GMAC Homeowners In Maine File Class Action Lawsuit Complaint Against GMAC Mortgage Over Alleged False Foreclosure Documents, Affidavits and Certifications.

A class action lawsuit has been filed against GMAC Mortgage, LLC (“GMAC Mortgage” or “GMAC” or “Defendant”) alleging, among other things, that GMAC Mortgage filed knowingly false certifications for foreclosure and false affidavits in support of foreclosure, according to a class action lawsuit news report.

The GMAC Mortgage foreclosure documentation class action lawsuit complaint reportedly alleges that thousands of Maine homeowners have lost their homes due to judgments based on alleged false GMAC foreclosure certifications and affidavits.

According to class action news reports, depositions of GMAC employees reportedly show that GMAC Mortgage does not verify the truth of information necessary to give GMAC the right to foreclose when GMAC signs certain foreclosure documents.

    Iam for this I am presently trying to get a loan madification from them.I do not understand Gmac.I have been denied twice.First time do not make enough money.Second time I make enough money.Third time tru an attorney I do not qualify for the Hamp.Iam self employed an has income .Was served with foreclosure suit with documents signed by Jeffrey Stephan who is involved with Gmac in this Law suit.I want to live in this home because rent is almost like mortgage.I suffered severely mainly due to the economy and extreme weather conditions during the course of this year.January to March snow.July heat.Now is mainly rain.My wife has spent a lot of money to improve this house in the last four years.

      Exact same thing happend to me! My payment was sent back and they told me they didn’t recieve my paperwork in a timely manner and my house was going up for sale in 3 days…3 Days!!!!

        Need class action attorney they did they same thing almost to me on the mod lied and told me everything ok and sale was pulled then boom they sold house and tacked on 35k in charges I had 67k in equity before this started.         The same thing happened to me… I sent a notorized document and they sent it back… The notory did not have me sign it…and they said it was to late… They would not work with me! I lost my home after 30 years!

        Angry non-homeowner… did you end up loosing your home in forcloser. What and who can I talk to the same thing is going to happen to me but I was told by GMAC not to pay my bill. They would send it back.

    SINCE THE BEGINNING OF THIS YR I HAVE BEEN TRYING TO CATCH UP WITH MY MORTGAGE WITH GMAC. FIRST I WAS TOLD TO SEND 3,OOO DOLLAR SO WE DID, SO THINKING IM ALMOST CAUGHT UP, THEY HELD MY MONEY FOR 10-15DAYS, AND SO IT WAS NO GOOD AND SEND ME BACK MY MONEY. IN 3 ATTEMPTS I HAVE SENT IN THE MODIF. PACKING AND EVEN ONE TIME I SPENT 52$ IN FAXING 23 PAGES, AND THEY SAID THEY DID NOT RECEIVE IT. THEN I CALLED, AND ONE THE REPREST. SAID SEND $3,535 AND THE MAKE YR REG PYMENT WITH EXTRA PYMT TO CATCH UP. SO WE DID, AND OFCOURSE AFTER 10-15DAYS THEY SENT UP THAT CHECK AND OUR REG PYMT AND EXTRA PAYMENT. THE I WAS TOLD OOOH , THAT PYMT WENT TO ANOTHER ACCT. I SENT THEM ELECTRONIC CHEK FROM THE BANK, STILL DID NOT GET ANSWER.. AS OF SEPT 2 I SENT IN ALL ORGIN TAX IF AND PAYSTUBS AND I AM STILL AWAITING ANSWER. I CALL EVERYDAY. IF WAS ALSO ADVISED THAT MY FORECLOSURE DATE IS NOV 2 THEN I WAS TOLD NOV 9….WAT THE FLIPPING HELL IS GOING ON!!!!!!

    I was the owner of new car franchise after 30 years GMAC closed my business put me out of business if any body listen to my story they feel sad how GMAC did to me .I am looking to find an attoney In California to take my case .GMAC is using tax payers money and destroying the country it is time to stand up and build the future of our chidern and remove company like GMAC from our system .

    We tried and tried to work out some sort of plan.
    After hours and hours and more hours nothing ever resolved. letters paperwork etc etc.
    Gmac bumbling fools. Non decission makers just passing the buck…
    Then all of a sudden we find our house is forclosed.

    I lost my family home to GMAC here in Brunswick, Georgia. I tried twice and was given the runaround from office contacts. They were very incompetent and after faxing documents they said they did not receive information on numerous times. I found out today that after going through a buyout by US Bank first, our house of 90,000 sold for 47,500.00. The banks are practicing open corruption in my opinion, and a lot of folks I talk to here agree, without any checks and balances from the government.

    friend of mine went thru some kind of modification to his home morgage also. after signing 1 set of papers sending them back 2 months later sent another batch of papers for him to sign saying there was some kind of screww up in the first ones sent previously so what ever money he had sent prior to that was thrown over into some thing els giving him no credit whrer needed. Finding all this out a month or so later when they are contacting him to tell him he is going into 2 months behind on the payment but still want him to sign a second bath of papers…to make a long story short and hearing him talking to these people on the phone 50 + times trying to straighten this mess out close to a nervous breakdown he and i both, they told him 10 26 2010 to send in a payment of $2900.00 some odd dollars and he be caught back up; said he could send it in the next day, that evenening at midnight they threw his home into foreclosure. We, I being diagnosed with cancer in the last 3 months and him being 54 and a few health issues himself, i worry the man is in for a nervous breakdown from all this and it certainly does nothing good for my health having to deal with this either.
    Anyhow, you would have to speak to him to get the rest of the details- ins and outs and whatever….i wish there was more I could do for him. Whoever helps if they can I just hope they can do some thing fast for him, he has worked hard for what hes got like alot of other folks so ive beeen hearing this bunch called aley? GMAC? bank of america? they are crooks to say the least!

