A class action lawsuit pending in Anne Arundel County Circuit Court in Maryland alleging that 2007 ground rent reform laws made ground rent leases worthless and constituted an unconstitutional seizure of private property for public use without compensation to the lease holders, has been certified as a class action by Anne Arundel County Circuit Judge Paul F. Harris Jr., according to class action lawsuit news reports.
The Maryland ground rent lease reform law class action lawsuit complaint reportedly alleges that under the old ground lease laws, a ground lease holder could eject a tenant, seize the house, sell it and keep the proceeds if ground rent was not paid. The ground rent reform bills reportedly abolished the legal process used to seize homes, banned the creation of new ground rents and mandated that ground lease holders register their leases with the State.
The Maryland ground rent class action lawsuit reportedly includes an estimated 116,000 to 212,000 ground leases to which thousands of homeowners pay rent on the land beneath their homes, unless they buy out the leases from the land owner.
