Healthways Class Action Settlement In Securities Fraud Class Action Lawsuit

If You Purchased Healthways, Inc. (“Healthways”) Securities During The Period Between July 5, 2007 And August 25, 2008, Inclusive (“Class Period”), Your Rights May Be Affected By A Class Action Settlement.

A class action settlement has been reached in a class action lawsuit pending against Healthways Inc.  and others (the “Defendants”) in the United States District Court for the Middle District of Tennessee (styled John Richard Beach v. Healthways Inc., et al., Case No. 3:08-cv-00569) (Judge Todd J. Campbell) alleging, among other things, that Defendants violated the securities laws, specifically Sections 10(b), 20(a), and 20A of the Securities Exchange Act of 1934, by causing Healthways to issue materially false and misleading statements during the Class Period, according to the Healthways securities class action settlement notice.

Under the proposed Healthways securities class action lawsuit settlement, Defendants have reportedly created a $23,600,000 cash Settlement Fund, the balance of which, after payment of court-approved attorneys’ fees and expenses, any incentive award to plaintiffs, the costs of claims administration, including the costs of printing and mailing Notice and the cost of publishing notice, and payment of any taxes assessed against the Settlement Fund (the “Net Settlement Fund”), will be divided among all Healthways settlement Class members who submit timely and valid claim forms.

The Healthways securities class action settlement class reportedly includes all purchasers of the securities of Healthways between July 5, 2007 and August 25, 2008, inclusive, who are otherwise not excluded from the class action settlement.

A Healthways class action settlement hearing (the “Settlement Hearing”) is scheduled to be held on September 24, 2010, at 2:00 p.m., before the Honorable Todd J. Campbell, Chief United States District Judge, at the United States District Court for the Middle District of Tennessee, Nashville Division, Estes Kefauver Federal Building and United States Courthouse, 801 Broadway, Nashville, Tennessee 37203.  At this settlement hearing, the Court will reportedly consider, among other things, whether the Healthways class action settlement is fair, reasonable, and adequate.

    MY purchase and sale of Healthways and Cooper Companies were by brokers and managers associated with Stanford group which is out of business. how can I obtain the necessary information to file my proof of claim for each class action settlement
