Shuttle Computer Class Action Settlement of Class Action Lawsuit Over Alleged Defective Shuttle Motherboard Capacitors

If You Reside In The United States And Purchased One Or More Of Shuttle Motherboard Model Numbers AV 11, AV 11-21, AV 18, AV 18E, AV 18ET, ME 64, ME64S, MS 21, OR MS 21N Between January 1, 2001 Through January 1, 2005 Containing Alleged Defective Capacitors, Your Rights May Be Affected By A Class Action Settlement. 

A class action settlement has been reached in a class action lawsuit pending against Shuttle Computer Group, Inc. (“Shuttle Computer” or “Shuttle” or “Defendant”) in the Superior Court of the State of California County of Los Angeles (styled Greg Granquist and Eric Schonning v. Shuttle Computer Group, Class Action Case No. BC319409) alleging, among other things, that Shuttle Computer sold motherboards with allegedly defective capacitors and seeking money damages and injunctive relief for alleged violations of California’s Consumer Legal Remedies Act (Civil Code § 1750 et seq.), and violation of California’s Unfair Business Practices Act (Business & Professions Code §§ 17200 et seq. and 17500 et seq.), according to the Shuttle Computer motherboard defective capacitor class action settlement notice.

Shuttle Computer defective motherboard capacitor class action lawsuit settlement class members reportedly include the following persons, unless otherwise excluded:

All Persons Residing In The United States Who Purchased, One
Or More Of Shuttle Motherboard Model Numbers AV 11, AV 11-21,
AV 18, AV 18E, AV 18ET, ME 64, ME64S, MS 21, OR MS 21 N Between
January 1, 2001 Through January 1, 2005 Containing Defective
Capacitors. The Class Does Not Include Anyone Who Claims
Damages For Personal Injuries Or Property Damage Resulting
From Defective Capacitors. The Class Does Not Include Any
Parent, Subsidiary, Affiliate, Or Control Person Of Shuttle
Computer Group, Inc., As Well As The Officers, Directors, Agents,
Servants, Or Employees Of Shuttle Computer Group, Inc., And
The Immediate Family Member Of Any Such Person. Also
Excluded Is Any Judge Who May Make Rulings In Connection
With This Action.

The Shuttle Computer motherboard defective capacitor class action settlement reportedly provides that Shuttle will repair or replace, at its option (and at no cost to the Settlement Class Member) any Shuttle Motherboard model number AV 11, AV 11-21, AV18, AV 18E, AV 18ET, ME 64, ME64S, MS 21 or MS 21 N purchased between January 1, 2001 through January 1, 2005 containing defective capacitors for Settlement Class Members who submit valid, verified claim forms establishing that they have experienced failure of a motherboard within the class definition.

For those Shuttle Computer motherboard defective capacitor Settlement Class Members who have incurred direct out-of-pocket expenses in connection with the repair, prior to the date of preliminary approval of the Settlement, of a Shuttle Motherboard model number AV 11, AV 11-21, AV 18, AV 18E, AV 18ET, ME64, ME64S, MS 21, or MS 21 N Shuttle will reportedly reimburse such Class Members for the cost of repairs, parts, labor and handling charges in connection with repairing affected capacitors up to Thirty Five Dollars ($35.00) per motherboard, provided such costs are verifiable.

A final class action settlement approval hearing is scheduled to be held on March 30, 2011 before the Honorable Mary Ann Murphy, at the Superior Court of the State of California, County of Los Angeles, located at 111 N. Hill Street, Los Angeles, California in Department 25, to will determine whether (1) the proposed Settlement is fair, just, reasonable, adequate, and in the best interests of the Settlement Class; (2) whether Class Counsel has adequately represented the Settlement Class; (3) whether the Settlement Class should be certified as a Class Action; (4) whether Class Counsel’s request for fees and costs should be approved; and (5) whether final judgment should be entered.
