refunding me. I threw away some of the product, but I still have most of it. My gut just said I’d need those UPC codes!!! Is there a government agency we can complain to? I am ticked off that I wasn’t told about a “refund” form. They flat out lied to me about that. . .because I asked if I needed to fill out anything. I think they’re lying about a refund, too. We all just got suckered!! No more Slim Fast for me – the company should be shut down!!!

  • Lori Still April 21, 2010, 2:44 am

I have never received a claim form or refund after many attempts through the 800 line and have gotten know where with this company. I became very very ill from the contamination and my illness lasted 6 weeks resulting in many medical visits and very costly and too think all I am asking for is a refund of the (2) 12 packs I purchased in November 2009!

    • Kacie February 21, 2011, 2:03 am

      Darlene-
I just bought cans of Slim Fast this week that were infected with the bacteria, after drinking just 1 can it made me deathly ill. I will not buy them ever again and in your best interest I would stay away from them for a long, long time. It is February 2011 and the problem is still going on. Horrible.

I used this product and got vey sick to my stomach. When I tried to get a refund, they gave me a check for $7.95, but I had originally spent over $100 on slim fast. When do I get my money from the class action lawsuit?

    • CINNAMON FALLS August 1, 2011, 4:40 pm

I GOT A 10 CHECK BACK FROM TODAY THAT ABOUT IT

  • tamarajohnson June 27, 2011, 8:24 am

  • tina August 1, 2011, 3:12 am

    • KeyKey520 August 1, 2011, 2:33 pm

I received a Settlement Check in the mail today,$13.95

    • jeffrey August 2, 2011, 1:15 pm

I received a check today for $2.40. Seems as if the lawyers kept most of my refund. You can bet my complaint isn’t over yet.

  • KeyKey520 August 1, 2011, 2:31 pm

I received a Settlement Check today for the amount of $13.95, It’s been so long I didn’t know who the check was from until I goggled it. I guess I can buy some Milk and Bread with this $13.95.

  • CINNAMON FALLS August 1, 2011, 4:44 pm

ALL THE MONEY WE SPIN ON MY SLIM FAST … THEY CAN DO BETTER THEN THAT WE CAN’T EVEN ALL OF ARE MONEY BACK I WOULD LIKE A 10 DOLLAR CASH BACK FOR BUYING THIS STUFF I WANT EVER BUY IT AGAIN …

  • L.J. August 1, 2011, 8:58 pm

I got a $13.95 check out of the blue today and couldn’t figure it out for the life of me until I found this site. No contact info with the letter, it just says “The attached check is being sent to you pursuant to the Settlment in Dolby et al. v. Unilever United States, Inc., Civil Action No. 2:10-cv-01432-SDW-MCA in the United States District Court for the District of New Jersey. The details of this Lawsuit were described in the Notice of Settlement you previously received.”

I had called the recall hotline and gave all my info but never heard squat. I can’t even remember now how much Slim-Fast I had left, but I think I remember you had to report how many unopened cans you had remaining. I never got sick, but I didn’t drink the ones I had left. Can’t stand the stuff now, I got so tired of the taste.

Hope this helps some of the confusion! I guess it really does take years to push through the legal system. I’ll take my little $14 surprise and take my son to a movie.

  • michelle vaughn August 2, 2011, 12:07 am

HI MY NAME IS MICHELLE THEY SENT ME A CHECK FOR ONLY $8.70
AND THAT’S NOT FAIR FROM WHAT I’VE SPENT THEN THEY MISSPELLED MY NAME AND SO IT STILL DOING ME NO GOOD.

  • f.a.s. August 2, 2011, 9:27 am

I just got a check for 2.20, spent over 20.00 ,for slim fast…what a joke

  • NBT August 2, 2011, 12:31 pm

Just received my check for $2.40! Gee, thanks…not.

    • Norma August 15, 2011, 12:07 pm

Happy to see others wondered if this was a scam as I did! I too got check for $2.40. A joke I presume! Looks and feels like a scam anyway. I won’t buy SlimFast again regardless.

