Blue Diamond Growers has reportedly agreed to a class action settlement of a class action lawsuit filed against it in the United States District Court Southern District of New York, styled Biegel, et al. v. Blue Diamond Growers, Case No. 7:20-cv-03032-CS (S.D.N.Y.), alleging, among other things, that Blue Diamond Growers made false and misleading claims regarding the labeling of certain Blue Diamond Growers almondmilk, almondmilk coconut or cashew blend, almondmilk creamer, almondmilk nog, and yogurt alternative products as “vanilla” or “vanilla with other flavors.”
Blue Diamond Growers reportedly denied the allegations in the lawsuit.
Who Is Included In The Blue Diamond Almond Breeze Vanilla Almondmilk Class Action Settlement?
The Blue Diamond Almond Breeze Vanilla Almondmilk class action settlement reportedly includes, unless otherwise excluded, the following settlement class:
All consumers in the United States who purchased the Products from April 15, 2014 through May 17, 2021 (the “Class Period”).
“Product” and/or “Products” under the settlement reportedly means and includes almondmilk, almondmilk blend, and almondmilk yogurt alternative products manufactured and labeled by Blue Diamond Growers during the Class Period that include reference to vanilla, including but not limited to, the word “vanilla” or the phrase “vanilla with other natural flavors,” on the front pack or in the ingredient statement, including:

What Settlement Benefits Does The Blue Diamond Almond Breeze Vanilla Almondmilk Class Action Lawsuit Settlement Provide?
Under the Blue Diamond Almond Breeze Almondmilk lawsuit settlement, class members can submit claims by November 23, 2021 to receive cash settlement payments. Settlement class members who submit a valid Claim Form with Proof of Purchase will reportedly receive a cash payment of $1.00 for each Product purchased (up to a maximum of twenty Products) and settlement class members who submit a valid Claim Form without Proof of Purchase will reportedly receive a cash payment of $0.50 for each Product purchased (up to a maximum of ten Products).
Settlement payments reportedly may be reduced on a pro rata basis (i.e., equally proportioned) depending on the total dollar amount of valid claims submitted.
