La Valencia Hotel Class Action Settlement Of Class Action Lawsuit Against La Valencia Over Telephone Numbers Or Personal Identification Information Allegedly Obtained During Credit Card Transactions

If you were a customer of one of the restaurants located at La Valencia Hotel who was requested or required to provide telephone number or “Personal Identification Information” during a credit card transaction between November 20, 2008 and July 22, 2010, your rights may be affected by a class action settlement.

A class action settlement has been reached in a class action lawsuit pending against La Valencia Hotel Corporation (“La Valencia Hotel” or “La Valencia” or “Defendant”) in the Superior Court of the State of California for the County of San Diego (styled Stefanie Bradley v. La Valencia, Civil Action Case No. 37-2009-00102572-CU-BT-CTL), alleging, among other things, that, between November 20, 2008 and July 22, 2010, La Valencia Hotel used a credit card form in its restaurants and bar areas that contained a preprinted space specifically designated for filling in the telephone number and/or “Personal Identification information” of its credit card customers in violation of California Civil Code section 1747.08(a)(3), according to the La Valencia class action settlement notice.

If the court approves the La Valencia Hotel class action settlement and you were a La Valencia Hotel customer who was requested or required to provide your telephone number or “Personal Identification Information,” as that term is defined in California Civil Code section 1747.08(b), on a credit card form or otherwise during a credit card transaction at any of the restaurants and dining facilities at La Valencia Hotel between November 20, 2008 and July 22, 2010, then you may be eligible to receive one forty dollar ($40.00) voucher that can be used toward the purchase of food and beverages at any of the restaurants or dining facilities at La Valencia Hotel if you complete and timely return a Claim Form to the La Valencia Hotel settlement Claims Administrator.

The Court is scheduled to hold a class action settlement a hearing on October 22, 2010 at 10:30 a.m., in the Superior Court of California, County of San Diego before the Honorable Steven R. Denton in Department 73 to determine whether the La Valencia Hotel class action settlement should be approved by the Court.
