Dish Network Customers In Illinois File Class Action Lawsuit Complaint Against Dish Network Over Removal Of Fox Network’s Regional Sport Channel Programming.

A class action lawsuit has been filed against satellite provider Dish Network (“Dish Network” or “Dish” or “Defendant”) in Madison County Circuit Court in Illinois (styled Steven Rippee and Lois Fernandez v. Dish Network, Civil Action Case No. 10-L-1093), alleging, among other things, that Dish Network removed Fox Network’s regional sports channel from the Dish Network line-up on Oct. 1 but did not reduce the amount that Dish is charging customers for satellite television service, according to a Dish Network Fox channel programming class action lawsuit news report.

The Dish Network fox sports channel class action lawsuit complaint is reportedly brought on behalf of a putative class consisting of all Dish Network customers in Illinois who have contracts with the satellite provider for programming that includes Fox Network’s regional sports channel.

    Yet another frivolous lawsuit – just what America needs. DISH Network’s residential service agreement, which is something all customer s must consent to in order to get service, clearly states (in bolded, underlined, and all-capped lettering) that “prices and programming are subject to change at anytime, regardless of whether you are in a commitment”.

    Frankly, they are not under any obligation to lower programming price with the (temporary) removal of FOX, nor would they have been liable for not doing so even if the take-down was permanent.

    Fail.

      Dish Network should be taken down and put out of business, period. They have the most dishonest and abusive customer care staff I have ever dealt with. Not all were that bad but about 80% of the folks I talked to (and there were many) were this way. A product of corporate training, I’m sure.
      Dish Network is not an honest company.

        Amen, Jerome! Dish Network is not an honest company. I’m terribly regretting signing that d*$n contract. Terrible product, terrible service. Now I know why the cable gal chuckled when I told her I was changing from cable to Dish.

    dish tells me,” you have to have h.d. to get free previews” and it is $10.00 more per month. Is there a way to get out of the Dish contract?

      Yea sign up for direct Satalight TV and they will buy out your Dishnetwork contract other then that the only way to get out is pay the like $250 early termination fee though if you try real hard and are nice they may let you out of it with out the penalty fee. I have seen some people get out of it then again i have seen some friends get stuck with it.

      I just got out of the 2 year contract after 13 days of service. You need to get connected to their “Executive Resolution Team”. Ask the customer service rep to connect you with this group. They seem to be the only ones who have the authority to waive the cancellation fee, in my case it was $420. Good luck.

        Can you please guide me with what happened to you. I got stuck with a 2 year contract on Dec 23th with the promise that my monthly payment will be reduced by $25.00 ($15 credit towards the programming fees and $10 for HD for life). I received my first bill yesterday by email and it was more than what I was paying before on a month to month plan (my previous contract was up).
        They (their reps) give you this fake ID and when you ask to speak with them, they tell you that it is not possible.
        I complained to one rep and he hung up on me. The second one bluntly told me that I signed a contract for 2 yrs and I am stuck with it. They will send me to collections.

        I would like to know how to get out of a contract… I cancelled my service after one month… with in that month my service was horrible. I was treated very ridely by three of the customer service managers (one of them hung up on me and tried to degrade me. I call executive resolution team, had a tech come out and prove that they didn’t give me 100% service and they still wouldn’t waive the cancellation fee. I believe this is how they make their money. They blindside you into a contract (which I was told there was a contract by the rep that did my original order), give you poor service (tv and customer service), and make you pay to leave when not satisfied. They are worse than the mob!!!

    Dish Network has many problems and now I believe that they are slowly going out of business because of their actions and lack of actions. They have extremely rude customer service reps. If you cancel the service and use the labels they provide for the return of their equipment (and I said their equipment that you rent), they will bill you later for the shipping (after the fact). I do not know how many people I have spoke with about the unfair billing. One reply I received was that the company considered the shipping labels that they expect us to pay for is fair billing and these charges will not be waived. In the same email, it stated that they ask the customer to pay this but bill you anyway. I have read many many other complaints (around 100 out of over 20,000) and the unlawful actions they use are extreme. Many people have had money taken out of their bank accounts (I call it corporate theft which I believe is a federal crime) or had their credit cards billed for various unlawful actions. No wonder they are a sinking ship. I do hope that their unfair policies (which by the way are not our – the customer – policies) puts them out of business.

        Its hard to read the many paragraphs of tiny orint on a satellite contract when you have a smooth fast talking “authorized dealer” filling you full of lies so he can get his $300 commission and make empty promises to care about you after that he will care about you after the sale which he cant cuz he doesnt even work for dish and then you left with the endless runaround that is outsourced subcontracted customer noservice in countries afar trying to sort out the lies the salesman told and the truth that is small print many pages deep in a contract people

        joe….ur a retard, it isn’t like there is any room for negotiation, if you want tv/internet you sign the contract agreeing to their OUTRAGEOUS terms. They have created a broken system that is designed to continuously take advantage of the customer.

