You May Be Entitled To A Payment From A Class Action Settlement If You Were Overcharged Because Of The Bidding Of “Halvarez” In A Snapnames.Com Domain Name Auction At Any Time Prior To November 4, 2009.
A class action settlement has been reached in a class action lawsuit pending against Oversee.net, Inc.(“Oversee.net” or “Oversee”) and SnapNames.com, Inc. (“SnapNames.com” or “SnapNames”) (collectively “Defendants”) in the Superior Court for the County of Los Angeles in Los Angeles, California (styled Resmer v. Oversee.net, Inc. and SnapNames.com, Inc., Civil Action Case No. No. BC 434426) alleging, among other things, that SnapNames and Oversee were complicit in the bidding practices of a now former SnapNames.com employee with a bidding name “halvarez” who was not supposed to bid in any SnapNames.com auctions without disclosing his status as a SnapNames.com employee who allegedly bid in approximately 50,000 domain name auctions between 2005 and 2009, according to the SnapNames.com & Oversee.net class action settlement notice.
The SnapNames.com & Oversee.net class action settlement class reportedly includes all persons:
in the United States and its territories who, at any time prior to November 4, 2009 (A) bid in and won one or more Snapnames.com auctions for Internet domain names in which “halvarez” also bid, (B) as a result of “halvarez” paid more for such domain name that you would have had it not been for the actions of “halvarez” and (C) have not participated in the Rebate Program offered by Oversee.net and Snapnames.com. Excluded from the Class are (A) all persons who, as part of Oversee’s Rebate Program, have or will have submitted releases prior to the date the Court finally approves this Settlement; (B) Defendants, their legal representatives, assigns, and successors, and any entities in which Defendants have controlling interests; (C) any judge to whom this case is assigned and those judge’s immediate families; and (D) any attorney who appears in a case concerning the conduct alleged in this Action and those attorneys’ immediate, blood, and marital family members.
Under the SnapNames.com & Oversee.net class action settlement, SnapNames has reportedly agreed to adopt a shill bidding policy for bidding activity conducted on the SnapNames auction platform and will provide a report on the compliance with its shill bidding policy, including the number of shill bidding complaints received; the number of complaints investigated, the number of complaints resolved; the number of complaints outstanding; and the number of suspensions of user accounts as a result of complaints.
SnapNames.com & Oversee.net settlement class members will also be entitled to submit a claim form by December 17, 2010 for a cash settlement benefit for the amount of money they were allegedly overcharged as a result of the bidding activity of “halvarez.”
The Court is scheduled to hold a settlement fairness hearing on January 27, 2011 at 9:00 a.m. at the Stanley Mosk Courthouse on Hill Street, 111 North Hill Street, Department 16, Los Angeles, California 90012 to determine, among other things, the fairness of the settlement.
