United Healthcare (n/k/a UnitedHealth Group) UCR Reimbursement Class Action Settlement

A Proposed Class Action Settlement Involving United Healthcare Corporation (Now Known As Unitedhealth Group), And Its Subsidiaries And Affiliates Will Provide Cash Payments To
Persons Who Received Or Furnished Out-Of-Network Healthcare Services And Who Qualify.

A class action settlement has been reached in a lawsuit pending against United HealthCare Corporation (now known as UnitedHealth Group), Ingenix, Inc., Metropolitan Life Insurance Company, American Airlines, Inc., and their subsidiaries and affiliates (“Defendants”) in the United States District Court for the Southern District of New York (styled American Medical Association, et al. v. United HealthCare Corporation, et al., Case No. 00 Civ. 2800 (LMM) (GWG)) alleging that Defendants provided insufficient UCR reimbursement for Covered Out-of-Network OON Services or Supplies, according to the United Healthcare | UnitedHealth Group UCR Reimbursement Class Action Settlement Notice.

The United Healthcare | UnitedHealth Group UCR Reimbursement class action complaint reportedly alleges that defendants used flawed Ingenix databases in determining reimbursement amounts for Covered OON health benefits, used OON reimbursement policies to reduce reimbursement amounts improperly for Covered OON health benefits and inadequately disclosed the use of the Ingenix Databases and their OON reimbursement policies in determining reimbursement amounts for Covered OON health benefits, purportedly in violation of various state and federal statutes, including the Employment Retirement Income Security Act (“ERISA”), the Racketeer Influenced and Corrupt Organizations (“RICO”) Act, the Sherman Antitrust Act, as well as common law breach of contract.

The United Healthcare UCR reimbursement class action settlement, if it is finally approved by the Court, establishes a gross Cash Settlement Fund (various expenses, such as the costs of notice and claims administration and attorneys’ fees for Settlement Class Counsel, will be paid out of the Cash Settlement Fund) of $350,000,000 plus accrued interest to pay claims of eligible settlement class members who submit timely and valid claim forms.

You may be eligible for a settlement payment if you qualify and submit a valid Claim Form, if you were or are:

(1) a Subscriber, which means a member of a healthcare plan insured or administered by a Defendant, and received Covered Out-of-Network (“OON”) healthcare benefits at any time from March 15, 1994 through November 18, 2009 that were processed or reimbursed by a Defendant using the Ingenix Databases (the Prevailing Healthcare Charges System (“PHCS”) database or the MDR Payment System database) or one of the Seven OON Reimbursement Policies (Anesthesia Policy, Assistant Surgeon Policy, Co-Surgeon/Team Surgeon Policy, Multiple Procedure Policy, Preventative Medicine Policy, Professional/Technical Policy, and Reduced Services Policy); or

(2) a Provider or Provider Group, which means a healthcare Provider or healthcare Provider Group who furnished Covered OON Services or Supplies to a Subscriber at any time from March 15, 1994 through November 18, 2009 and whose claim for payment was processed or reimbursed by a Defendant using the Ingenix Databases or one of the Seven OON Reimbursement Policies.

Under the settlement, UnitedHealth Group and its affiliates have also agreed that they will, among other things, stop using the Ingenix Databases at issue in the class action lawsuit and will contribute $50,000,000 towards the funding and implementation of a new database.

    I get my health care through my employer. I do not know if I am eligible for this settlement. I payed out of pocket for my Anesthesia and have had multiple procedures. How can I find out if this applies too me.

      I would suggest checking with your employer to see what health care policy is carried for employees.

      My company has UnitedHealth as an option for the higher coverage plan so I’m considered a “subscriber” in this suit. So, for 11 years I’ve ‘subscribed’ to UnitedHealth via my company option.

      BTW all of my health care providers dropped UnitedHealth due to its problems as stipulated in the suit. Therefore I had to submit my own claims for reimbursement which sometimes took months and several resubmissions in order to get reimbursed. In the mean time I had to eat the payment to my health care provider until finally getting reimbursed if at all.

      If your company does not have UnitedHealth for its employees then you probably don’t have a claim in this class action suit.

      So, check with your company benefits representative about this.