    I think the government needs to get involved and investigate the business practices of Dish Network. They will find out that their reps are nothing but liars, they will never give you in writing what they have sold you nor they will show you what the actual charges are when they make you sign the contract on their electronic PDAs. You will only find out that you got reamed when you receive your fisrt bill.
    This just happened to me.

    I am having very bad expericence with Dish. They suspended my service and they keep sending bills. I have called several times trying to cancel my account, but it never gets cancelled, and they keep increasing the “amount I owed”.. They took my social security card, the number of one of my credit cards, and all my personal information without my authorization and they say they can do that. How???? Can someone guide me?

    I made a purchasing decision to use Dish Network based on the heavily advertised price of $24.99 for 12 months followed by $39.99 for the subsequent 12 months of a two year agreement. After 5 months my bill increased to $29.99 per month. I could not find a phone number to call and used their provided Chat Session. I was told to “READ YOUR CONTRACT”, “WE CAN CHARGE YOU WHAT EVER WE WANT TO”. I explained that the product was sold as above. They proceeded to show me my bill as $39.99 – $15 = $24.99 and is now $44.99 – $15 = $29.99. I again tried to explain the difference between being sold $24.99 for 12 months and the above method. I had no problem with them raising their rates for new customers and calculating my bill but now it should be $44.99 – $20 = $24.99 to agree with what I was sold. Bottom line they told me to stick it and read my contract: “THEY CAN CHARGE ME WHAT EVER THEY WANT”, regardless of what they sold me. I want a class action against them that will force them comply with the letter of their advertising, which was very clear.

    As to all those “wannabe lawyers” who claim you are bound by the Dish Contract language, giving Dish the unilateral right to change a material term of the contract (namely price) without further agreement between the parties, kindly review your Hornbook on Contracts for the following (which is actually a fundamental basis for the above lawsuit):
    “The Harris v. Blockbuster Inc. decision [1] established precedent in the district that when a contract has a clause that authorizes one party to make changes to the “contract” without notification, that it is illusory and hence the entire “contract” is void.
    Some websites’ “terms and conditions” may be deemed an illusory contract and unenforceable if the language can be changed at any time by the company without notifying users and giving them a chance to accept the new changes. On April 15, 2009, the District Court for the Northern District of Texas ruled that Blockbuster Online’s Terms and Conditions were unenforceable because they gave Blockbuster too much discretion in modifying the terms of the agreement. Following the reasoning in a Fifth Circuit case, Morrison v. Amway Corp., and consistent with a Ninth Circuit case, Douglas v. US District Court ex rel Talk America, the court found that Blockbuster’s arbitration provision was illusory, because there was nothing in the Terms and Conditions that would prevent Blockbuster from “unilaterally changing any part of the contract.”

    I have the same problem as Terry. I signed up for 2 years in November and was supposed to get the very same discount for the first year. It has only been 4 months and they just raised my rate!! Thier customer service rep said that I should have read the fine print, that they can raise thier rates or change programming any time they want to. Then offering us this discount is fraud. It is false advertising!! These people should go to jail!!!

    Sounds like JBL is one of the corporate fat cats sitting in his penthouse office enjoying the spoils of another triumphant victory for corporate America. The fact of the matter is that “DISH” has continued to miss-represent themselves and has not been, or is not being forced to hold up their end of the contracts. Lets be honest, what good is a contract that basically says “we can change, charge, and do what we want with your service, and there is nothing you can do but PAY!” If the Judge overseeing the case can’t see what “DISH’s” real agenda is then I truly feel bad for the American people.

    I just found out on 4/2/11 someone signed up getting Dish services under my name. $485.85 back in Nov 2010. CSR said if a person has your information: ssn, dob and name you can get service. Tech person do not have to get a copy of your d.l or you don’t have to be at home to sign papers. If it is that easy to get cable, I need to sign up for a class action lawsuit…I faxed over police report, ftc info, contact credit breau..I don’t have time for this…the contact person at the Exective Office not returning my call.

    I had a dish contract for 2 years that started in June 2010. In Feb. 2011 I moved and did not reconnect because:1. I was leary about Dish-They send their service people in their own cars without Dish logos on the vehicles.
    2. Later on,when I lost the picture ,the service man showed up and said” You must connect the receiver directly to an outlet and not to a 6 way which I shut off at night to save energy. He said it receives updates at night-result,they charge $15.00 for a service call which should have been done right upon installation.I do not want any more headaches from them-would you reconnect with these amateurs?

    I would to know if there is anyone pursuing a class action suite against dish network. The sales rep I talked to gave me misleading info and also said I can cancel the contract in thirty days (which was a lie). The account specialists were very rude to say the least. My biggest issue is that there is a lot of misleading info the sales rep give to hook someone in to the contract. The technician ask one to sign their PDA’s to report that they installed the equipment. I know you will say I should read what I signing and its my fault I didn’t do it. Nevertheless, they have poor service, reps lie and account specialists are extremely rude.

