If you are a current or former owner of lessee of a 1999-2001 Volkswagen Jetta IV vehicle, or a 2002 Volkswagen Jetta IV vehicle you may be included in a class action settlement, and if you paid for the repair or replacement of an original or genuine Volkswagen replacement front spoiler, caused when the vehicle was backed off of a curb, bumper stop or similar obstruction, which damaged only the spoiler, and this damage occurred less than five years after your vehicle was originally placed in service, you may be entitled to reimbursement for each such repair or replacement up to $140.
A settlement has been reached in a class action lawsuit against Volkswagen of America, Inc. (“Volkswagen” or “Defendant”) in the District Court, Twenty-third Judicial District, Pottawatomie County (Shawnee), Oklahoma, (styled Rajina Hess and Kelly Parsons, et al. v. Volkswagen of America, Inc., Case No. CJ-05-205), alleging, among other things, that certain 1999-2002 MY Volkswagen Jetta IV Sedan/Wagon vehicles sold by Volkswagen, are defective in that the front bumper cover and related components, including the front spoiler, part no. 1J5 805 903 B, can be damaged if the vehicle is backed off a parking barrier, curb, or similar obstacle onto or over which it has been driven, according to the Volkswagen VW Jetta Spoiler class action settlement notice.
The Settlement Class in this case reportedly includes all current and former owners and lessees of a 1999-2002 MY Volkswagen Jetta A4 (“Jetta IV”) Sedan/ Wagon vehicle (Jetta Sedan 2002 Model Year VIN up to and including 3VW___9M_2M099360; Jetta Wagon 2002 Model Year VIN up to and including WVW___1J_2W693058) distributed for sale in the United States and the District of Columbia, by Volkswagen of America, Inc.
Under the Volkswagen VW Jetta Spoiler lawsuit settlement, Volkswagen will reportedly reimburse actual expenses incurred by a Settlement Class member for repair or replacement of a Front Spoiler in the Settlement Class Vehicle, caused when the vehicle was backed off of a curb, bumper stop or similar obstruction at any time up to five years from the date the Settlement Class Vehicle was placed in service, regardless of mileage, as long as no repair was performed on the Bumper Cover, in an amount up to $140. In order to be paid, Volkswagen VW Jetta Spoiler settlement class members must complete and return a claim form postmarked by November 14, 2012.
The Court will hold a class action approval hearing at 9 a.m. on November 16, 2012, in the Pottawatomie County District Court, 325 North Broadway, Shawnee, Oklahoma, 74801 to consider whether the Volkswagen VW Jetta Spoiler settlement is fair, reasonable, and adequate and in the best interests of the settlement class.