    You will get something in the mail automatically if it applies to you, unless your mail has changed over the years since you may have used the UH policy. Try contacting them direct to see if it applies to you.

    I have a 3+ policy that I always argued they were not paying more. some things were no covered at all.

    My grandfather received a notice in the mail about this settlement. I can’t figure out if it applies to him or not, because his mind isn’t good enough to answer most of my questions. I’m trying to fill the paper out, and all he is saying is that he’s been with United Health Care through Caterpillar for many, many years, and that he retired in 1996. That’s all I can get out of him…I’m not good with this type of thing, but it’s my responsibility to take care of my grandparents now that they’re too old to handle things on their own. The notice in the mail is so confusing I can barely understand anything it’s saying. Is there a website that will explain all of this in simpler terms? So my grandfather could understand what I’m asking him, because I’m not even quite sure what I’m asking him…

    my former employer Upjohn and then Pfizer covered my wife and me with supplemental health insurance by United Health Insurance . I am now retired and as far as I can remember Upjohn and then Pfizer have contiously provided health to my wife and me for may years. I worked for Upjohn for 34 years. Do we qualify for the settlement and if so what action ,if any , we need to take? Does ay one know? thanks

    here is some information that may answer some questions. i called 1800- 443-1073 and spoke with the settlement person. I exlained that i was under the Upjohn /uhc health plan since 2002 ( my wife as dependent also) . they told me that they would send me a form to fill within the next 2-3 weeks. my wife ‘s name would be included in the same form.

      I believe behavioral health/mental health benefits for OON was paid at 50% reimbursement and it should have been paid at 80 % reimbursement or treated as any other illness e.g. diabetes, cancer, etc. Am I right?

    Okay, so I have a question…I received two forms. If I’m not mistaken, I was covered under UHC simultaneously under two different groups. I had UHC benefits through my employer but I was also covered by my husband’s benefits, as we had a family policy provided by his employer. It has been forever since we had any OON expenses but I’m almost positive I had at least a few maternity-related costs. I simply can’t remember because it’s been quite some time.

    Anyone have any idea whether I fill out both forms, one form, neither form? Also, I don’t think I have my policy numbers, either, whee! Thanks much!

    I have had cancer and all the on going medical procedures in incurs. This is the second time I’ve had cancer. The first time, I was fortunate to work for a company that had Blue Cross/Blue Shield. I paid for nothing more than my co-pays for my chemotherapy. UnitedHealthcare has left me more than $40,000.00 in debt and I still have a few more procedures/surgeries to undergo!! I am continually calling and trying to figure out why they are not meeting their 100% (I have met my co-pays and OON expenses) obligation. I continually get the run around. The suit covers up until 2009 but these bills are in 2010. It seems that UnitedHealthcare doesn’t care that it was sued or that it has to pay millions of dollars for their fraud. I would think that in all fairness they should be made to pay all expenses until further notice until they can prove to the courts that they are no longer commiting fraud and leaving their policy holders to pay what they claim they would cover!! I am actually seriously considering resigning my postion with my company I work for because of this insurance company. I will be sending all the information I can find to the company regarding UnitedHealthcare so that they are informed that they are offering their employees a bogus, fraudulant insurance program. I think when UnitedHealthcare loses a company that has over 20,000 employees, it might start to ‘get the picture’. (Then again, maybe I might just get a lawyer and start another class action suit with my company’s employees since UnitedHealthcare really dosen’t mind being sued.)

    I currently work in the medical field and deal with UHC often. Our office is not a contracted provider with UHC and have many patients that have that coverage. I often recommend to our patients that they request what is called “GAP” coverage. If approved UHC will cover the out of network provider at the in network benefit level. UHC will review the request and see if the patient has an in network provider within the patients traveling radius. GAP coverage has to be requested prior to services being rendered. So if you have an emergent hospital visit, you certainly don’t have the time to request this prior! I don’t believe GAP coverage is something UHC will openly tell you about, as I found out about it a few years ago trying to get better coverage for one of our patients.
    As for obtaining your ID #’s – my suggestion would be to contact any doctor you may have seen in the past with that coverage. They should have that info in your chart or scanned somewhere in their computer system. If you were seen at the hospital for any reason – they would have that info. Dr’s offices have access to UHC website and can do a search by name and DOB if they are willing. ID #’s might be on old EOB’s (explanation of benefits) as well. I’m glad someone has realized how unfortunate this OON thing is!

