L’Occitane, Inc. (“L’Occitane” or “Defendant”) has reportedly agreed to a proposed settlement of a class action lawsuit against L’Occitane in the Los Angeles Superior Court for the State of California (styled as Tessa Owen v. L’Occitane, Inc.,, Case No. BC491880) alleging, among other things, that L’Occitane requested and recorded certain personal identifying information from purchasers who used a credit card at certain California retail stores purportedly in violation of section 1747.08 of the California Song-Beverly Credit Card Act, according to the L’Occitane privacy class action settlement notice.
The L’Occitane privacy settlement class reportedly includes, unless otherwise excluded, any and all U.S. residents who purchased merchandise with a credit card at any L’Occitane retail location in California between September 9, 2011 and October 4, 2013, and who were asked to provide, and did provide, personal identification information including their address, email, zipcode and/or telephone number, which information was recorded or used by L’Occitane.
The L’Occitane Privacy Class Action Lawsuit Settlement provides that will send a $12.50 Merchandise Certificate redeemable at California L’Occitane stores to settlement class members for whom L’Occitane has a complete mailing address or valid email.
