Intelius Class Action Settlement Of Lawsuit Over Post-Transaction Marketing Of Adaptive Marketing Membership Programs Such as Family Safety Report, Privacy Matters Identity, 24 Protect, ValueMax, Privacy Matters 1-2-3 and Savings Ace

Intelius Post Transaction Marketing Class Action Settlement.

Intelius Inc. and Intelius Sales, LLC (“Intelius” or “Defendant”) has reportedly agreed to a proposed settlement of a class action lawsuit filed against Intelius in the United States District Court for the Western District of Washington (styled as Keithly et al v. Intelius et al. Case No. 09-cv-1485-RSL) alleging, among other things, that class members were unwittingly enrolled in Adaptive Marketing membership programs such as Family Safety Report, Privacy Matters Identity, Privacy Matters 1-2-3, 24 Protect Plus, ValueMax and Savings Ace while purchasing an Intelius product, according to the Intelius class action settlement notice.

The Intelius settlement class reportedly includes, unless otherwise excluded, persons residing in the United States who provided credit or debit card information to a website owned, operated or controlled by Intelius between July 2007 and August 12, 2013 and were subsequently charged for member services offered through post-transaction marketing or for the benefit of Intelius and/or Adaptive Marketing LLC, and who have not enabled or used any benefit associated with the service.  As noted above, examples of such membership clubs reportedly include Family Safety Report, Privacy Matters Identity, Privacy Matters 1-2-3, 24 Protect Plus, ValueMax and Savings Ace.

The Intelius settlement has reportedly resulted in the creation of a settlement fund of $9.5 million in cash and $1 million in vouchers for Intelius products. Class members can file claims to receive up to 3 times the amount the class member was charged for post-transaction marketing services (up to $225 without proof) plus vouchers in amount equal to the amount the class member was charged for post-transaction marketing (up to $75 without proof), subject to pro rata reduction if total claims exceed the amount available for distribution.
