If you purchased a Nokia Model 8860 in the United States, a class action settlement may affect your rights.
A class action settlement has been reached in a class action lawsuit against Nokia Inc. (“Nokia”) and AT&T Wireless Services, Inc. (“AT&T”) (collectively “Defendants”) in the Circuit Court of St. Clair County, Illinois (styled Terrell Ervin v. Nokia Inc. et al., Class Action Case No. 01-L-150) alleging, among other things, that the Nokia Model 8860, which was manufactured by Nokia and sold by Defendant AT&T Wireless (as well as other authorized sellers, dealers, or distributors), contained design defects that affected the performance of the phone, according to the Nokia Phone Model 8860 class action lawsuit settlement website and settlement notice.
Nokia Phone Model 8860 settlement class members reportedly include the following persons, unless otherwise excluded:
All persons or entities who purchased a Nokia 8860 phone in the United States directly from Nokia, AT&T, or any other authorized seller, dealer, or distributor of the Nokia Model 8860.
Excluded from the Settlement Class are: (a) Defendants and Defendants’ affiliates and their respective current employees (including immediate family members of employees), former employees who received a Nokia Model 8860 in connection with their employment, officers, directors, attorneys, and agents (actual or alleged); (b) any other authorized seller, dealer, or distributor of the Nokia Model 8860 in the United States, including but not limited to Brightpoint USA, US Cellular Corporation, MCI WorldCom, and Neiman Marcus Group, Inc. and all of their respective employees (including immediate family members of employees), officers, directors, attorneys’ and agents (actual or alleged); (c) resellers, including retailers, wholesalers, and other individuals or entities that purchased Nokia 8860 phone(s) for resale; (d) any judge to whom the Action was or is assigned and the judge’s immediate family members; and (e) all Settlement Class members who timely and validly opt to exclude themselves from the Settlement Class. The heirs, successors, or assigns of any of the foregoing are also excluded from the Settlement Class.
If the Nokia Phone Model 8860 class action settlement is approved, each Settlement Class Member who submits a Valid Proof of Claim will receive a nontransferrable coupon redeemable for a $175 credit toward the purchase of any Nokia phones and accessories in stock and available on the www.nokiausa.com website. The coupons issued as Settlement Benefits will reportedly be non-transferrable and cannot be redeemed by anyone other than the Class Members to whom they are issued, shall not be construed as gift certificates, and will have no cash value. The coupons may be used toward the purchase of multiple products during a single transaction but may not in any event be used in more than a single transaction. All Settlement Benefits issued to Settlement Class Members who submit Valid Proofs of Claim will reportedly be void if not used within sixty (60) days of their date of issue. Settlement Benefits that are not used within sixty (60) days of their date of issue will reportedly not be reissued.
The Court will reportedly hold a Hearing on Final Approval at 11:00 a.m. on July 6, 2011, at the Circuit Court for St. Clair County, Illinois, 10 Public Square, Belleville, Illinois 62220. At this hearing, the Court will reportedly consider whether the proposed Nokia Phone Model 8860 class action settlement is fair, reasonable, and adequate.
