Lennox & Superior Glass Front Gas Fireplace Class Action Lawsuit Settlement

If You Have a Superior or Lennox Gas Fireplace You Could Get a Protective Screen and Warning Sticker from a Class Action Settlement.

A class action settlement has been reached in a class action lawsuit against Lennox Industries Inc., Lennox Hearth Products Inc. and Lennox International Inc. (collectively “Lennox” or “Defendants”) in the United States District Court for the Northern District of California (styled Keilholtz v. Lennox Hearth Products, Class Action Case No. 08-CV-00836-CW) alleging, among other things, that Lennox failed to adequately warn consumers that Superior and Lennox sealed glass front of gas fireplace surfaces can reach very high temperatures that may cause serious burns to the skin, according to the Lennox & Superior glass front gas fireplace class action settlement notice.

The Lennox & Superior glass front gas fireplace class action lawsuit settlement class reportedly includes the following persons, unless otherwise excluded:

  • Any individual who lives in the United States (including California) and owns a home or other residential dwelling bought for personal, family, or household purposes and that home has one or more Superior or Lennox brand single-pane sealed glass front gas fireplace(s) that was installed between February 6, 2004, and January 11, 2011.
  • Any individual who lives in California and owns a home or other residential dwelling bought for personal, family, or household purposes and that home has one or more Superior brand single-pane sealed glass front gas fireplace(s) that was installed between March 1, 2003, and February 5, 2004.

Individuals who suffered a personal injury related to the Defendants’ fireplaces are reportedly not members of the Settlement Class.

The proposed Lennox & Superior glass front gas fireplace class action settlement reportedly provides benefits in the form of a Protective Screen for the Lennox or Superior fireplace that is intended to reduce the risk of burns to the skin by preventing direct contact with the glass front.  In addition, the Lennox & Superior glass front gas fireplace class action settlement provides supplemental information regarding the safety of the fireplace, as well as a warning sticker to be placed on the fireplace control.

To receive the Protective Screen and Warning Sticker available under the Settlement, class members reportedly must fill out and submit a Claim Form by August 1, 2011 or 60 days after the final approval hearing, whichever comes later.

The Court will reportedly hold a Settlement Approval Hearing at 2:00 p.m. on June 2, 2011, at the United States District Court for Northern District of California, Oakland Division, located at 1301 Clay Street, Oakland, CA in Courtroom Two, Fourth Floor.

      I was not aware or the class action suit, can i still get the screen as i have the fireplace mentioned in the lawsuit and is it free of charge

    I also have the Lenox insert and I was not aware of the class action suite. Would I be able to receive the protective? Also the glass on the front of the sealed box has fogged up. Could you advise if there were any reported issues with the glass. My builder put the unit in my new home in 2007.