    For those who can’t find their old account number: It doesn’t matter as long as you have the SSN of the subscriber.

    I just called UHC and they have a dedicated number to answer questions about the CA litigation. It is 1-800-443-1073.

    I don’t have all the documentation from the years I was covered by UHC, but there is a simplified form (Group A claimants) that will give you $50 for each year you were covered. The person I talked to also said to be sure to fill out and sign section 6 of the claim form.

      It states above that they will give you $50 for each year you were covered. Would that be each person in your family that was covered or $50 per family?

        It’s per policy holder/subscriber. So, if you and your husband were included on the same policy (i.e., you were the subsciber and he was a family member on the same policy), you’d get $50 total. But if you had separate health insurance policies that both happened to be through UHC, you’d each get $50. Make sense?

    It is about time that UHC was called out on this- after 1 year with them and a very frustrating experience trying to get reimbursed for surgery (of course performed out of network), I had enough and chose another insurance company as soon as my employer’s open enrollment period came around.
    My belief is there are thousands of stories like mine and I hope the judge helps to rectify some of UHCs wrong doings on Sept. 13th.
    For anyone impacted, take the time to complete the paperwork and make your voice heard!

    what if oxford is still paying very small amounts for out of network surgical procedures and paying even less for “multiple procedures” now–ion summe of 2010 ?

    the surgery was done in feb of 2010, and its as if the lawsuit never happnend— one rep told me they were using the ingenix for fee sddcedules currently!!

    im’ not covered under the lawsuit setlemnt because the surgery was after the lawsuit, and yet the same problem exists!! what are my recourses?

    I had insurance throught Metra Health and United Healthcare around 1995 through 2002, and during this time had two of my children. I was wondering how you tell on the EOB if the doctor was in the network or out of network. I tried calling the doctors office that I no longer go to and they did not seem like they even wanted to check on it, since it was so long ago. They did say they were in the network now. I know it seemed at the time that we had terrible bills coming in that were not covered. Is there a way that we can check, by doctors name or hospital name, if they were out of network?

    I had a few surgeries and eye problems out of network, I remember receiving many bills afterward, that I argued I thought should have been covered…(fell on death ears) I checked past paid taxes looking for medical bills I paid, but then couldn’t find copies of original hospital bills…how long are you supposed to hold on to stuff? Where do you store it all? I guess $50 a year is some consolation. There are other medical service facilities I would love to see taken to court

    I recently contacted 1-800-443-1073 inquiring as to the status of my claim. The requested information was mailed approximately the end of September or the beginning of October. When I contacted the above phone number, it was suggested I contact Berdon Claims Administration LLC regarding my claim. At this time, I have no idea as far as resubmitting it.     do you seriously think this evil entity is going to pay anyone? they are thieves who hire the best attorneys (who are all liars) to cover their outrageous theft upon the American people. The don’t pay their doctors, wont let them become in-network providers so they don’t have to pay and they refuse to pay for patient services. they have become the LARGEST INSURANCE COMPANY in the US because of their greed and can keep sucking people in with their lies!     I’m currently fighting with UHC to get my FSA funds reimbursed, and they’re claiming that my expenses weren’t covered. It was dental work and vision. The only reason I chose to have vision correction is that I had a bunch of money in my FSA that I was going to lose, and UHC directed me to IRS publication 502 for things I could spend the account on. Though vision correction is listed, they’re refusing to cover it, and I don’t know who to contact to fight them on it. Any tips would be appreciated. Otherwise, I lose the FSA and have this big credit card bill, because I put it all on a card thinking i’d have the FSA refund for paying it off.

    I went to the Berdonclaims.com website, they have lots of lawsuits that are “disbursed” ours is still in progress and they say it may take months for monies to be distributed, hoping I can pay off my debt of 24,000! Thats all I ask, should be a million 24 for the mental anguish I had to go through with UHC!!

