If You Participated in RCI’s Points® Exchange Program, You May Be Eligible for a Payment from the RCI Timeshare Points Exchange Program Class Action Settlement.
A class action settlement has been reached in a class action lawsuit against RCI, LLC (formerly known as Resort Condominiums International, LLC) pending in the United States District Court for the District of New Jersey (styled Anton Glenz, Valentina Giacchi, Donna Moyer, and Dorothy Wood v. RCI, LLC formerly known as Resort Condominiums International, LLC),, Class Action Case No. 09-00378 (PGS)), alleging, among other things, that RCI rented or otherwise made available certain timeshare inventory deposited by members of the RCI Points Exchange Program to non-members, rather than make that inventory available for exchange solely for members, in violation of certain laws including those designed to protect consumers, according to the RCI Resort Condominiums International Timeshare Points® Exchange Program class action settlement notice.
You are reportedly included in the RCI Timeshare Points Exchange Program Settlement as a Class Member if you:
1) Live in the United States or its territories, and
2) Were a member of the RCI Points Exchange Program, either directly or through a vacation club, on or before April 25, 2012.
The RCI Resort Condominiums International Timeshare Points Exchange Program Settlement provides payments to Class Members, and requires RCI to make certain disclosures about the RCI Points Exchange Program. Under the Settlement, two types of payments are available. Which one you are entitled to depends on whether you are a current or former member. If you are a current member, you may be eligible to receive a $12 payment from RCI. If you are a former member, you may be eligible to receive a $10 payment from RCI. In either case, you will need to submit a valid Claim Form by August 24, 2012.
The Court will hold a Fairness Hearing at 10:00 a.m. on November 1, 2012 at the Clarkson S. Fisher Building & U.S. Courthouse, United States District Court for the District of New Jersey, 402 East State Street, Trenton, New Jersey 08608 to decide whether the RCI Resort Condominiums International Timeshare Points Exchange Program class action settlement is fair, reasonable and adequate.