    My husband and I lost our home to GMAC. Three times they said we qualified and sent us papers. Then said we sent nothing at all. Then the check would come back. It was impossible to speak to anyone more than once. Each person would give us different information. Finally the house went up for foreclosure. We tried to explain we were in the middle of a loan mod and they insisted they would stop the foreclosure up until the night before. They lied to us over and over. Even after the house was sold, I received papers saying they had not received our papers on time, proving that we had indeed been in the middle of a loan mod. That was one month after the house was sold at auction! We lost the home we had built for our children. Sick feeling!!!!! Does anyone know of a California class action suit?

      GMAC employees are a bunch of inept individuals who have no idea what the heck the right hand is doing from the left. We are in California and too lost our home in foreclosure while awaiting for modification documents to come in the mail as promised. We filed a law suit against GMAC and it is currently pending. I kept a record of the date, time and name of representative that I spoke with every time I contacted them and logged a summary of the conversation.       I’m not a lawyer, but if you can prove you were approved or qualified for loan mod, kept a log of your calls, time, date and name of individual you spoke with along with a description of your conversation then I wouldn’t depend on a class action law suit! If you can afford it, hire a lawyer and sue them personally for unfair business practices and a whole bunch of other actions! They’re nothing but a bunch of incompetent idiots! A good lawyer should be able to seek compensation for your loss. Also, find out if your house was sold to another party or if it was just returned to the bank’s books. If it has returned to the bank’s books you can fight to get the foreclosure rescinded and get your house back. Feel free to email me. I have good attorney representing us for similar situation.     I’m having a heck of a time trying to find the “category” we fit in. In 2005 my husband and I were duped into a 125% 2n mortgage with Ditech, a GMAC company. In 2008 I lost my job in mortgage after the mortgage mess hit, I called Ditech to do a loan mod and they said we qualified. Never once did they ask for any documentation, they just reduced our monthly payment by about $250 and said this would be our new permanent payment once we made this amount on time for the next 3 months. They ceased sending any bills and said I could only speak to 1 person and gave me his number. They said we had to call to make the payment each month and advised we would be dropped from the plan if we missed it by so much as a minute. I called every month to pay the payment on the due date and was never once able to reach this person I was to speak with, I resorted to calling the general customer service to take the payment. They of course could NEVER find any information about this in their “system” but happily took the payment and said they would pass the info along. Each time I called to speak to my contact it was always the same thing, “the voice mail box you have reached is full, please try your call again later” I sent letters, I faxed letters, I called and called to no avail. We made all 3 payments and then nothing, literally nothing. Ditech fell off the earth, they stopped sending any bills and I never heard from them again. I kept calling my contact and got the same message each time, I called customer service and was told I had to call him directly and I needed to discontinue calling this line as my file was being handled by the foreclosure department. Now this is a 2nd mortgage, besides being floored by the “F” word I was taken back at the thought this company actually thought they could foreclose on us above our 1st mortgage! Our first would never subordinate to them.

    We ended up having to file bankruptcy and included this 2nd in the filing, the odd thing was when doing the research for account verification even the judge could not verify our loan with them. They claimed the account had been settled, then they claimed we were not customers, then when the finally admit we had a loan there they lied and claimed we had not paid them since 2007. I had all the documentation to prove otherwise, but they were not budging. The judge called them a “crazy mess” and said we will be better off without them. He reviewed it and said they had not filed a lien on the property and advised us to sell ASAP. We had to wait till the bankruptcy was discharged and then attempted to place the home on the market, and guess what…they placed a lien on the property the day after the BK was discharged!!! We now couldn’t sell the home because there was no clear title. Because of this we ended up in real foreclosure with our 1st mortgage because we could not sell the home and pay off the 1st either. We gave them all the docs we had and it didn’t make a difference at all. All because GMAC and Ditech don’t know how to properly conduct business. Granted I could no longer afford the 1st mortgage payment, but I would NEVER had ended up in foreclosure if it had not been for these inept, greedy, liars!! Now what, I don’t want the house I just want them off my credit report so I can someday get credit again!