    This lawsuit applies ONLY to Non-Network Provider claims where the bill was not paid in full due to “reasonable & customary”, as the court contends that the Ingenix UCR database was incorrect. It will NOT apply to network providers, because there is a rate contract in place between UHC & the provider, with the provider agreeing to a pre-set rate of reimbursement. Everyone should be diligent in making sure that ALL providers recommended or otherwise participate in your PPO (Preferred Provider Organization) network. It is YOUR responsibility to check this, not your Doctor or Hospital. So if they recommend Home Health Care, and refer you to a specific home health agency, YOU need to make sure they are in your network. And if the HH agency is NOT in your network, YOU have the right to change to one that is in your network. Insurance companies and health care plans get blamed all the time for claimants laziness or lack of interest in trying to understand their own health care plans and benefits. You are given a Summary Plan Description when you enroll, and an updated one periodidcally when benefits change. READ IT. And if you don’t understand it, go to someone in your company that will explain it to you. You can save yourself thousands of dollars if you just make the effort to understand and abide by your health care plan.

    We received the information last year. I haven’t received any paper work back. Peter T. Farm is my husband and we haven’t heard back about what to do since our home burned down. We traveled and we did have out of pocket hospital / medical bills as you well know.

    Please get back to us. We call that number the court told us to call but you have a voice mail instead of having someone available.

    We were under United Health for over two decades under different policy’s.

    We are making a copy of this email even though on your board for our records. We feel this is necessary since we have not heard back from anyone.

    Please respond that we don’t have to contact the court.

    I have received a postcard dated March 25, 2011, indicating a 60 day deadline from that date to submit further proof of claim. The card arrived at my home in Huntington, Long Island on April 2, 2011.
    Additionally, no address is provided on this card to send the ‘additional proof ‘ if one were to mail it to Berdon. I Called Berdon phone number
    and was given a PO Box 1500, Jericho, NY 11853. This is typically, not an appropriate method for the postal service to get a timely return receipt. Additionally, these bulk mailing addresses are well known for leting the return receipt mail lanquist for signatures until the deadlines have passed. The insurance companies routinely do this -I’vehad this done to me by “MEDCO”-our drug company just last year and had to contact my union to get them to pay the claim as I mailed it 12 days return receipt prior to the deadline. 5-16-2011

    I emailed the attorneys office directly, berdon claims, and they said it will be the end of the year before funds are disbursed. Seems insane that it takes 2 years to do this, but I guess some people in these types of cases never see a dime because of the constant appeals etc…Lets just hope thats not the case for us!

    I sent in all my information a long time ago, when the claim was first announced. They have none of it. It got lost somewhere. Now i have no documentation. I found copies of one of them and will send it in but don’t expect the judge to allow it since it is now late. I’m still paying this therapist 3 years later.

    It would be only responsible to acknowledge that your claims were received and even better to keep us informed. I have read countless questions and concerns and no answers. People have lost their homes, gone bankrupt, and lives hang in the balance. Can someone take us seriously???

    last year around early summer ( 2010 ) i recieved, filled out all the paperwork that i was asked to by united healthcare class action litigation/berdon claims admin llc.
    i sent the first portfolio out reg. mail to the address and never heard a thing from the p.o. . so i called the firm in n.y. Berdon and they advz. me the wrong address was given to me.
    so i sent a second set out to them and 12 days went by and Nothing so i went to the p.o. again and ran another tracer and they show it was recieved at such and such time, but no green reciept was ever sent to my home . now no.3 portfolio was sent out and in the interim the registered/certified came to my home from the 2nd time.
    now i have 3 ports out there .
    i recieved a letter from berdon sayto fill out more papers and did so but had to resubmit copys of my medical bills …………so now i have 4-four…. ports out there and went over all the medical bills and found more medical bills so i made copys no. 5 portfolio and sent it on .
    in short if thats possible i sent ..6…. portfolios out to berdon
    ……………………………………………..
    now i want to tell you about the contract firm which i spoke to at least eleven 11…….. times and 6 of them told me that froom 2003 to 2009 i would not have to produce bills, proof of med. expenses etc. etc. just from 1994 to 2002……..i am a guy who likes to be reassured and after 6 or more associates i started to believe them .
    ok speeding this up today monday morning 10-17-2011 i spoke to a lawyer from berdon for the better part of 20 mins and she explained quite a bit to me .
    i told her i felt this was nothing more then a determent from the getgo and said i understand the only ones making out were the lawyers and those with deep pockets …its a damn shame …i laid alot of money out of my pocket from 2001 – 2009 …17 operations/ procedures and now i have to come up with more facts and figures which is next to impossible …i ctc the banks, dr. offices , and now i have to pound the pavement to go to the hospitals and hope they can help me , otherwise i have to go from group B down to group A which is a major downgrade dollar and cents wise.
    again if you can believe this ….this is a short version
    oh one of the contract workers thought it might be a good idea if i contacted uahealth and they might be of help////////they who are sued and lost are going to help me ……you heard of the saying WHAT A JOKE ………
    well i dont know what else to say ….good luck to all of you getting any any monies and most of all group B OR BETTER as group A ….is about 50 USD per year……unless you have 40 yrs or so in ….

