eBay Sellers Auction Duration Class Action Lawsuit Receives Class Certification For eBay Sellers.

Class action lawsuits pending against eBay Inc. (“eBay” or “Defendant”) in the United States District Court for the Northern District of California, San Jose (styled Michael Ewert v. eBay, Inc., Civil Action Case No. C-07-02198 RMW and styled The Missing Link, Inc. d/b/a Bath Plus, Inc. and Jeffrey Marks v. eBay, Inc., Civil Action Case No. C-07-04487 RMW), alleging among other things, that eBay auction listings are often not listed for a certain period of time due to technical and other delays, that eBay failed to disclose the existence of these delays to eBay auction sellers, and failed to extend the eBay auctions listing period to compensate for these delays, have been certified as class action lawsuits by Judge Whyte, according to the eBay auction seller class action lawsuit news report.

The eBay auction seller delayed listing class action lawsuit is reportedly brought on behalf of the following certified class of persons:

“All eBay customers, beginning on April 20, 2003, who advertised a listing for sale on eBay.com using the Sell Your Item form and using the “start listing when submitted” default selection for listing start time. Excluded from the class are (a) claims based on listings with the “Buy It Now” option where the item was sold at the “Buy It Now” price; (b) defendant eBay and its subsidiaries, affiliates, officers, directors, agents and employees; (c) any government entity; (d) any judge or judicial officer presiding over this matter and his or her immediate family members ; (e) claims for personal injury and wrongful death; and (e) any and all legal representatives of the parties and their employees.”

    The damages model referenced by the Judge would be a huge amount. Did eBay disclose this suit in their 10Ks over the last five years? If not, this suit could be the least of their problems.

    I found this after doing a search for auction duration issues on ebay. I posted a listing on Thursday late afternoon, so that it would end on Sunday late afternoon. Now I am looking at my auction, and it says it’s a 7day listing, even though I know I chose 10 b/c I had to pay an extra fee! Now customer service will not tell me why there is a discrepancy, just that I can relist. If I relist it now, it will end on either Saturday or Tuesday. Neither of these is acceptable. On top of all that, ebay no longer offers a customer service telephone number, only Live Chat. It took me 28 minutes to get connected, and it has been over an hour since then, and I’m STILL on chat, the past 30 minutes of which I’ve spent requesting to be connected with a supervisor!! I used to love ebay, but now, not so much.

    ebay is running a 100 free listing items. However, if you are a new seller as I am. I am only allowed to post 1 item per day. As I look at the “list you item” (last page) it is charging me the listing fee!
    I have to call e-bay, wait 30 minutes to chat, once they pick up, I spend a minimum of 1 to 2 hours with them to try get my $1 refund….??? is this on purpose, so we get tired of calling everyday to ask for our money and they get their listing fee? i tried to fix this issue yesterday, and the customer rep promised me the problem was fixed and that i would not be charged again until i reached the 101 item. Today i had the same issue. as i was trying to fix the issue the rep. gave me the runaround. I told him the same thing i told the girl yesterday “to please fix this because i have an 18th month old i need to look after and gets into trouble, i cannot be on the computer chatting for 2 hours while she gets hurt” well right now she has a purple cheek soon to be black. And to top it all off the rep. just hung up on my! he totally dissed me, now i am on hold for another 30 minutes. I am so furious, i am about to type up a thing and send it to the local news. I have the copies of the chat they send to my e-mails! i am so furious because I called 2 times, i got lied to, hung up to, and now my 18 month old daughter has a purple cheek , and worst of all i might have to be calling everyday to get my $1 refunds?
    If anyone starts a law suit for something similar please let me know i am so joining.

    PLEASE! I need to join the class action lawsuit but how! Please respond. This is my situation with ebay. Hi I sell software on ebay and find that some people will copy my software and make up lame excusses why they want a full refund ebay tells them to send it back and ebay takes the money out of my account and give it back to them after they copy it. I end up paying for shipping to them so they can copy my software. Even walmart don’t take back software after it can be copied. Ebay will not stop acting like a president of my online company. They take money out of my account for this anytime they feel the need. I even state no refunds on software. Ebay don’t even make them work out their lame excuse with me they just tell them to send it back and take my money. Causing me to pay for buyers to get free software anytime they want it. Can they be stopped?

      Federal law forbids the refunding for cash or credit opened copyrighted software/other media for the purpose of (you) returning an ‘OPEN BOX’ to the manufacturer for credit or refund and this law was designed to protect the software companies from dishonest people. All a seller can legally do is exchange the software for the exact same title (if defective) or agree to refund the purchase to the buyer without the seller having any intensions of returning the open box to the manufacturer for cash or credit. If eBay is forcing you to issue refunds for OPEN software I would report it to SIIA (siia.net) and they can and will pressure eBay to conform to Federal Law regarding the returning of OPEN software or other copyrighted media products. However, you may want to check eBay policies on selling software/media, as you may have agreed to refund the purchase(s), at your expense on any eligible refundable situation when you posted software/media for sale.

    We are new sellers on eBay with sports memorabilia. It has been an exercise in frustration. Our items have been taken off for various reasons stemming from us not having a high rating (no win situation, since we’ve not been able to sell anything yet!) and other sellers questioning our items and their authenticity! eBay did not even contact us to see if we could prove their worth, instead based on someone else “reporting us”, we’ve had our items taken off and even our selling priviledges denied for 5 days. We’ve been slapped on the wrist for something that we didn’t do.

    Furthermore, we feel like this is a defamation of character, since our items are the authentic, now if we put them back on buyers will think they’re suspect!

    Lastly talking to customer service there is laughable, except we weren’t laughing! It was like talking in circles. Their representatives have no useful information to help you in any way. Nor can they elevate your situation to someone who could actually help. Instead we’re instructed to reply to an automated e-mail and get almost the same “rejection email” just re-worded.

    I am on board with a class action lawsuit against eBay as I feel they have unfair practices, no recourse for sellers (who are their customers) and have defamed our character by falsely making allegations about our items!

    12 years on Ebay and Ebay says that they do not feel comfortable with me selling goods any more because I can not validate I am authorized to sell the goods. WTF we own the good, we have them manufactured in teh USA as our own product and sold for over 12 years as a power seller and now we are being cut off.

    One thing a lot of folks do not know is if a buyer files a not as described claim and you the seller give them all their money back, ebay keeps the sale fees and does not refund them to the seller. Buyers only have one option when wanting to cancel a transaction and that is NOT AS DESCRIBED. Seems to me that ebay has it rigged so as to keep the sales fees when a not as described case is opened. If the buyer gets the item and it for instance doesn’t fit even though the size listed is correct, they can only open a not as described case. Then ebay gets to keep the final value fees even though the seller refunds all monies.
