MySpace Privacy Class Action Lawsuit Complaint Over Alleged Sharing of MySpace.com User’s Personally Identifiable Info With Advertisers

MySpace.com User Files Class Action Lawsuit Complaint Against MySpace Over Alleged Unauthorized Sharing of Personally Identifiable Information With Advertisers.

A class action lawsuit has been filed against social networking company MySpace, Inc. (“MySpace” or “MySpace.com” or “Defendant”) in the United States District Court for the Central District of California (styled Mitchell Leong v. Myspace, Inc., Civil Action Case No. 10-CV-8366 AHM Ex) alleging, among other things, that MySpace transmitted information and data to outside advertising companies that could be used to identify the MySpace users without the MySpace user’s knowledge or consent, purportedly in violation of federal and state laws and in breach of MySpace’s agreements with its users, according to the MySpace.com privacy class action lawsuit complaint.

The MySpace privacy class action lawsuit complaint reportedly alleges, among other things, that each MySpace member has a unique user ID that is a public part of all MySpace profiles, that anyone can use an ID number to find a person’s name on a standard web browser, that MySpace encourages users to share personal information, that MySpace.com’s privacy policy provides that MySpace will not share personally identifiable information with third parties without permission, but that MySpace allegedly shared user names or ID numbers with Google, Quantcast and the Rubicon project, allegedly without the MySpace user’s permission, authorization or consent.

The MySpace class action lawsuit complaint is reportedly brought on behalf of a putative class of all MySpace users, unless otherwise excluded, who reside in the United States and who, at any time after November 3, 2006 (i) interacted with MySpace’s authorized applications or (ii) clicked on a third-party advertisement displayed on MySpace’s social networking website.

I have been trying to delete my MySpace account for the last hour and a half using the methods prescribed in their help section. The final step, which requires you to fill out a form containing your email address, selecting a Topic of “My Account”, selecting a Sub-Topic of “Delete Account”, entering your vanity name into a text box, and clicking Submit, has failed to complete a dozen times in a row. Instead, it indefinitely displays a “Hang on a sec” notice which I’m witnessing exceed 30 minutes in time without finishing. Calls to their customer service will not reach actual people, calls to their legal department result in an answering machine, of which I left a message instructing them to delete my account and to send confirmation. This is all in response to their ineffective privacy protections and unauthorized distribution of my personal information to third party individuals without my consent. I believe two things should occur: #1, a company should never be allowed to introduce a new feature that defaults sharing of your personal information without your consent, like both MySpace and Facebook have engaged in. #2, deleting of accounts and personal information should be processed as a top priority by the companies information systems and every website that collects such information should have a standard form required by law that will accomplish the task with minimal consumer effort (such as legislation that allows you to unsubscribe from marketing email easily). I am tired of this abuse and will henceforth be deleting all of the publicly available information about myself that is still within my control, though I fear it is already too late. It says something about the state of affairs when consumer privacy can be violated to this extent, with little to no repricussions for the abusors. Google Buzz, Facebook, MySpace are all examples of this, and at worst they are still able to deny fault and donate chump change to mop it under the rug. Meanwhile, they never actually cease engaging in these anti-consumer tactics.
