ConAgra Alexia All Natural Frozen Potato Class Action Settlement Of In re Alexia Foods Litigation Over Disodium Dihydrogen Pyrophosphate

ConAgra (“ConAgra” or “Alexia Foods” or “Defendant”) has reportedly agreed to a proposed settlement of a class action lawsuit against ConAgra in the United States District Court for the Northern District of California (styled as In re Alexia Foods, Inc. Litigation, No. 11-cv-06119) alleging, among other things, that ConAgra advertised certain Alexia frozen potato products as “natural” or “all natural” even though they contained disodium dihydrogen pyrophosphate in order to retain the potatoes color, according to the ConAgra Alexia All Natural Frozen Potato class action settlement notice.

The ConAgra Alexia All Natural Frozen Potato settlement class reportedly includes, unless otherwise excluded, all persons who purchased Alexia frozen potato products, including Sauté Reds, Mashed Potatoes Yukon Gold Potatoes & Sea Salt, Mashed Potatoes Red Potatoes with Garlic & Parmesan, Waffle Fries, Harvest Sauté, Italian Sauté, Sauté Sweets, and Potato Bites, in the United States between December 6, 2007 and July 10, 2013.

Under the ConAgra Alexia All Natural Frozen Potato Class Action Lawsuit Settlement,  ConAgra will reportedly create a settlement fund of $3.2 million. Settlement Class members can file claims to receive cash ($3.50 for each product, capped at 10 products), Alexia product food vouchers (two vouchers worth $3.75 for each product, capped at 10 products), or a combination of both cash and vouchers.

In addition, the settlement reportedly provides that ConAgra will no longer use disodium dihydrogen pyrophosphate in its frozen potato products and instead will use citric acid or another natural compound, unless the FDA allows disodium dihydrogen pyrophosphate to be labeled as a natural ingredient.