    I really hope someone files a class action suit against the dish network. They are outright LIARS! They sold me a bill of goods with as so called 2yr price guarantee. Two months into the contract, they raised the price. I called and complained and basically they told me I signed the contract which reads that prices are subject to change. How can they say it’s a price guarantee and then raise their prices? They also lied about our package. We were supposed to get all of the Boston sports teams. Well during hockey season, my husband could not watch all of the games. When I called to complain, I was put on hold for so long, that I had to hang up and call again from another phone. The next person said I would have to buy into another package at a higher rate to get the channel I wanted. Needless to say I didn’t. Now six months into contract my bill goes up yet again. I called to find out why, well it’s a protection plan that was free for the first 6 months. Protection fromwhat? their lies? After screaming at the rep, I told him to have it removed immediately! We should have some recourse for these atrocious business practices.

    Im POed about the continued increased price. I m paying $57.50/mo. now. I started w/ a $24.00 plan. Dish kept raising the price un-announced to the point I had checks bounce on my bank account. (the only way I could get Dish service was to let them take their payment automaticly from my bank account) Today I receives a past payment due of $over $100.00 plus a late payment charge. Talk about reading the contract,,,, WHAT CONTRACT??????? I may have something at the start, but never recieved a copy. I can’t wait to get out!!!

    I called Dish Network agent in Wisconsin Sterling Satelite.com for information on obtaining
    Satellite programming (quote) the agent went ahead and signed me up without my authorization.
    When I got an Email from Dish with a confirmation number and price, I was shocked and sent an Email
    stating that I do not want this order to go thru he said he could not cancel I called Dish and cancelled
    Now as of the 12 of March and waiting 11 business days I have not received my refund in my bank
    Account as I was promised I never had the install done. I also always requested someone from the US
    when I spoke to them the last four times! Dish is a devious outfit not to be trusted they always give you
    a different answer when you call now I was told I have to wait 7 more days . I am sure glad I don’t have
    to deal with them. I hope they choke on the money they took from me.

    After being a loyal and valued customer of Dish Net Works for 3.5 years (August 2008), I elected to make a change and try another company. Over these past several years we had experienced numerous issues with our DVR Box. Sound issues were reported and their follow through was unsuccessful. Back in September 2011 after several attempts to resolve the technical issues they admitted that they could not fix it. The online help/technician said that he was going to place a requisition to have it replaced. And stated that one would be sent out to me and that instead of asking me to hook it up, that he felt a technician should be sent out to service my needs. (this was very kind and appreciated it due to unsuccessful attempts to repair it over several weeks). So they did and a gentleman arrived switched the boxes out and everything was fine. Since their visit, they have raised their prices and kept switching premium paid packages around that confused us and we began to feel that it was partly being done to help justify price increases… Recently we elected to look for another service provider. So I did so and felt the promotional offers and a new 24 month commitment with a different provider was in our best interest. So when I went to cancel my account this afternoon with Dish Network, they said that they would be willing to take off $10.00 a month if I would stay with them. When I said I didn’t want to, they hit me with a $180.00 cancellation fee for an early cancellation.. Claiming that the DVR Box that they replaced was an upgrade and an upgrade is an additional 24 month contract commitment ! WHAT??? I never requested an upgrade! I simply wanted the sound problem fixed and their own service department made the request to switch DVR Boxes… I think that the old DVR Box was outdated (three – 3 Years) at the time “they elected to switch it out” and they no longer had another old/original DVR Box to offer in the exchange as an exact replacement, so they sent out another one and they upgraded it without my knowledge. Which allowed them to manipulate an internal upgrade in their records in order to lock in the customer… I want to know where and how I can file a complaint on this matter. I am very angry and I believe that their actions are so wrong and it is nothing short of stealing from me.

    Learned something from these comments….like the part about the “Executive Resolution Team”. DISH Network are all smiles and motivation when installing equipment and even some simple troubleshooting when service goes on the fritz. Their BIG problem is giving consideration to customers when errors are found. I had service with them for several years including an upgrade to DISH HDTV for Life. I got one of the two years and no consideration for the entire year I thought I had something activated by the installer. DISH didn’t care…..just flipped me off and I did the same for them after the 2nd/final year requirement of the contract. SO glad I dumped them and now enjoying DIGITAL ANTENNA TV. No CNN but hey – DISH lost most of the other channels anyway like AMC, IFC and losing more at this writing. So let them bring on HOPPER and BLOCKBUSTER. Seems like the last act to attract customers….one I suspect will be shortly lived. DISH NETWORK’s shortcomings in customer service, coupled with DIRECTV’s superior muscle is taking them down!

    I have been a customer since 01/2000. In December, 2014 DISH notified me that my receivers were obsolete and needed to be replaced at no cost to me. B/S! Have had billing problems ever since and still not straightened out. I would like to join the Class Action suite.

    just wrong. been charged 10$ a month for hd. I was told by satellite company that dish was charging Me for years and they shouldn’t. so I called to complain and they said they can credit me 10$ for the last month and free hd for life. lol its supposed to be free. what about years worth of over charging. joke.. should be a class action lawsuit. what about the people that are still paying this.