    We have been battling with GMAC Mortgage since June 2010 for a loan modification. Our circumstances are like so many others that i’ve read here with GMAC giving us the runaround, losing documents we’ve previously faxed, having a previous payment not applied to our account, the amount we owe in order to ‘reinstate our loan’ has almost tripled in just a few weeks without them being able to explain why, being told we would not go into foreclosure during our modification process but in fact we were served with foreclosure papers just the other day, the list goes on and on. Now, luckily we are looking into being a part of a class action lawsuit to protect our home. If you have a loan through Bank of America, GMAC Mortgage, Chase or several others and you’re going through this same issues as so many other homeowners, contact the law office of Kramer & Kaslow 866-990-4262. I got a letter in my mail box today that I have to pick up a certified letter from GMAC. I know its not good news. I have yet to get the letter. Im getting it this week.       Start by contact your state attorney general’s office and file a formal complaint. And make sure to keep a detailed log of all your communication with GMAC. Date, time, name of representative and a summary of the conversation. Noting exact phrases they may use… for example, they told me they would “reset” my mod packet and “reissue” stating that it was “standard industry procedure” to do so. This way you have a clear record of all communication so you can use against them in court. Get them with their own words…. Good luck.

    We also got foreclosed on our home with GMAC. Basicaly the same as everyone else. Sent in modification documents .. was put on forebearance plan. GMAC kept losing the inform we sent. didnt matter whether we sent it by fax or federal express … they didnt get it or it was missing something. They would ask for a certain amount of money then they would put it towards fees and then stopped accepting money. They promised us the modification and then foreclosed. I watched my house which had been appraised the previous year at $300,000 sell for $150,000. There were 5 houses auctioned off by gmac that day. There were no buyers. The attorney/auctioneer called gmac after the reading of each foreclosure and gmac bought my house for $150,000. I stood at the courthouse steps with my 5 year old daughter – not able to do anything but I hope we put a face to our foreclosure. I am just sick about these laws. If gmac hadn’t assessed so many fees and hadn’t stopped taking our money … maybe we could have gotten a deal and got the house for $150,000.

    My mother is losing her home due to the same games that GMAC has been doing to some of you. They first say yes, then no, then you don’t have income, then your paper is late (it was certified twice), they can’t read a fax… all these deceitful bankers are just stalling.     I TO AM IN THE SAME BOAT WITH GMAC I ONLY MISSED ONE HOUSE PAYMENT AND THEY FORCLOUSED ON ME . THEY APPRAISED MY HOUSE FOR $117.000 AND AUCTIONED IT $143,000 I WOULD LIKE SOMEONE TO CONTACT ME SO I CAN EXPLAIN MY CASE AND THAT MY HOUSE WAS ADDED IN MY BANKRUPTCY. I FIGURED THAT THEY OWE ME ABOUT 13,000 AND THEY SAID THAT THEY DID FIND A DISCREPTCY IN WHAT THERE FIGURES WERE.

    I am in loan mod HELL with GMAC! For 2 YEARS we have been given the runaround same as everyone else! I am in Illinois..any class-action suits started yet?? I have contacted an attorney(I need to fax everything..WHERE do I start?)today, so we will see. We even filed a CH 13 BK..all the payments that we directly sent to gmac does not even show up on our statements! THEY put us in this position! We were current when we started all this mess..and NOW we are $65,000.00 in arrears! I will NOT give up..they will have to take me kicking and screaming!     Dear Sirs or to anyone who cares.
    I have tried over the past three years to get a loan mod a serious joke.
    Back in step of 2010 I made a radon call to check on loan mod only to find out that GMAC was holding my payments and told me that from now on I must send in a payment and half I tried to explain that it was all I could do to make my normal payment. They were unmoved and simply said its either make the payment and half or foreclosure.
    I borrowed money and carried on.
    In Feb 2010 I called yet again to find out that once again they were holding funds this time because I now send money orders no longer having a checking act. What was most disturbing was that they seemed to pick and choose what money orders to cash and which ones to not cash. The reason I make this remark is because they had no problem cashing the two previous ones one in the amount of $1000 and one $900.
    I was told that they could not cash one for $ 960 hundred and wanted me to get one reissued. I went to Wal-Mart where I got it asked if they could reissue it per Nicole with GMAC request, they told me it would take min two to three weeks. I did not have this kind of time because of pending foreclosure. I called the next day as usual they could not find any of my funds when they finally did they assured me that they now could cash the $960 and said all I needed to be current was $688 so I sent it next day via money order. All the funds at this point would make excelty one payment, feeling confident now. I went about life i.e. looking for work etc.
    Then on march 10 11 I called just to check things out and to my utter disbelief I was told I was four months late I was shocked and said when was my last payment they reply Dec 2010 no that impossible am looking at my records receipts , as we are speaking, well they have no record of any of my payments i.e. a money order for $500 one for $188 one from $960.00 and a check sent in for $350 after two hours they found all of these funds but still could not cash the money order for $960 the check no reason just did not cash it.
    Again at this point they said they were sending it back to me on March 10 11. I said I need that money put toward my mortgage, too bad! I feel that I have been pushed into foreclosure. And once again they want a payment and half. I need that $960 they also said they sent it out to me on Feb 1 11 when I said I never received it, WA la they found it. So now it is my fault and might lose my home.. For me this is insanity and criminal, it was my belief that the mortgage company was going to be held responsible and honesty WHAT IS HAPPING

      Sounds more like you need a job…maybe some roomates or a man with a job to pay your mortgage???…These people have real problems and I think your just looking for a way out. If your 2 weeks late on a phone bill they contact you…4 months behind on a mortgage and no contact I call B.S… I feel sorry for these folks and I am not sure you will find anyone that cares.

