If You (Individuals, Small Businesses and Agencies) Hold A Consumer or Small Business Credit Card Issued By Bank of America, Capital One, Chase, Citibank, Discover or HSBC, Your Rights Could Be Affected By A Partial Settlement of A Class Action Lawsuit.
A class action settlement has been reached with Bank of America, Capital One, Chase and HSBC in a class action lawsuit (Ross, et al. v. Bank of America, N.A., (USA), No. 05-cv-7116 (S.D.N.Y.)) that claimed that defendants Bank of America, Capital One, Chase and HSBC (the settling defendants) and Discover, Citibank and National Arbitration Forum (the non-settling defendants) violated federal law by conspiring, with each other and others to require that their cardholders be subject to arbitration clauses (i.e., that they must arbitrate claims rather than file a lawsuit in court) and give up any right to participate in class actions against these credit card companies through class action waivers, according to a Bank of America, Capital One, Chase, Citibank, Discover and HSBC class action settlement notice.
The Bank of America, Capital One, Chase, Citibank, Discover and HSBC class action settlement reportedly requires the settling defendants to cease enforcing arbitration clauses and class action bans. Currently because of my x husband attaining all of my personal information he has used my cc without permission, I currently have a police investigation going on. HSBC was informed of this and they did not at all co operate with me, my accounts were closed and I had no idea. They knowing that I have an actual police investigation going on they pretty much said they are here to collect I would like to join any class action lawsuits, against HSBC and Chase. Citi Bank was the only company that did the right thing and is helping with the police investigation.
Mary – just wanted to follow up to see how things panned out. Though it was 4 years ago, I pray that everyone on this thread has found some peace and tranquility.
Bank(s) of America are blood suckers, liars, thieves and of course nobody seems to care that they are gang banging the public to death! The rich lawyer in Virginia Beach, who is retired, has 300-400 staffers that don’t help you either, they work for the BANK, so do the realtors and development companies, I’ve called them all. I worked with the so-called Home Modification Program and they transfer you off, pawn you to wrong departments, or disconnect you altogether, or they can’t speak English very well and I can’t understand them. This went on for 5 months. At first they wouldn’t consider a Modification on the Loan due that I was only one month behind and it was just a “temporary situation”. After 2 months to find a job, I wasn’t paid until the end of the first month on the job; therefore I was put in the hole for 4 months. The Modification Dept. had all of my paper work at this point and I got so pushed around, to the point that I lost my house and they don’t care, even when I had enough money after my position to pay them. (Note: I didn’t have unemployment, no benefits, plus the company I now work for was granted a tax write off for hiring me after 60 days of MY unemployment. What gives here? The huge companies got a tax write off for hiring me and I got nothing, let alone any help on my house, screwed again) They stole my house and I only have until next week to get out, I lived there for 21 years). I had TONS of equity in the house and they wanted it all, my house and the equity. NOW, I make a 6 figure salary and I still got screwed royally, and I even tried to have the sale receded even when and I had the MONEY to pay for ALL of my back mortgage amounts plus their additional fees, to no avail, they said it was TOO LATE….f$$k you! I have nothing good to say about this airhead so called “Modification Program”, the people who work there are idiots and so is the government to permit this kind of action to happen, shame on the government, the banks, and f$$k the amerikan dream. After I had a nervous breakdown and destroyed my kitchen they want to rape me more, even with all of the equity in my Vienna Virginia house, they want damages, f$$k you Bank of AmeriKa!! Nobody gives a SH$$. Even with a class action suite, that won’t work either, just another ploy, I hate this county for permitting “business” practices like this to happen!
Hi Lana, I agree completely with everything you said. You have to keep your nose squeaky clean to survive in this country. Once you get caught up in the system you can get screwed in a heart beat. My “Heart” goes out to you. For me, the Home Equity Loan I took out has come due, I owe $57,000 and I don’t have enough income to re-finance. I don’t know what’s going to happen to me. I’m just waiting for the same bank to foreclose on the house in Fort Washington. I wish you would get in touch with me. Caring about you! Oliver
OMG! Oliver! I just now saw this posting and it’s been over 2 years when it was posted! Where are you?

BOA responded to the Attorney General complaint I made full of lies! I called AG office and they asked me to answer BOA letter, attach my evidence and send to the El Paso Office who is handling their BOA complaints. I also requested a copy of all the “notes ” made on my account and the rep in the BOA “office of the CEO customer relations” told me over the phone “I don’t know if I can do that”. I told him they could do it now or later in court. I have found one other person in Texas on this message board that wants to join in a class action suit. If you want to join us write me at boaisgoingdown@yahoo.com
PS Legal Aid in Austin,TX has filed a class action suit and I wrote and left phone messages with the lead attorney, she has not answered either message, I mean come on people, how unprofessional is that? I also joined the Texas Housing Justice League and have heard nothing.

LO- just wanted to follow up to see how things panned out. Though it was 4 years ago, I pray that everyone on this thread has found some peace and tranquility.
Lana Dragon and ant other victims of Bank of America residing in DC, MD, VA and/or NC:
I am interested in speaking with you all off-line as my wife & I have been facing this very same issue since January 2009. Our home finally went to foreclosure on 10/7/2010 while still under a review for a modification loan. The same nonsense we faced with the lack of responses during our modification, we are also facing as we have requested a rescinsion of sale.
I am calling around today for attornies who would be willing to assist in initiating a class action law suit against BOA here in VA and the surrounding states such as DC, MD, & NC. I have read each story here and could not believe that so many of us have been victimized. They are looking to put us out in November, me, my wife, my 16 year old daughter, 9 year old son, and 5 year old daughter, but we are not leaving without a fight.
I am also looking to make contact with Congressman Randy Forbes office again.
Please contact me either by e-mail @ daquan_reinhardt@yahoo.com or by cell phone @ 240-353-9996 or home @# 804-275-0144.
I am very interested in joining a class action law suit against BOA. They have taken 1 1/2 yrs to only deny us for a Making homes affordable modification. They sent us a letter 15 days ago stating they would let us know in 10 days if they would work with us , short sales or foreclosure. Our life is just hanging. My husband was dignoised two years ago with a 90% blockage in his heart and in the modorate stage of Alzehiemers. I took a part time job with benefit with the USPS to get a good job. They enocomy is so bad It will be awile before I get on full time. Our income is much less than 3 yrs ago. Can anyone help us before we lose our home during a time when we need a stable home.
Thank you Glenda
To anyone who cares..pls help me. I’m 63 yrs old & was forced to retire from a Sheriff’s Dept after 25 yrs of service so that another employee could transfer to my job. I was harrassed & even threatened to be fired after submitting my retirement letter to the Sheriff that then caused an investigation. People lied, the person was handed over my job. Now I am being sued by Capital One, Chase, and HSBC. The debts totaled less than $9,000, but from all the fees are now well over $15,000. Cap One is taking me to court & I can’t afford an attorney and don’t know what to do. I have medical problems that I can’t afford to take care of due to my percentage of costs. I take meds from an on the job injury back in 1997 that left my back badly damaged and due to these meds and pain, cannot get another job. Can someone tell me what to do. Anxiety is literally killing me, according to my doctor. Does anyone even care about people like me? I have been honest all my life..now I wonder if I shouldn’t have been like the people who cost me my job and now health. I never wanted to die so indebted. I wanted to be able to take my grandchildren to the movies, etc. Now I only worry about what Cap One and others can take from my check once a judgement is filed against me.
You could of course hire hit people for revenge..(creative karma) like the drug cartels but would not recommend it.
