Flycell, Glomobi, Mobilefunster, Thumbplay, WebAMG Holdings, Glispa and Motricity Class Action Settlement of Class Action Lawsuits Over Alleged Unauthorized Mobile Content Charges on Cell Phone Bills

Class Action Settlement Announced In Class Action Lawsuit Against Mobile Content Providers Flycell, Glomobi, Mobilefunster, Thumbplay, WebAMG Holdings, Marketing Affiliate Glispa and Wireless Aggregator Motricity Over Third Party Charges On Cell Phone Bills.

A class action settlement has been reached in a class action lawsuit against Flycell, Glomobi, Mobilefunster, Thumbplay, WebAMG Holdings, Glispa and Motricity  (collectively “Defendants”) pending in the Circuit Court of Cook County Illinois (styled Scott Williams, et al. v. Motricity, Inc., et al., Civil Action Case No. 2009 CH 19089) alleging that Defendants charged and billed cell phone subscribers for third party mobile content (such as ringtones, games, wall paper, graphics, news, and other SMS text alerts that are provided through mobile phones) on their cell phone bills without their authorization or consent, according to class action lawsuit settlement news reports.

The Flycell, Glomobi, Mobilefunster, Thumbplay, WebAMG Holdings, Glispa and Motricity cell phone mobile content charges and billing subscription class action settlement reportedly has been preliminarily approved by the court and provides a $9 million dollar settlement fund to pay class members and attorneys fees. Settlement members are reportedly eligible to receive a one-time cash award of $10.00, or a refund of up to three months of content subscription charges.

If you were billed for charges for Mobile Content covered by the Settlement at any time prior to August 27, 2010 that you believe were unauthorized and were associated with any of the Defendants, you may submit a Claim Form to obtain a Set Cash Award or a Cash Refund.

To determine whether or not the unauthorized charges for Mobile Content you received were associated with the Defendants, you can reportedly check your wireless bills for the following eligible short codes under the cell phone settlement:

Under the cell phone billing class action settlement, defendants are also reportedly required to agree to certain consumer protection practices including properly disclosing billing terms, as well as promptly refunding unauthorized content.

The Court is scheduled to hold a Fairness Hearing to determine if the Settlement is fair, reasonable and adequate, and to consider also Class Counsels’ request for an award of attorneys’ fees and expenses, and incentive award(s) to the Class Representatives on December 2, 2010 at 1:30 p.m. at the Richard J. Daley Center, 50 West Washington Street, Courtroom 2402, Chicago, Illinois, 60602, or on such other date as the Court may otherwise determine.