    Going through the same GMAC hell. Have been trying to get a loan mod now for 2 years. Samething, lost paperwork, returned payments….. Foreclosure threats, its just been hell. The last 14 months I have had to battle GMAC myself as I lost my husband 14 months ago, I have bent over backwards and sent them the last bit of his life insurance I had left with the promise they would work with me, needless to say they lied and lied and lied. Now they are wanting me to do a Short Sale on our HOME. Needless to say, I handed them a little over $10,000 to live in my home for 12 months, and the Hell has not stoppped yet. I have lost track as to how many times We/I have send in paper work requested my GMAC onloy to be told many time they never received it, in addition I cannot tell you how many hundreds of dollars I have spent in faxing in 26 – 30 pages when they requested it over and over again. Actually, in June of 2010 at 2:06pm on a Friday afternoon I faxed it 28 pages for a loan mod, then less then 48 hours later, on the following Monday morning in my post office box was a Denial Letter for that loan mod packet. As if suddently loosing my husband 14 months ago wasn’t enough, these MONSTERS are killing me, now they are trying to take away the only thing I have left of my husband and that is OUR Home.
    Need help in Missouri!!!! Attorneys that may be able to help me, Class Action Lawsuits in Missouri against GMAC Mortgage. I will fight with all that I have left Not to loose Our home.

    We are fighting with GMAC also. We tried to get a loan mod and were told we didn’t qualify because we were not behind on the payments. So we missed a few payments and asked for the loan mod papers. They said we now qualify. After losing our paperwork twice my wife decided to go with an attorney firm which has already taken 1,000 of our money and done nothing. Is there a class action against GMAC in Washington state? We would like to join.

    I’m in Texas. I requested modification in September and then put my house on the market for sale, some investor made an offer in October. In the meantime, GMAC indicated they were reviewing my modification. 2 months later, my home was sold in foreclosure to same guy who made offer in October. Called GMAC immediately, was told my home was NOT in foreclore; then sent me a mod denial letter postmarked 3 days later. The purchaser indicated it was a “foreclosure list”. How? When my home was not being foreclosed on? Need an attorney quickly.

    We have to get lawyers and Congress to go after these people and get as smart as them it’s bad to say but in order to save your home you have to get a dirty as them everyone who has been forcloused on need to protest in front of the White House and Congress and maybe then something will happen , if your living on the streets because they didn’t care but to lie to you we should stand up I went thru this for now 2 years and still going thru it they will not even give me a settlement price on my loan if I could sell my home. the keep saying they don’t know what the amount would be , but yet they set my payments in half for 11 months and then refused to take another payment and wanted about 10,000.00 and still wanted more paper work we as tax paper’s and home owner’s that have invested our saving and life into these homes need to stand up , they come together for other things and protest, We should go after these CEO and company’s and have them charged , at least then they wouldn’t be taking billions from us

    I was previously married for 22 years. Under the divorce agreement I gave up all of my rights to the marital property and filed a quit-claim-deed like GMAC told me too. You are writing your comments here to find possible solution, but some scammers act as a victim and give you a phone number to call. These commenter act like they already called that phone number and solve their problems, while the commenter is actually the scammer who try to charge you $4000 for loan modification, but the tell you they want to include you with the general lawsuit that and return to s you 25% of your loan principal. This is the lowest way to scam innocent people. They call themselves “Class Action lawsuit”, I already contact them, they are not even attorney, they just want to suck the last drop of your blood and clean you valet. What a Shame

    I need to sue these crooks. We have never been delinquent on any payment. They decided that we did not have insurance (even though we did) and charged us $1500 for bogus premiums. (The actual coverage only costs $300, but they marked it up 500%) Then they started foreclosure on our home for the insurance premiums, not for mortgage payments. Even though this is duplicate coverage, we paid them their bilked $1500 while we started refinancing with another co. They got the money, which they owe us, but are calling us 2-3 times a day to harass us. Whenever we try to show them that we have record of them receiving the check – they hang up on us and there is no # to call back. I hope these idiots all go to jail.

    GMAC Mortgage modified our second mortgage and then sent us a 1099 C for the loan “forgiveness ” in 2010. Now, we just closed on a lower interest loan. GMAC Mortgage added our “loan modification forgiveness” that they turned into the Federal Government under the Obama Plan onto our final payoff. Double dipping. GMAC Mortgage. Illegal. Millions of dollars for a class action lawsuit. You could make millions. We were Told ” ‘Get a lawyer. It’s unethical, illegal and clearly defrauds the Federal Government.’ ” email us back!

