Toyota 2006 Scion xB Class Action Settlement Over Cracked Windshields

If You Are A Current Or Former Owner or Lessee of a Model-Year 2006 Scion xB, You May Be Entitled To Benefits From A Class Action Settlement.

A class action settlement has been reached in a class action lawsuit pending against Toyota Motor Sales, U.S.A., Inc. (“Toyota” or “Defendant”) in the Superior Court For The State of California, County of Los Angeles (captioned Justin Bauer v. Toyota Motor Sales, U.S.A., Inc., Case No. BC375017), alleging that the windshields of 2006 model-year Toyota Scion xBs are affected by one or more defects that cause their windshields to have a propensity to crack (i.e., they are prone to cracking) under circumstances that would not cause non-defective windshields to crack, that such windshields were improperly excluded from warranty coverage, and that Toyota’s failure to disclose this windshield cracking condition to the consuming public violated various statutes and duties, according to the class action lawsuit settlement notice.

If the Toyota 2006 Scion xB cracked windshield class action settlement is approved, the windshield warranty for 2006 Scion xB Class Vehicles will reportedly be extended to six years or 60,000 miles from the date of original retail sale or lease of the class vehicle, whichever is first.  The Extended Warranty will reportedly cover all cracks to Genuine Toyota windshields unless it is obvious that the crack was caused by something that would normally cause a windshield to crack (e.g., a collision with another vehicle or stationary object, a natural disaster, vandalism, a baseball, or the like).

Each Toyota 2006 Scion xB settlement class member is potentially eligible to seek one of the following two remedies one time:

  1. Toyota Reimbursement Program: If you are a Settlement Class Member who paid to repair or replace a cracked Genuine Toyota windshield installed in a 2006 Scion xB prior to the Effective Date of Settlement, you may seek reimbursement for that expense provided that the repair or replacement occurred within the first six years or 60,000 miles from the date of original retail sale or lease of the Class Vehicle (whichever comes first) and timely file a properly filled out Claim Form.
  2. Toyota Windshield Replacement Under the Extended Warranty: If you seek to replace a cracked windshield in your 2006 Scion xB after the Effective Date of Settlement but within the first six years or 60,000 miles from the date of original retail sale or lease of the Class Vehicle (whichever comes first) you may be eligible to have that windshield replaced for free under the Extended Warranty, provided you present your Class Vehicle to an authorized Toyota Dealer to determine whether you qualify for a free replacement under the Extended Warranty before replacing the windshield.

In addition to these settlement benefits, Toyota has also agreed to pay for the costs of administering the settlement and to pay Class Counsel attorneys’ fees and costs and an award to the Plaintiff in amounts to be determined by the Court, subject to certain limitations. Neither the award of attorneys’ fees and expenses nor the incentive award will reduce the benefits provided to the Settlement Class Members.

A Fairness Hearing is scheduled to be held on July 15, 2010, before the Honorable Emilie H. Elias, Department 324, at the Los Angeles Superior Courthouse, 600 S. Commonwealth Avenue, Los Angeles, California, 90005 to determine, among other things, whether the terms of the settlement are fair, reasonable, and adequate and should be approved by the Court.

    The windshield on my 2006 toyota scion xb has been cracked since the first week I’ve had it. It’s never been replaced and I now have cracks all over it. I will have to have it replaced within the next month. I’m JUST NOW finding out that there is a defect in this windshield. Do I have any rights to the settlement? The mileage on this vehicle is over the 60,000 miles.

    I changed my toyota socion 2006 windshield because the windshield cracked out of nowhere.I just need to have an address to send the reciept.

    i’ve called toyota twice about this settlement and they know nothing about. what’s going on???????????????????????????

    We had our XB for 3 almost 4 years. Within the first 6 months the windshield cracked. We took the car back to the toyota dealer we bought it from, and got some nonsense story that because I drive on the highways every day I should of known it would crack. We replaced it 6 months later and the people who replaced our windshield said they have seen a lot of 05 and 06 XBs with crack windshields. Also they told me because of the position of the windshield they will always crack. They called them “stress fracture”. Not even 3 weeks after replacing the windshield, it cracked again! We started to do some research online and found hundreds of other people who were dealing with the same problem. I took my car back to the dealer, along with all stuff we printed off the computer. They stood right there and said this was the first time ever hearing any complaints about the windshield. (Obviously they forgot that we were just there not even a year ago)…I never replaced the windshield again. Shortly, after our horrible experience we traded the car in.

      My daughters scion rear window has not cracked but shattered twice. Someone is going to get hurt luckily no one was in the back seat.

    My Scion 2006 also cracked out of nowhere. I went to work in the morning and there it was a l shaped looking crack right from the bottom edge of the window. I was really confused cause it didn’t look like a rock hit it. I thought maybe it was the heater air going against a cold winter window… any way my windshield is replaced and I submitted my claim. Now just wating.

    We took our xb in to the dealers after hearing about the settelment becauswe it had cracked just sitting in the driveway. It had 54900 miles and just qualified for the settlement. They replaced the windshield and one week later it broke again! We went back to the dealer and they said they were only requierd to replace it one time. They said they are not required to do anything more. What a Joke! Do0es anybody know if there is anything else we can do. I mean beside never buying another tyota! Please respond

    I bought my 2006 scion new, the first new car I’ve ever owned! It (winshield)cracked a month after I bought it..My husband saved up the money and had it replaced..then we heard about the settlement and we sent in the receipts and filled out the forms..it is 2014 and we still have not recieved a reinburstment or anything from them!