  • Deleana August 2, 2011, 2:00 pm

Today i got a 15.00 check thats not worth anything no more slim fast for me!!!

  • Doug August 2, 2011, 3:44 pm

Well — Just to go against the tide — I submitted just a statement back when I was first invited to make a claim. No calling involved. It was not too long before I got my refund. I was surprised to receive another check yesterday. It’s not much, but maybe represents a difference between what they already reimbursed me and what the lawsuit required . . . .

    • Doug August 2, 2011, 3:48 pm

Well, everyone else seems to think it took a phone call, so maybe I did call, and just don’t remember. Anyway, I got no hassle out of the process. They reimbursed me for the number of cans I reported, no questions asked.

      • Vicky August 3, 2011, 3:44 pm

I did fill out the information when the recall information came to me, took pics, sent product info and got some of my money back. Im assuming the HUGE 3.00 check I got today was suppose to be the rest of the funds. I just bought milk for 3.33, so I guess that 3.00 dosnt cover much.

  • Disappointed August 2, 2011, 8:27 pm

I got a check for $15. Very disappointed when I spent more out buying the cases and then had threw the receipt away to show that I had more than 24. I’m going to try Kelloggs shake from now on!!!

  • Thanks Slimfast (Really) August 2, 2011, 10:58 pm

Wife called it in back when they had the recall. Received a coupon a few weeks later to replace what we threw out. No problems. Today we get a check for the amount we threw out. (We weren’t expecting it because we were aready re-imbursed). Guess we didn’t have all the pain and suffering from missing a few cans to consider a lawsuit. Thank you anyway Unilever, we tore the check up. please make a donation to a charity that can really use it.

  • K August 3, 2011, 12:01 am

Really…..are you serious? I received a fifteen dollar check, what a joke!

    • Thanks Slimfast (Really) August 3, 2011, 9:59 pm

Yep, I’m serious. You received a fifteen dollar check, how much were you out? Just curious

  • erica August 3, 2011, 1:09 am

LOL I recieved $8.70, I think I spent more gas trying to cash the check , some relief.

  • Cierra August 3, 2011, 8:19 am

I guess my question is this…… who actually cashed the check because I’ve heard of too many scams where you cash a check sent to you and thereby allow the sender access to your account. So I’m just trying to check to see if this is legitimate because though it was only for $2.40 as a college student every red cent helps.

  • richard August 3, 2011, 9:09 am

got a check for 2.28 today. as with others it did not say what it was for. i guess i expected a little more, like 10. i guess the layers are the only ones who made out/got rebated on this.

    August 3, 2011

  • Alison August 3, 2011, 10:27 am

I received a check for $2.40 out of the blue and had to research to find out it was related to the Slim Fast recall. When the recall was first announced I left information at the 800# and received a full refund immediately. I am trying to find out if this most recent check is legitimate.

  • Candy August 3, 2011, 1:02 pm

I got one of these checks today.. for $4.80. I was worried about the legitimacy of the check since the “heat sensitive security feature” (color fades with heat) didn’t work. I just tore it up and tossed it – it may have been real but I’m not going to risk it; I won’t live or die for lack of a few dollars.

  • peggy macneil August 3, 2011, 5:57 pm

aug 3 2011 i just recieved a letter about a settlementin dolby et al v. unilever united states.

  • Maria August 3, 2011, 8:52 pm

A check for $2.40 arrived yesterday. Our lives are worth more than that! The check is legit since we looked it up and see it’s about the Slim-Fast settlement, which we know about.

  • Maria August 3, 2011, 8:53 pm

Has anyone cashed the check yet without any problems?

  • Linda August 4, 2011, 8:04 am

I got my settlement check 8/1/11 for $3.60. I buy slimfast by the case and this is what I get? I agree with others, it seems like the lawyers keep the big chuck of money, and only handing out 1/2 pennies to the consumer. It had been so long, I also forgot what this was for until I goggled it. Lawyers are laughing to the bank, with those fat checks they are depositing in their bank accounts.