    omg i hate GMAC mortage they are horrible people who do nothing to help you and lie to you! 2yrs ago my husband lost his job and went on unemployment of about $1500.00 a month! we had already been paying on the house for over 7yr and are trying our best to raise 3 grandbabies! i am disabled with copd and severe degeneration of my spine from the neck alll the way down my spine! after working over 30yrs i was turned down for ss because i was not old enough so tryed for the ssi part and turned down for it to because they said my husbands unemployment was concidered mine omg! ok our house payment was $1000.00 a month which left us a whole $500.00 to pay bills and buy grocerys there was no way! my husband called GMAC to see what we could do to not loose the house. they told him we quailified for some emergency thing where we only had to make half payments we thought thank god that helps! and we were getting food stamps for the first time ever that helped alot! needless to say our nightmare with GMAC had just begun after making 3 half payments like they said we recieved a letter of foreclosure from them demanding a $8000.00 baloon payment to keep our house omg how do you do that on $1500.00 a month and trying to raise 3 grandbabies? thank god our 81yr old neighbor that loves us paid our way out that time! and we still owe her i feel so bad! needless to say it has happened 3 more times in the 2yrs it started! we give up we are tired of them! our main concern is that our grandbabies we are raising have no one but us as my 25yr old daughter was killed by a drunk driver and my 34yr old daught is dying of heart failure as i type this! so when we loose the house and no where to go im sure social services will step in and take our kids for being homeless! i hate you GMAC sitting there in your million dollar homes that are paid for because yoy SCREW poor people like us! may you rot in hell! marla buckley

    i have been reading some of your stories about the HORRIBLE MORTAGE GMAC! i saw my wife has written our story to i just want to ad a couple things as my wife said our nightmare began 2yrs ago or longer with GMAC! i am the type of person that takes things calmly the exact oppicite of my wife! i guess you can say i let people run over me as my wife puts it and she is right! i am to calm and let people take advantage of me but now since our NIGHTMARE WITH GMAC began over 2yrs ago im still calm and bend over backwards with GMAC thinking if im calm things will be ok! but now i know im wrong for the over 2yrs our nightmare began with them i cannot take it anymore! i feel like a looser that cannot provide for my family! and believe it or not i have actually thought about taking my own life thinking my family would be better off with out me thanks to GMAC! at least that way i wont have to see my wife and grandkids on the streets with no where to go or turn to!     GMAC is the worst mortgage company to ever work with. We were qualified with other lenders, but we were promised closing costs to be paid by GMAC if we went with them and a lower interest rate. AT CLOSING they doubled our closing cost, jacked up our interest rate, and didn’t pay for any of the closing costs. I hate this company sooo much. I was furious on the phone for hours, ready to walk away. I had to take an entire day off for their screw up. And reluctantly decided to sign even though the interest rate was still twice what it should have been. DO NOT USE THIS LENDER. THEY ARE THE WORST.

    I’m sobbing as I read these stories!!! How can these people be allowed to destroy so many lives AND our Country all at the same time!!! We have got to do something to stop this! We lost our home 1 yr ago, I thought it would get easier (the monkey off your back) but everyday the realization of the SCAM that GMAC put us through and everything they took away, my familys security, my kids forever home, my pets, our dream, makes it hard to get up in the morning!! We put everything we had into our home only to have it all ripped away. And the kicker…… it all happened because GMAC TRICKED us into it!!! They TOLD us to let our payment go 90 days late in order to qualify for a loan mod. We were only 30 days late at the time but according to them, the only way to even apply for a loan mod was to be 90 days late! We were paying $2800.00/mos on a $315k loan so we had to get our payments to a reasonable amount! Once we did that they strung us along for another 10 months having us apply and re-apply until we were so far behind we could never catch up without a loan mod AND WHAMMO they came in for the kill telling us we had 30 days to vacate the premises. My biggest regret is letting fear dictate my actions!!! Having 2 small children and not wanting the Sherriff to show up at my door I allow those blood sucking, heartless, scammers to force me and my family out of our dream home!
    My advice is don’t leave!!! Fight!! Fight for your home, fight for your family and fight against these CRIMINALS!!!

      my wife and i filed for a loan mod 3 times. We were told at first we make enough, then told we don’t make enough. We are currently working with the hardest hit foundation to try to get some help with these blood sucking bastards. Our mortgage has gone up twice and gmac says it is due to the economy. I didn’t vote to bail out wall street and the auto companies. Why should we pay for their greed? GMAC is heartless cruel bastards who will one day get theirs!! I agree with Kelly Wood…fight fight FIGHT!!!!

    Was forced to sell my home through gmac mortgage. They would not answer my calls to work something out. When I did talk to them they suggested selling the home. after that they would hang up on me.
    Working with this company was the worst experience of my life causing excess stress. They charged me with pmi insurance when I had paid enough on the home where thy owed me a refund but did not want to talk about that either. I was pressured into selling the home at a loss. by The months of court threats of how my home was going to be sold at the courtroom steps.

    Hi – i had Wells Fargo when i got my home. They accepted my income and gave me a loan. A couple of years pass and they sell my loan to GMAC. Since then, the economy changed. While I have more income, all my bills have skyrocketed and have stretched me to the limits.

    I applied at least 3 times for a loan mod. They lost papers, too and denied me 3 times saying I didn’t make enough money. They also said i needed to cut back bills. So I cancelled all kinds of services, closed credit accounts, and paid everyone to date. I applied again. Same thing. I don’t make enough money.

    WELL DAH! What’s the point of a loan modification? My mortgage escrow has gone up 200 a month in 4 years! Gas, food, cable, internet and insurance have gone up. I have very little bills. Financially i make about 1000 more a month than when I started my loan!!

    Why did they buy my loan if I am “high” risk low income??? Are there any class action lawsuits in York PA? I’d like to join one or have a private law suit. Thanks.

