A class action settlement has been reached with Coventry Health
Care of Kansas, Inc. (“Coventry Health Care” or “Coventry” or “Defendant”) in a class action lawsuit in the United States District Court for the Western District of Missouri (styled Casey v. Coventry Healthcare of Kansas, Inc.,, Class Action Case No. 08-0201-CV-W-DGK) alleging, among other things, that Coventry Health Care of Kansas, Inc. (“Coventry”) improperly imposed upon individuals enrolled in a Coventry Missouri HMO plan both a coinsurance and co-payment amount for the same healthcare service in violation of a Missouri regulation and the Employee Retirement Income Security Act (“ERISA”), according to the Coventry Health Care Of Kansas Coinsurance & Co-Payment class action settlement notice.
You are reportedly a member of the Settlement Class if you were enrolled in a Coventry Missouri HMO plan at any time between May 30, 1998 and May 4, 2011 and Coventry imposed upon you both a co-payment and coinsurance charge for the same healthcare service. Excluded from the Settlement Class are the Court presiding over any motion to approve the Settlement Agreement and its immediate family and staff, as well as any persons who timely and validly request exclusion from the Settlement Class.
Pursuant to the proposed Settlement, Coventry will pay $1.4 million into a Settlement Fund to make payments to eligible Settlement Class Members subject to the conditions found in the Stipulation of Settlement. Additionally, Coventry has agreed to amend its Missouri HMO plans to eliminate any requirement that plan members are to be charged, obligated to pay or made to incur both a copayment and coinsurance payment for the same healthcare service.
A Final Approval Hearing (“Hearing”) will be held on September 1, 2011, at 9:00 a.m. in the United States District Court for the Western District of Missouri, before the Honorable Judge David Gregory Kays. At this Hearing, the Judge will consider all timely and proper objections, if any, and will consider whether the proposed Settlement is fair, reasonable and adequate to the Settlement Class.
