Navy Federal Credit Union Class Action Settlement Of Repossession & Post-Repossession Notice of Sale Class Action Lawsuit Approved By District Court.

A class action settlement has been approved in a class action lawsuit against Navy Federal Credit Union (“Navy Federal Credit Union” or “Navy Federal” or “Defendant”) pending in the United States District Court for the District of Maryland (styled Donna L. Whitaker v. Navy Federal Credit Union, Civil Action Case No. RDB 09-cv-2288), alleging, among other things, that Navy Federal Credit Union repossessed certain financed cars and sent Notices of Sales advising of its intent to dispose of the repossessed cars that allegedly failed to include certain information required under the Uniform Commercial Code (“UCC”), according to the Navy Federal Credit Union class action settlement memorandum opinion.

The Navy Federal Credit Union repossession and disposition class action settlement reportedly includes the following settlement class members:

All individuals in the United States, including without limitation individuals who serve abroad in the Armed Forces of the United States, who during the four year period preceding the filing of the Action on July 7, 2009:

(a) have or had a finance agreement held by Navy Federal;
(b) had the motor vehicle pledged by that finance agreement repossessed; and
(c) were sent a post-repossession notice under U.C.C. Article 9 with respect to a motor vehicle pledged by the finance agreement.

Individuals are excluded from the Settlement Class if they:

(i) obtained a discharge in bankruptcy;
(ii) filed a bankruptcy petition;
(iii) entered into a post-repossession repayment agreement;
(iv) had a final judgment entered in a collection action; or
(v) have been involved in a dispute in which they are represented by counsel.

Under the terms of the Navy Federal Credit Union repossession and post-repossession notice class action settlement, Navy Federal will reportedly contact the credit-reporting agencies and request that they rehabilitate the class members’ credit report by deleting the information related to the loans at issue in the case.  In addition, Navy Federal will reportedly pay $50,000 to the Army Emergency Relief, an organization that provides financial assistance to members of the armed forces.

    Hi,
    How can I get official copy of the result of this class action suit. I want to pursue the Credit Bureau on ensuring that Navy Federal follows through with their obligation in contacting Credit Bureau and retracting negative credit reports as per class action suit.

    I need to know if its a done deal and how its going to end also, my credit has been shocked ever since, and i need to purchace a car and have not been able. If some can tell me whats up? I would appreciate it. Or a time frame maybe a letter to show creditors that its fixed.

    I think this is great! I hope it is true. I cannot stand NFCU. I had to file bankruptcy before they came to get my cars. I am paying them off through chapter 13. However, they continue to report not only me as Chap 13 but as in default. Plus every time I call to talk to them they are rude as hell. Treat me like a second class citizen.
    Good luck and sue the hell out them.

      I AGREE I WORK THERE NAVY FEDERAL AIN’T SHIT THEY DO NOT TREAT ALL EMPLOYEES FAIRLY. IF YOU ARE FRIENDS WITH SOMEONE IN A EXECUTIVE POSITION YOU ARE SAFE. YAULL SHOULD SUE THEIR ASSSASSSSS

    Just some FYI for the people who are wondering. I recieved papers on this a little over a year ago. It had everything about the suit, what to do etc.. However, my credit report still shows the account and I would like to know when, and if this will be removed. I know I was totally to blame for the repossesion but, hey sadface for them for not typing out a few extra words. If anyone has any information regarding the final decision it would be much appreciated!! Thanks

    We have been having trouble with Navy Federal over a house purchase. I hope some lawyer takes up a suit against the credit union about their practices in home purchases and sales. A member can not find a person to talk to that can take ownership of your account and work to make it right, The staff called my husband a deadbeat when he was trying to get a fax number to send some papers that they requested. I hope many read these reports and think about the right place to put their money. We did business with NFC for over 40 years,

    They are reporting it on your credit file anyway but it’s listed as a credit card bad debt write off so as to skirt the terms of the settlement regarding “repossession” action. Here it is 2013 and their bogus report as well as a collection agency account still there as a credit card default. Only problem is, I never had a credit card with them. How do they get away with this?