      My story is simular to all the others. GMAC foreclosed on the home I had lived in for over 20 years. I believe they are crooked and they make lots of money foreclosing on property. 3 mortgage companies have made 20,000.00 or more on the sale of my property. I am now without a home or money but they are not hurting for either. I feel that GMAC is foreclosing for profit all over america!!!

    My story is not different from anyone else, except that I paid my mortgage every month and I paid my property taxes every year. The problem started when GMAC Mortgage decided to pay the property taxes because the property tax office sent GMAC Mortgage a letter of deliguency which I explained over and over to GMAC staff and supervisors that’s not true and I sent to GMAC Mortgage copy of my bank statements to proof payments of the mortgage and property taxes, but nobody listen or check any documents that I provided. My monhly mortage payment deposited in escrow account, which closed in 2009, instead of depositing my monthly mortgage payments to the mortgage account. I keep calling them everyday that I paid my mortgage every month and never been late, as well as my property taxes. I even helped, after several trips to the property tax office, to retrieve all the money GMAC paid to the property tax office in Houston, Texas, to expediate the process, and of course paid back to GMAC. But GMAC mortgage still insists that I am two months late in paying my mortgage. I am filling personally a law suit against GMAC Mortgage.

      I have the exact same problem. sent proof of payment numerous times, they claim they never got it. They also told me that the property tax office sent them notification that my tax payment was delinquent. Here is the problem with their claim: county property tax offices do not have records of the mortgage company of a property owner (unless the servicer is already paying the taxes as agreed by the borrower). Can you imagine a county tax office trying to keep track of which mortgage company each property owner has? and why would they even want to? I confirmed this with the SF tax authority which is where my home is located. GMAC deducted escrow charges for their duplicate payment, forcing my loan to go into default. I paid them what they claim I owed, but am following up on my own law suit. would be curious to know if you followed up with a suit and if there were any key issues you could share that would help me outl.

    GMAC has been stressing me out to no end, screwed with my paper work when I refinanced in Aug. 2010 not taking taxes out when we agreed and signed for it to happen the blames me saying they are allowed to make mistakes, then takes out home owners insurance denied they were taking it out while I have been paying my home owners on my own myself. I paid 5 grand in closeing costs to lower my monthly payment and bring down my rate from 6.0 to 4.8 just so now they say they did all the numbers wrong, it put my monthly payment back to where it was from the start so I lost 5 grand and no one cares, I did get a lawyer did not help at all, did not matter. I just found out the called my home owners insurance company and told them they will pay my home owners (with out my permission) my home owners called saying I was behind because GMAC has paid them nothing after GMAC called and told them they would pay, so here we go again. BAIT AND SWITCH, they are trying to force me into forclosure even though I have never been late on a payment but came down sick in Aug. 2010 this is why I refinanced to bring my payment down through hard times. There has to be something done to stop them from ruining lives, I wrote to everyone, president, attorney general, banking commision, trade commision …. no one will help!!!! What is happening to the world today …. now they are taking advantage of sick people and people who really need help to save their home and they are allowed to screw us all…this is very troubleing and sad…. no where to turn….president wont even help….I have tried everything, I have nothing left in my , stress brings on my illness and they are killing me.

      Never ever let the mortgage or servicing company pay your property taxes or insurance. PMI you may be forced to escrow but there are loans out there with PMI that do not require you to escrow your property taxes and insurance with the mortgage company. Pay these on time and keep records/receipts showing they were paid on time. Register your GMAC loan online on their website and sign in and check it frequently to make sure they are applying your mortgage payments to your account and not to taxes or insurance. Call your insurance company and tell them under no circumstances are they authorized to take funds from GMAC in payment of your insurance or to make any other changes without your permission and if they do you will terminate with them and move to another insurance company. They work for you not GMAC – make sure they know that.

My wife and I was BLACKMAIL by GMAC late 2007 i lost my job was off till 2009,used all my 401 what little saving, first off GMAC,FANNYMAE, FREDDYMAC, what ever ailias YOU want to use,wouldnt help until your credit is noted and screwed up,had to be at least three months behind, kinda like IRS if you have any mistakes in there faver they dont let you know until you owe them everything , where I think there should be a law that helps poor middle class? or just us poor.That they should have to let you know right away as soon as they know ! I was asking and requesting a loan modification I owed 15yrs on our home. the kept screwing me around and around.finally i thought we were headed in the right direction, they sent me a offer it was bullcrap they were going to lower my mortgage a couple hundred lower the interest a little, but we owed 15 yrs it now going to be 40 yrs , I lost it these people are sick ,thieve and OUR GOVERNMENT is letting them do these, I rejected the offer. Speaking to other in similier siturations said they thought that they would make three ,3 three , shots at modification. so they came back with there second offer (2),at this time I started getting registered mail from there laywers saying I needed to pay X amount of $ , or Im going to be foreclosed on. so the second offer come ups or fedx ? And it in my eyes was BLACKMAIL,exstortion how ever you look at it is illegal in THE U.S.A but i guess not for them,It was worst then the first offer, one hundreds or more for my payment, and still a 40yr mortgage and it stated that this was my last offer and that we would except it or else be foreclosed on, I wanted to tell them where to shove it but, WE have three boys and at that time my very ill sister lived with us she since has passed to a better place, I would love to see these companys get what they deserve , between them and the greedy asses in wallstreet look at our USA NOW.Just wish I had of had a good laywer. the sad thing is there still gettig away with yhit crap. <<BLACKMAILED AND SCREWED

