GeoDeck Composites Decking Class Action Settlement Of GeoDeck Class Action Lawsuit

If You Own Or Owned A Geodeck™ Deck That Was Installed Before October 1, 2007, Your Legal Rights Could Be Affected By A GeoDeck Decking Composites Class Action Settlement.

A class action settlement has been reached in a class action lawsuit against Kadant Inc., Kadant Composites LLC, Liberty Diversified Industries, Inc. n/k/a Liberty Diversified International, Inc., LDI Composites Co. and Green Bay Decking, LLC (“Defendants”) pending in the Superior Court of Connecticut Judicial District of Middlesex at Middletown (styled Michael v. Kadant, Inc. et al.,, Class Action Case No. MMX-CV-11-6006274-S), alleging, among other things, that Kadant Inc., Kadant Composites LLC, Liberty Diversified Industries, Inc. n/k/a Liberty Diversified International, Inc., LDI Composites Co. and Green Bay Decking, LLC (“Defendants”) manufactured, marketed and sold defective GeoDeck decking products or otherwise are legally responsible for the sale of defective GeoDeck decking products manufactured between April 2002 and October 2003 inclusive that was purchased and installed prior to October 1, 2007, according to the GeoDeck Composite Decking & Deck class action settlement notice.

You are reportedly a GeoDeck Composite Decking & Deck Settlement Class Member if you reside in the United States and are an original end-user purchaser of GeoDeck decking products manufactured between April 2002 and October 2003 inclusive, which were purchased and installed prior to October 1, 2007 at an identified property. Excluded from the GeoDeck Composite Decking & Deck Settlement Class are the following: (a) all wholesalers, distributors and retailers; (b) all governmental entities; (c) Defendants, their subsidiaries and affiliates; (d) the Judge or Judges to whom this case is assigned; (e) persons who have settled with and released Defendants from individual claims substantially similar to those alleged in the Litigation; and (f) any persons who timely and validly requests exclusion from this Settlement and the Settlement Class.

The GeoDeck Composite Decking & Deck Settlement provides that, for Settlement Class Members determined to be eligible that have not already received compensation, Defendants will make cash reimbursement to Settlement Class Members or provide replacement GeoDeck decking products at a discounted price. The GeoDeck Composite Decking & Deck Settlement reportedly provides for payment of up to five million dollars ($5,000,000.00) to Settlement Class Members, including cash reimbursement of $1.00 per linear board foot of eligible GeoDeck product or issuance of a product voucher redeemable for the right to purchase certain replacement GeoDeck product at the price of $0.60 per linear board foot of eligible GeoDeck product. If claims under the GeoDeck Composite Decking & Deck Settlement exceed five million dollars, payments will be made and discounts will be provided on a prorated basis.

To participate in and receive benefits from the GeoDeck Composites Decking & Deck class action settlement, settlement class members must submit a claim form by September 10, 2012.

    Question- our Geodeck did rot out after 7-8 years. So all we are entitled to is about $700 when the deck cost much more than that and what we had to do to replace the whole thing also cost much more?

    I agree with Sue Hein. I installed a Geo-Deck and only two years later it was rotten and we had to replace the whole thing. Not to mention that the Contractor had to be re-hired to tear down the deck and paid again for a new deck! This cost was in the thousands and I want to be reimbursed for it also. I stepped out onto the deck and my foot and leg went through the rotten deck causing me to have to go to the emergency room. I have already sent pictures of my leg and the deck months ago. I say that Geodeck should be held accountable for my pain and suffering as well as the total cost of what I had to pay out to the contractor for the demolition and replacement of the old deck. , John Bixler

    MY DECK LASTED LESS THAN 1 YEAR WHEN IT ROTTED. WAS TOLD I WAS ENTITLED TO 6 CENTS PER LINEAR FOOT, AND WOULD BE GETTING A CHECK FOR ABOUT $600. HAVENT SEEN ANY MONEY YET.

    My Geo Deck has been crumbling under my feet for the past couple of years. Went to the place where it was purchased and they always gave me the numbers of Reps. I called left messages and nobody ever called me back. Went yesterday and they gave me this website. Now it looks like I have missed the deadline. What am I supposed to do now? Ive been spining in circles to get this resolved.

    Both of my Decks have crumbled. Where it was purchased didn’t give us any information to have it replaced , kinda like that’s too bad. Yesterday I fell through the deck and had to go to the Dr. as I am A Diabetic and will be a long time healing. I guess we missed the deadline too. If anyone has any info or who to call please help us. Thank you

    My builder told me that Geodeck was out of business and we had no recourse for my very large deck that is crumbling. I just now found out about the class action suit. Can we begin another?

      I too purchased and built a two tier deck with GEO. It’s crumbling and disintegrating badly. Just shows that a warranty is only as good as the company providing it. Dear manufacturers……Your warranties are useless so don’t try to sell me a product that has no real backing ! I wouldn’t buy GEO now…..in the year 2014 or ever. Your product SUCKED when I bought it and you can’t convince me otherwise NOW. I will go out of my way to convince anyone who asks about GEO to buy anything BUT that product.

    I had a deck and screen room built, with GeoDeck, during Summer 2003. Both, the deck and screen room, have been cracking and crumbling under my feet. I found out this class action suit last week, so like most of you I guess I’m also SOL. From what I read in the above narrative, Green Bay Decking (the new GeoDeck manufacturer) was also included as a defendant in the class action suit, but when I called them last week and spoke to a very nice woman, Jessica, she told me that they are not responsible for the decking that was manufactured by previous companies (Kadent). She did say that they will work with me and provide me new GeoDeck at their cost, so that may be the my only choice. Not very happy…………