      ongoing saga 10-21-11…went to see the billing dept in cleveland clinic past friday …..this gal working it could’nt do enough for me …she not only gave me what i needed she filled in the papers with all the pertinent information on it.
      now i got to go to more hospitals and i i scored again with another hospital.
      moving on i call another cleveland clinic in toledo and they said they could not help me as too much time had passed , i believe she used the word perged and i told her that cant be correct as i was accomidated by her sister hosp. so she put on hold and came and said she could not ..so i told her to check with her archives and that i felt she would be able to get it from there so she put me on hold again only to get prompted by her co-worker and give me the same ……B.S. …….
      for whatever the reason they got it blocked and dont/cant give it out ……it took another hospital approx. one …1.. hr to get what i needed instead toledo cleveland clinic is playing hardball with me ……im not stopping here , im going up a few rungs to get what i need…
      as i said earlier in my first comments i may get kicked down but not without a fight . last yr. i sent 6 portfolios and now on the way to ……seven 7…….i want every damned nickle coming to me and not in some lawyers /corp. big shots pocket .
      sad it’s such a dog eat dog world .
      i have read some of your comments and if you folks think they pay attention to ….Q when/where is my money …etc etc your wrong you ought to pour your heart and soul into this .
      sadly this whole thing is made up of a deep pocket situation , and a large part is a determent to discourage you .
      stop andv think how many people never bothered with this suite , and others dropped out , or say/do as little or nothing to push things ……..thks for your time

    It is my understanding that in November of 2009, two years ago, the settlement was reached. Why does the law firm keep the settlement funds for that period of time and not begin distribution? Methinks they are getting a lot of interest on the funds due to be distributed. After all, it has been two years since the settlement was reached. This firm should be investigated.

    I submitted my claim form long ago when the claims brochure and “How to Submit” were sent out. I called the office there and it was acknowledged that they had received it. When do payments go out? I was told by Berdon Claims a couple of months ago that it would be by the end of this year. That would be the end of December. When will payment checks go out? Nothing has changed with my mailing address, however I do have a P.O. Bx number address, which I put on my claims form.

    HAS ANYONE RECEIVED A PAYMENT FOR THIS LAWSUIT. I HAD UNITED HEALTH FOR OVER 15 YEARS AND TOOK THE $50 A YEAR OFFER, BUT I HAVE NOT HAD ANY COMMUNICATION WITH ANYONE. IF SOMEONE HAS A PERSON TO CONTACT AND A PHONE NUMBER, OR EMAIL ADDRESS I WOULD APPRECIATE IT.

    We got an email from Berdon asking if we still lived at the address on file. That led us to believe they were soon ready to disburse money. This was November 2011

    I just sent them an email asking when the funds would be disbursed and they replied with, “We are hoping to have all claims satisfied the beginning of the new year-no guarantees” . If that’s not vague, I don’t know what it. 🙂

    I sent them an e-mail and this is the response I received on 12/27/2011

    We are close to completing the processing of the entire case, and checks will not be issued until shortly after that happens. Amounts have yet to be determined and will not be calculated until the judge signs off on distribution.

    I just talked to Berdon Claims. They said they are “hoping to make the distributions during the first quarter of 2012” and have no information about the amounts.

      I called Berdon Claims last week and got the same story sometime in the 1st quarter. I feel they just do not know. I also called early December and was told end of December or begining of January checks will begin to be sent out.

    settlement checks,we wait, they did not wait to take the money in the begining now we have to pay taxes on the income. what is the tax on a quarter!
