Hyundai 2003 Tiburon GT Flywheel & Clutch Class Action Settlement

If you bought or leased a manual transmission, 2.7-liter engine 2003 Hyundai Tiburon produced on or before April 1, 2003, your rights may be affected by a class action settlement. If you paid to replace your vehicle’s clutch or flywheel parts installed in the vehicle, you may be entitled to a cash payment.

A class action settlement has been reached in a class action lawsuit pending against Hyundai Motor America, Inc. in the United States District Court for the Central District of California (styled Michael Parkinson, et al. v. Hyundai Motor America, Inc., Case No. SACV 06-345 AHS (MLGx)) alleging that the clutch and flywheel parts installed in the Hyundai 2003 Tiburon GT are defective and that Hyundai knew of these defects, but failed to disclose them to consumers, according to the Hyundai Tiburon Class Action Lawsuit Settlement Notice.

The Hyundai 2003 Tiburon GT Flywheel & Clutch settlement class members reportedly includes all current and former owners and lessees of a manual transmission 2003 Tiburon GT, produced on or before April 1, 2003, who paid for a replacement of clutch or flywheel parts (flywheel assembly, clutch disc assembly, clutch cover assembly, or clutch release bearing) during the applicable warranty period.

The Hyundai 2003 Tiburon GT Flywheel & Clutch class action settlement, if approved by the court, reportedly provides that settlement class members who paid for a repair or replacement to the flywheel or clutch assembly, will be able to choose between a cash and non-cash options.

The cash option under the Hyundai Tiburon class action settlement reportedly consists of a debit card for 100% of the qualifying claim, which is redeemable for at least 90 days without any fees charged by HMA or the debit card issuer at ATMs and merchants that accept Visa cards.

The non-cash options under the Hyundai Tiburon class action settlement reportedly consists of:

  • (1) a non-transferable debit card redeemable (for one year from issuance) for Hyundai goods and services at participating authorized Hyundai dealers in an amount equal to 125% of the cash value of the qualifying claim, or
  • (2) a voucher, non-transferable except among immediate family members, redeemable (for one year from issuance) towards the purchase of a new Hyundai vehicle in an amount equal to 175% of the cash value of the qualifying claim.

The reimbursed amount will reportedly be adjusted based upon the number of miles a vehicle had at the time of the repair (i.e., 0-50,000 miles eligible for 100% payment, 50,001-75,000 miles eligible for 75% payment, and 75,001-100,000 eligible for 50% payment).

If a settlement class member’s repair involved the replacement of Original Equipment Manufacturer (OEM) parts with non-OEM parts, Hyundai will reportedly reimburse the settlement class member the lesser of the manufacturers suggested retail price of the OEM part as indicated by Hyundai’s published price list to dealers at the time of the repair, and the actual cost of the non-OEM component.

If settlement class member’s repairs were rendered at a service facility other than a Hyundai dealership or any other Hyundai-authorized service facility, Hyundai will reportedly reimburse the settlement class member for the lesser of the estimated retail price for said repairs as indicated by Hyundai’s Labor Times Standard and Hyundai’s published price list to dealers at the time of the repair, and the actual cost of the repair provided.

Settlement class member are also reportedly eligible for reimbursement of rental car expenses incurred because of the repair (up to $150).

However, settlement class members will not be reimbursed for any amount paid for by an HMA warranty and will not be reimbursed if their Tiburon was materially modified with the intent to increase the vehicle’s torque output at any time prior to the repair or if it was used in street or track racing.

Settlement class members must submit a valid and timely Claim Form, along with the valid proofs required in the Claim Form, to  receive a cash settlement payment.

The court is scheduled to hold a fairness hearing on June 28, 2010 at 11:00 a.m. at the United States District Court for the Central District of California, 411 West Fourth Street, Santa Ana, CA, 92701-4516 in Courtroom 10A, to decide, among other things,  whether to find the settlement fair, reasonable and adequate for the settlement class members.

    I have send in a claim for for more than 4 repairs on my car and I called today to ask about the outcome of the settlement on the Tiburon and now they tell me the have no record of my claim

    Can i still get paid i found out after the fact and i own a 2003 GT 6 Speed Manual?

    I received a letter in october 2010 that my reimbursment would be mailed out in 10 business days. I have yet to receive anything back for the settlement! It is now nearing march 2011! I am looking for some sort of feed back as to when i should be receiving something in regards to the settlement letter I received in OCTOBER!

    I submitted my claim forms to Hyundai back in september, I called to follow up and they are telling me they have no claim on file??????

    Hyundai Consumer Affairs is where I originally called back in 2005 to file my first clutch claim and got approval to get my recalls done. My car was in the dealership for over a month and they still didnt do the recalls!!!!

    I just want to get reimbursed for the money I paid out of pocket to fix the clutch (3 times clutch went out!)

    What now Hyundai is telling people they have no record of a claim just to get out of reimbursing and failing to follow a COURT ORDER????

      My clutch has gone out twice now. I was reimbursed for the first one, but it just went out again. Just curious if they ever paid you and if they paid you for the replacement of all 3. Appreciate your input.

    I received a claim form in the mail in regards to my 2003 Tiburon Gt, I filled the form out and sent in all information that they had requested. It stated that I should receive notice in October with an update on the case. I never received anything further from them. I went on the Hyundai website the other day and found out the case had been settled back in June of 2010. On the website it says for a status on your claim please call 800-633-5151 consumer affairs for Hyundai. When I called they told me my information didn’t match up and that they needed me to provide proof of ownership of the vehicle. She said she would reopen the case for 30 days so I could send the info in. Then she called back said she was wrong and that the case is closed that I will not be reimbursed and that it is too late. I never received anything from them stating they needed more information from me. Now the original lawfirm Girardi Gibbs says I can send in an arbitration. Please anyone who is interested in this CONTACT ME! I am considering all possibilities for this. I am curious what Hyundai would think if this got into the news because this was not a very public case. Please contact me as I would like to find out how many people did not receive reimbursment.

      My clutch has gone out twice now. I was reimbursed for the first one, but it just went out again. Just curious if they ever paid you and if they would pay again for yet another failed clutch. Did you ever get into arbitration?

    I got a letter from Hyundai and an email from the attorney about going to arbitration??????

    I sent in my claims on time an Hyundai is telling me “uh we don’t have any record….”

    The attorney is no help to me they won the case, they got paid and we are not reimbursed.