  • Lois August 5, 2011, 10:17 am

I couldn’t figure out what this check for $5.55 was for. I also googled it and I’m not sure if I’m going to take the chance to cash it. I have until Oct 12th before it expires. What a joke! Seems like a good way to get personal info. We can’t trust anyone these days….what a shame. If it isn’t our cc#’s being stolen, which did happen to me, it’s some other type of fraud. Good luck to everyone who cashed their Lottery check! Don’t spend it all in one place! lol

  • Donna Blevins August 8, 2011, 10:21 am

Just got a check in the mail for $4.80 from the Claims Administrator. They did everything possible to make it feel like it was a scam check. Sure, they put the civil case number on it, but it made little sense. We had nearly $80.00 in slim fast that we poured down the drain.

    Shame on you Unilever!

  • Leslie Chess August 10, 2011, 3:04 pm

I recieved a 2.00 off coupon for the slimfast i bought. This is unfair and I am going to make a compliant about this. They settled that case for millions and I can’t get reimbursed. This is very fishy

  • Snookie M August 12, 2011, 1:00 pm

I received a check today from the LAW SUIT settlement for $3.40. But I had PREVIOUSLY (yes, about 2 years ago) received a refund check from the company for the actual cans I still had on hand (or the case I had purchased- I don’t recall…) when the problem was announced. Some folks may be forgetting that they had previously received a check for the product on hand. Just may want to check back in your banking records. Of course, some folks may not have received their original reimbursement, I understand. I called the company hotline number that was provided, and I recall getting the refund check very promptly- perhaps 2 – 3 weeks. There may have been a ‘cut-off’ date for filing a reimbursement for the cans puchased. Just a thought.

  • Nicole Awich August 24, 2011, 4:31 pm

I got a chk in the mail for $15.00 today. I had no idea why I was getn this check. I dont recall filing a claim recently, must be a while back???
Before I cashed it…I wanted to search & see if anyone else had rcvd a check..lo & behold I found this site…

  • ann December 29, 2011, 7:44 am

i still haven’t heard anything from them, only that the check is in the mail/ lol that was back in march lol

  • Theresa Quick April 12, 2012, 8:46 pm

I did not know about the recall. Wished that I had. When I got sick last year after drinking a slim fast, I called the company. I talked with a very rude customer service person, and she told me there had not been a recall. I spent $1400.00 on medicine before the bacterial infection cleared up. It was a very painful and horrible ordeal. I see in the stores now they are no longer in cans. I would not wish what I went through on anyone. This is a very unscrupulous company to deal with.

  • John Martin May 1, 2012, 9:56 am

I still have 3 cans of the tainted stuff the receipt with date and repeatably contacted Unilever-slim fast with no success . I sent a letter to Dolby Settlement Administrator and still have not received anything.

I am sick and tired of corporate greed and will NEVER buy another Unilever product. If I don’t get something soon you will see those three cans on Ebay or donated to the Smithsonian. Anything that will generate lots of press. I think Unilever should be put out of business. A company that will not stand behind the products they sell should not be allowed to be in business.

    • Ben May 17, 2012, 12:41 pm

I’m in the same boat. I had about 24 cans of the stuff on hand when they announced the recall so I followed their instructions to a T including leaving my information on their voicemail. After not receiving anything within 6 months I followed up again and they mailed me a form to fill out but of course I filled it out and sent it back and have heard nothing since. Then, when this Dolby class action came out and they mailed me a card I expected to receive whatever the settlement amount was by following the instructions. Of course, nothing from that either. I’m sure the check would have only been about $10 but I have done whatever possible to avoid using unilever products (difficult) as they have done whatever possible to avoid compensating me for the product I bought from them but then was told not to consume because it was unsafe. I would have been placated by a few coupons for free slimfast bottles but now I’m just bitter.

  • Akeyha Walters July 10, 2013, 1:28 pm

l I’ve been waiting for any answer from them, but I haven’t heard anything from them. I don’t know who to contact to discuss the matter. It’s July 2013 how much longer is going to take for a answer or a check or something.
