Verizon Wireless “Pay As You Go” Data Charge Class Action Lawsuit Settlement

If you did not have a data plan and were charged a data usage charge by Verizon Wireless, you could be entitled to benefits from a class action settlement.

A class action settlement has been reached in a class action lawsuit against Cellco Partnership d/b/a Verizon Wireless (“Verizon Wireless” or “Defendant”) in the United States District Court for the District of New Jersey (styled In re: Verizon Wireless Data Charges Litigation, Class Action Master Case File Civ. Act. No. 10 Civ. 1749 (FLW) (LHG) (D.N.J.)) alleging, among other things, that Verizon Wireless erroneously billed pay-as-you-go data charges (i.e., charges to Verizon Wireless subscribers who did not have a data plan and were charged for each megabyte or portion of a megabyte used) to some customers (for example, allegedly some customers incurred data charges when they did not access the internet, did not access the internet beyond the Verizon Wireless Mobile Web home page, or did not engage in any activity involving data usage; when they had a “data block” in place; or when they unintentionally pushed a button on their phone that allowed access to data usage), according to the Verizon Wireless Pay As You Go Data Charge Class Action Settlement notice.

The Verizon Wireless Pay As You Go Data Charge Settlement Class Members reportedly include all former or current Verizon Wireless Customers nationwide who, unless otherwise excluded, incurred one or more pay-as-you-go data usage charge(s) at any time from November 2007 to January 31, 2011.

In addition to the credits and refunds issued as part of the program announced by Verizon Wireless in 2010, Verizon Wireless has reportedly provided more credits and refunds to current and former subscribers who may have been mistakenly charged for pay-as-you-go data usage.

If you are a Verizon Wireless Pay As You Go Data Charge Settlement Class Member and believe that you paid for an erroneous pay-as-you-go charge for which you did not receive a credit or refund, you may contact Verizon Wireless to request a credit or refund. If you do so by October 28, 2012, Verizon Wireless will reportedly promptly initiate a review of your past data usage and charges to determine whether you are entitled to a reimbursement, and if so, Verizon Wireless will issue a credit or refund. Verizon Wireless will also seek in good faith to resolve such requests within thirty (30) days after it has the necessary information, either from you or from its own databases. Additionally, for 24 months after the settlement becomes effective, Verizon Wireless will not charge Settlement Class Members for access to MyVerizon or for access to the Verizon Wireless Mobile Web home page through the WAP gateway, so long as the Settlement Class Members do not navigate from that web page to a third party website.

    I am asking about MQUBE a company that send unsolicited text messages to your phone and charge your company and you 9.99 for each one. We have tried sending them a text to stop and unsubscribe and they say no. We are not the current subscribers. When I looked them up online they had a law suit against them for this very reason and it said to go to this website to file with the class action lawsuit. I can’t seem to get Verizon to stop these charges, and they said if we can’t get the company to stop they can just keep racking up charges we didnot ask for and do not want. How do I stop them?
