Hi‐Tech Pharmacal Co., Inc. (“Hi‐Tech Pharmacal” or “Defendant”) has reportedly agreed to a proposed settlement of a class action lawsuit filed against Hi‐Tech Pharmacal in the United States District Court for the Central District of California, Eastern Division (styled as Hoover v. Hi‐Tech Pharmacal Co., Inc., Case No. EDCV 13‐00097‐JGB‐OP) alleging, among other things, that Hi‐Tech Pharmacal falsely advertised that its Nasal Ease product temporarily relieves allergy symptoms, according to the Nasal Ease class action settlement notice.
The Nasal Ease settlement class reportedly includes, unless otherwise excluded, all persons who are domiciled or reside in United States, who purchased Nasal Ease in the United States for personal use between April 1, 2010 and February 25, 2014, and were domiciled or resided in the United States at the time of their Nasal Ease purchase.
The Nasal Ease class action settlement reportedly provides that Nasal Ease class members may file claims to receive full refunds (or up to $5.00 per Product, with a cap of $15.00 per Household for claims without proof). In addition, Hi‐Tech Pharmacal has reportedly agreed to make certain modifications to the labeling of the Nasal Ease product and packinging, including that “These statements are based on traditional principles of homeopathy.”
