Helio Class Action Settlement Of Class Action Lawsuit Over Helio Early Termination Fees ETFs

If You Were Charged An Early Termination Fee By Helio Or You Continued To Maintain Service With Helio Because Of An Early Termination Fee Prior To October 4, 2010You May Be Entitled To A Refund From A Class Action Settlement

A class action settlement has been reached in a class action lawsuit pending against wireless telephone service provider Helio LLC (“Helio” or “Defendant) in the Superior Court of California, County of Los Angeles (styled  Samuel R. Vanover v. Helio, LLC, Civil Action Case No. BC 414842) alleging, among other things, that Helio’s contracts with consumers for cellular telephone services imposed unlawful flat rate early termination fees or ETF charges of $175 on Helio users who ended their contracts before the Helio contract expiration date, according to the Helio class action settlement notice.

Helio early termination fee or ETF class action lawsuit settlement class members reportedly include the following persons, unless otherwise excluded:

All current or former Helio customers in the United States and its territories who, at any time prior to October 4, 2010, was a party to a contract with Helio for wireless telephone service that contained an Early Termination Fee (regardless of whether or not they paid any portion of the Early Termination Fee to Helio or any third-party collection agency or any other party to which Helio assigned its rights).

The Helio early termination fee ETF class action settlement reportedly provides that  for a period of two years following the occurrence of the Helio settlement, Helio agrees that if it charges any Early Termination Fee in its contracts with any Person for wireless telephone services, any such Early Termination Fee will be pro-rated (i.e., the amount of the fee for terminating the contract for wireless services before the contract is over will vary depending on the length of time that a subscriber has been in the contract).

Certain Helio early termination fee ETF settlement class members will also reportedly be entitled to submit a Claim Formfor a cash settlement benefit.

The Court has reportedly given preliminary approval to the settlement. A final hearing on the settlement is scheduled to be held on December 15, 2010 at 11:00 a.m. in Central Civil West Courthouse, Department 307, 600 South Commonwealth Avenue, Los Angeles, California 90005 to determine the fairness of the settlement.
