Department of Fair Employment & Housing (DFEH) v. Verizon Medical Leave Class Action Settlement of California Family Rights Act (CFRA) Class Action Lawsuit

A class action settlement has been reached in a class action lawsuit against Verizon Services Corporation and Verizon California, Inc. (collectively “Verizon” or Defendants”) in the Los Angeles Superior Court in California (styled Department of Fair Employment and Housing vs. Verizon Services Corporation d/b/a Verizon California, Inc., Class Action Case No. BC444066), alleging, among other things,  that Verizon engaged in unlawful employment practices in violation of the California Family Rights Act, Cal Gov’t Code 12945.1 (“CFRA”) with respect to current and former Verizon employees who applied to take CFRA-protected leaves of absence from June 18, 2007 and were allegedly denied medical leave and/or terminated due to denial of medical leave, according to the Department of Fair Employment & Housing DFEH v. Verizon Medical Leave California Family Rights Act (CFRA) class action lawsuit settlement website and notice.

The proposed Verizon medical leave class action settlement reportedly provides for, among other things, that Verizon has agreed to pay $6,011,190 to settle claims according to the following formula:

1. Claimants whose applications for CFRA leave were improperly denied will receive $3,000;
2. Claimants who were disciplined for requesting or using CFRA leave will receive $6,000;
3. Claimants who were terminated, or resigned in lieu of termination, due to absences associated with CFRA leave will receive $25,000.

To make a claim for settlement benefits under the Department of Fair Employment & Housing (DFEH) v. Verizon Medical Leave California Family Rights Act (CFRA) class action lawsuit settlement, settlement class members must submit a claim form on or before February 15, 2011.  Verizon Medical Leave class members reportedly can opt-out of the settlement by contacting the Claims Administrator and submitting an opt-out form on or before February 15, 2011.