    How do you join in the Class Action Suit against GMAC? Also Why not organize a group assault on the politicians, I do not mean a physical assault, I am talking about a barrage of mailings in continuous succession, demanding they take a stand for the people. It is Campaign time folks, with a little help from the press we could let one of them have a real issue to deal with. I agree the Sneaky way that GMAC has set up the Legal teams with Attorney collection agencies is very wrong, I don’t see why it doesn’t come under the Predatory Lending Laws, that most states passed in regards to LOAN SHARKING. If you look at the interest and legal fees being assessed against individuals who are trying to save their homes, these fees are exorbitant and cannot be substantiated by actual cost. From what I have seen the Legal Firms are used as a cover to stall notifying the home owner until the time limit is exhausted for resolution of the outstanding debt and late fees. Money is intentionally left unclaimed on deposit with NO notification given to the homeowner, until foreclosure is in process. I believe that in 5 years there will be a reckoning with these Law Firms and crooked Mortgage Practices. Everyone SAVE ALL DOCUMENTATION…Log all phone calls…..Save every RECEIPT…GET Names of All Contact personnel (they will probably lie and give you a false name) but document it and the time and phone number you speak with. I think each person involved with the harassment, deceptive trade practices, and downright Extortion of homeowners, should be listed and sued Personally. We may loose the battle and in some cases our homes but I will never stop fighting to make these Crooks pay for the damage they are doing to the American Taxpayer.

We were only two months behind and tried to work lout smething prior to foreclosure. They would not accept any payments. GMAC, Countrywide and Household deserved more than paying back monies to customers. We lost our firs thome and it still hurts.

Even our laws are corrupt to a point. its all about who has the most money. Its not about what is right or wrong anymore. If our government really wanted to do something they would have by now.     I spent 18 months trying to re-do my mortgage. Every time I called them to see where I was, they asked for more paperwork. After 18 months they put it up for sale and I was notified on the day of the sale. They never turned me down for a modification but never answered me either. I think because me and my partner are over 60 they didn’t want to deal with us because of age. We need a lawyer in Washington State (preferably Seattle) to find out why they wouldn’t help us.

    GMAC is terrible, We had put down 20% on a double in Parma Ohio just two months prior to the housing collapse– Needless to say the house we bought is now worth about 90,000 and my son and daughter owe 130,000. my son’s wife was recently diagnosed with MS and due to her symptoms she had to leave her job. My son has tried numerous times to negotiate his monthly payments with GMAC due to a loss of income and they refuse to work with us. Just recently we drove to Chicago to apply for help from NACA to lower his house payment and interest rate- Of course GMAC does not have an underwriter that attends these events like all the other banks, instead we were told that if my son qualifies due to the information we sumitted his house payment would be cut in half and instead of a rate of 7 1/2% he would now have a rate of 2% – this process would take 2-3 weeks. Once again GMAC screwed us over, it has been 2 months, we finally received a letter in the mail and it was a denial letter. We were told that my son made $4,400.00 a month– actually he makes 1,200.00 a month. We told them this is totally incorrect information. Now GMAC is stating that because its been more then 30 days the case is closed- they only allow a 30 day window — but yet it took them 2 months to respond to us. We immediately called NACA regarding this matter and have yet to get any response. I do not understand how these mortgage companies and banks get away with this- where is the government intervention here for us little people who just want the american dream of owning their own home???

    Hello my name is Shirley. I’ve spent years trying to pay off my mortgage. I have paid GMACover 85,000 dollars for a shotgun house that I bought for 6,000 dollars. Their rate was so high and it only kept rising. I have had too borrow money over and over again in order to make payments to them. I have also tried going to loan companies for help but it’d very difficult to get a loan from them. GMAC is nothing but s rip off. They cheat people out of their money and have never been fair to me. I can understand everyone and their suffering. I am a VICTIM.

