Southern California University for Professional Studies SCUPS Settles Class Action Lawsuit Over Refunds of Tuition Payments.

A class action settlement has been reached in a class action lawsuit against Southern California University for Professional Studies (“Southern California University for Professional Studies” or SCUPS” or “Defendant”) pending in the Superior Court, Orange County, California (styled Patricia Lee, individually and on behalf of all others similarly situated, v. Southern California University for Professional Studies, , 05 CC 00274), alleging, among other things, that plaintiff enrolled as a student at Southern California University for Professional Studies, was administratively terminated for not completing the program of study for which she enrolled and upon her termination, Defendant allegedly should have given her a refund of all or part of her tuition but failed to do so, according to the Southern California University for Professional Studies Tuition Payment Refund class action settlement notice.

The judge reportedly ordered that the Southern California University for Professional Studies Tuition Payment Refund case proceed as a class action and defined the class as follows:

All individuals who enrolled in SCUPS pursuant to a written enrollment agreement not containing an arbitration clause, who paid tuition and then terminated (voluntarily or involuntarily) from their program at SCUPS, and did not receive a pro rata refund of their tuition less the application fee, and who either (a) terminated their program of study having completed 60% or less of the program of study; or (b) did not request all materials in writing after having received the first lesson. Individuals whose claims are barred by applicable statutes of limitation are excluded as are employees of SCUPS.

Under the Southern California University for Professional Studies Tuition Payment Refund settlement, each Class member will reportedly receive a voucher for free tuition for a certain number of credits. The number of credits will be between one (1) and five (5), depending on the total amount of tuition paid by the Class member, less any refund already received. The value of one credit is equal to an amount ranging from $250 to $330 depending on the program that the voucher is ultimately used for.

The Court has scheduled a hearing for October 24, 2012, at 8:30 a.m., to be held before Judge Nancy Wieben Stock in the Orange County Superior Court, Department CX-105, Complex Civil Center, 751 West Santa Ana Blvd., Santa Ana, California 92701, to determine whether the proposed Southern California University for Professional Studies Tuition Payment Refund settlement of the litigation is fair, reasonable, and adequate, and should be finally approved by the Court.
