Philip Morris Marlboro Lights Cigarettes Class Action Lawsuit

A class has been certified in a class action lawsuit against Philip Morris USA, Inc. (formerly Philip Morris Incorporated) (“Philip Morris” or “Defendant”) in Missouri Circuit Court, Twenty-Second Judicial Circuit (City of St. Louis) (styled Craft, et al. v. Philip Morris Companies, Inc., et al.,Cause No. 002-00406-02) alleging, among other things, that Philip Morris misled people about the amount of tar and nicotine delivered to smokers by Marlboro Lights cigarettes, and about the dangers of Marlboro Lights cigarettes, according to the Philip Morris Marlboro Lights Cigarettes class action lawsuit notice.

The Court reportedly decided that Philip Morris Marlboro Lights Cigarettes Class Members include, with certain exceptions, all residents of the state of Missouri who purchased and consumed Defendant’s Marlboro Lights cigarettes in Missouri between February 14, 1995 and December 31, 2003 but who have not filed a claim for personal injury resulting from purchase or consumption of cigarettes.

The Plaintiffs in the Philip Morris Marlboro Lights Cigarettes class action lawsuit reportedly seek to recover the amounts they say Class Members overpaid for Marlboro Lights cigarettes, as well as punitive damages (damages in excess of what consumers paid for purposes of punishment), attorneys’ fees and costs.

The Court has scheduled a trial to decide who is right in this case. The trial is set to begin on September 6, 2011 (the date may change) at the Missouri Circuit Court, Twenty-Second Judicial Circuit, 10 North Tucker Boulevard, St. Louis, Missouri.

Class members reportedly have to decide whether to stay in the Class or whether to exclude themselves before the trial, and reportedly have to decide this by August 23, 2011.

    I know that somewhere in the early 90’s My deceased Wife and Myself decided to switch to Marlboro light cigarettes. Due to less tar and nicotine. My wife smoked Marlboro Light cigarettes until her death of emphysema {COPD } in March of 2004. I think we were both miss lead on info about Marlboro Light cigarettes. In 2006 I quit smoking.

    I, my daughter, my two brothers and our family friend were all smoking Marlboro Lights in the time span mentioned. The five of us believed that the Lights were actually lighter in Tar and Nicotine as advertised. Also, at least *four of us were on Marlboros mailing list for coupons.