    My home is in foreclosure and was up for auction yesterday. My husband and I are both veterans and have been going back and forth with GMAC. Our payments were being made through their website and were to be taken out bi-weekly. We received a letter in the mail in January that we were in default because we did not make a payment since November. I paid the 1322 that was owed and that was that. We received another letter of default in April, so we requested a modification. Every document they have asked for, I faxed. I would follow up soon after I faxed the documents, and then they would tell me that they received it and will be reviewing them, and they will contact me in 2 to 3 business days. A week later I would call them and they tell me that they did not receive the documents, so I fax it back to them, and then follow up with a phone call to see if they had received them, with a “yes” we did and we’ll call you within 2 to 3 business days. Same routine over and over again. June 28 2012, we received a certified letter from their attorney that my house will be auctioned off Aug 7, 2012. Mind you, GMAC was still telling me that they are reviewing our documents for modification. I contacted their attorney and they told me to contact GMAC and so I did. I was going back and forth with them because they were still telling us they are reviewing our documents. In a state of panic, I responded to a letter that came in the mail that would guarantee me a load mod and stop foreclosure. I paid them upfront (panic mode) and faxed them all the documents I had faxed GMAC. The law group advised me not to talk to my lender from then on, in which I didn’t, until the day before the sale. I received mail from GMAC informing me that my mod was denied and that my house was going to be auctioned the next day. I called the lender and they told me that there was nothing I could do because I too long. I asked why my mod was denied and they said they did not receive all of the documents. I asked which document, and she told me that page 7 was worded differently and that I needed to fill that out correctly. I told her that I could download it right away and send it in. She told me to go ahead and do so and then send it in and then they’ll review it. I call back in after faxing it in and they tell me it will take them 7 business days to review it and it will be too late then. I broke down at that point because I knew that I have been duped. The law group we had hired informed me that the documents were sent in to GMAC for a modification and that we shouldn’t worry because they will stop the foreclosure or the sale. On Monday, the day before the sale, I received a call from the law group and advised me to get a quitclaim deed from my husband to me, in which I did. They said this was another tactic that will stop them from foreclosing. After I faxed a copy of the deed to the law group, they told me that would call GMAC and speak to the person that they know and that will help me out (kinda strange). That night, the law group told me to download a chapter 13 pro se packet and fill it out myself, and then take it to the courthouse early the next morning (day of the sale). I was up all night filling it out to the best of my ability. I left my home about 7:30 just so I could be at the courthouse to file, but unfortunately, they told me that the paperwork was not complete and it was done incorrectly. I kept calling GMAC and their attorneys. They told me to pay almost 14,000 for a reinstatement, which is the first time they have ever mentioned it. Had I known that this could have been avoided I would have sold my truck. I check back with the attorney yesterday afternoon and they told me that GMAC bought the property back. I called GMAC to see if I can keep my home and the answer was no. I am now in talks with a new attorney who is reviewing my case, and hope that we can make this into a lawsuit. I believe that things happen for a reason, and I believe that I will save my home. My God is much more powerful than GMAC and whoever is working for them to scam us out of our money and homes. I will not let this defeat me and I will continue to fight for my home. Please do not be discouraged. Fight on and keep on keepin’ on.

      Please let me know what I can do to sue them because they took my property and bought it back without me even knowing that someone was able to buy it at sheriff sale. I was in another part of Ohio due to employment and did not recieve any paperwork till after the fact. I do not that this is legal. Please advise wat you re going to do to overcome their unethical tactics.

    I have read and understand the above mentioned about GMAC. I myself have become a victim of gmac and i think its time for a change. I think letters should be sent to all political parties since this is election year. I for one believe we can make a difference.     I have setup an “auto-pay” voided check and took all the necessary steps to insure my GMAC loan was paid on time, and not only do their creditors continue to harass me, but they have submitted a false credit report to the 3 major credit companies with a false claim of over 90 days late. I am in the process of suing them.

    Is it too late to get help? We were foreclosed on in 2008, somehow, someway, they managed to get the house back in our name as of May of THIS YEAR (nearly four years later!!!), now they are trying to hit us with another foreclosure! We just found out about all of this TODAY! We haven’t lived in that house and it was taken out of our name nearly 4 years ago, how can they do that?!?!
    Any help would be REALLY REALLY appreciated!

    I lost my husband 2008 and I retired in 2009. My property and been in the family for over 150 years I have tried everything to hang on to the homestead. They sent paperwork for foreclosure I went a filed Bankrupcty to stop the foreclosure. Finally I went through NACA and got a so called modification 10 years interest only at the end of 10 years balance due. Well it gave me time to try to get a real modification. My son and his family gave up there place moved in with me to help save the homestead. They couldn’t gave me a modification because I don’t make enough so I showed where my son gives me some now they say I make to much and can’t get on the HAMP program. They said they only had the HAMP and Traditional modification programs and I don’t fit in any of them. But I’m going to apply again. I’m about $170,000 upside down in my house. All I wanted to do was keep our homestead. Can anyone help us save our homestead??????

    I really hope by 2013 something is being filed against GMAC! I’ve been in the same boat as everyone posting on here for over 4 years now and of course GMAC has now filed bankruptcy to get out of the fraud they’ve committed. I surprisingly am still in my house, but very close to losing it. Who or where do we turn to?

    GMAC held my mortgage for several years before I could no longer make the payments and requested a modification package. They sent it, but also sent a letter telling me to seek credit counseling for help. I did, and the counselor even helped me prepare the package. She faxed it to GMAC and I waited two weeks as instructed. GMAC told me that they didn’t receive a page of the fax, but that the whole package had to be updated. So I did. Again, the credit counselor faxed it for me and again I was told something was wrong. Long story short, I sent in the mod. package 4 times and was told 4 times that something went wrong . I gave up, found a place to move into and vacated the house because of the impending foreclosure. Later in the year 2013 I received a check from the class action lawsuit against GMAC for $1250 and the letter with the check said that cashing it would not release GMAC from any further action I may care to take against them. I’m wondering, if GMAC owed that to me, is it possible to find out if they owe me more? Anyone ??

    A side note to my comment above; I did not fax the package to GMAC from the same fax machine. Office Depot charged me quite a bit for faxing it.
