If you applied for a job with an employer who obtained your consumer report from Intellicorp Records, Inc. or Insurance Information Exchange, You May Be Entitled to a Cash Payment from the Intellicorp Criminal Background Report & Criminal History Class Action Lawsuit Settlement.
Intellicorp Records, Inc. and Insurance Information Exchange (“Defendants” or “Intellicorp”) have reportedly agreed to a proposed settlement of a FCRA class action lawsuit against them in the United States District Court for the Northern District of Ohio (captioned as Roe, et al. v. Intellicorp Records, Inc., Case No. 1:12-cv-02288) alleging, among other things, that Intellicor provided criminal background reports to certain employers that may have included inaccuracies, and/or failed to send required notices to individuals whose criminal history information was reported to an employee, purportedly in violation of the Fair Credit Reporting Act, 15 U.S.C. § 1681 et seq. (“FCRA”), according to the Intellicorp Records & Insurance Information Exchange Criminal Background Report & Criminal History class action settlement notice.
Who Is Included In The Intellicorp Class Action Settlement?
The Intellicorp Criminal Background Report & Criminal History settlement class reportedly includes, unless otherwise excluded, all natural persons who reside in the U.S. who were the subject of one or more consumer reports provided to a third party by Intellicorp or Insurance Information Exchange, for employment purposes, and where such report(s) contained an Intellicorp Criminal SuperSearch result that reflected a record of a traffic or criminal arrest or conviction or other criminal history, from April 16, 2010 to September 16, 2013.
What Settlement Benefits Does The Intellicorp Class Action Settlement Provide?
The Intellicorp Criminal Background Report & Criminal History class action settlement reportedly provides that a settlement fund of $18.6 million will be created to pay class members, pay plaintiffs’ counsel’s attorneys fees and costs and settlement administration costs. In addition, the Intellicorp settlement reportedly provides that defendants will make certain changes to their business practices, provide (for free) copies of criminal history information to settlement class members and provides for a process to resolve disputes regarding inaccurate criminal histories.
Certain Intellicorp class members who were subjected to a Criminal SuperSearch that had a record of a traffic or criminal arrest or conviction or other criminal history but who weren’t mailed a notification will reportedly be sent a check for fifty dollars. Settlement class members who think that their criminal background reports were inaccurate can file a claim to recover up to an additional $2,000.
