Audi A4 & Audi A6 CVT Transmission Class Action Settlement – Sadowska v. Volkswagen Group of America

If you are a current or former purchaser or lessee of a 2002, 2003, 2004, 2005 or 2006 model year Audi A4 or Audi A6 vehicle equipped with a factory-installed CVT transmission, you may be entitled to a free warranty extension and/or cash reimbursement under the Audi A4 & Audi A6 CVT Transmission Class Action Settlement.

Volkswagen Group of America, Inc., Audi AG and Volkswagen AG (“Audi” or “Defendants”) have reportedly agreed to a proposed settlement of a class action lawsuit against them in the United States District Court for the Central District of California (styled Anna Sadowska, et al. v. Volkswagen Group of America, Inc., et al., Case No. CV11-00665 (BRO)(AGRx)) alleging, among other things, that certain CVT transmissions of 2002 through 2006 model year Audi A4 and Audi A6 vehicles failed to function properly and asserting violations of the federal Magnuson-Moss Warranty Act, 15 U.S.C. §2301 et seq. and breach of various states’ express warranty laws and California consumer protection statutes, according to the proposed Audi A4 & Audi A6 CVT Transmission class action settlement notice.

Who Is Included In The Proposed Audi A4 & Audi A6 CVT Transmission Class Action Settlement?

The proposed Audi A4 & Audi A6 CVT Transmission settlement class reportedly includes, unless otherwise excluded, all United States purchasers and/or lessees of any 2002, 2003, 2004, 2005 and 2006 model year Audi A4 and Audi A6 vehicle originally equipped with a factory-installed CVT Transmission, imported and distributed by Volkswagen Group of America, Inc. for sale or lease in the United States of America.

What Settlement Benefits Does The Proposed Audi A4 & Audi A6 CVT Transmission Class Action Settlement Provide?

Under the proposed Audi A4 & Audi A6 CVT Transmission class action settlement, a cash reimbursement will reportedly be made available to Class Members who timely file valid Claim Forms for the cost previously paid for repair or replacement of the following CVT transmission part(s) of Settlement Class Vehicles which occurred within the earlier of 10 years or 100,000 miles from the date of the first original purchase or lease of the vehicle, whichever occurred first: (1) Transmission Control Module (TCM) of the CVT transmission of a 2003, 2004, 2005 or 2006 model year Audi A4 or Audi A6 Settlement Class Vehicle; (2) Valve Body of the CVT transmission of a 2003 or 2004 model year Audi A4 or Audi A6 Settlement Class Vehicle; and (3) Transmission without the Valve Body and TCM of a CVT Transmission of a 2002, 2003 or 2004 model year Audi A4 or Audi A6 Settlement Class Vehicle.

Class Members who previously paid for repair or replacement of a CVT transmission part covered after the 10 year or 100,000 mile period may also be entitled to reimbursement of that cost if they provide proof that the need for that repair/replacement was diagnosed and documented by anauthorized Audi dealer or other repair facility within the 10 year or 100,000 mile period.

In addition, the Audi A4 & Audi A6 CVT Transmission class action settlement reportedly provides that Audi’s New Vehicle Limited Warranty will be extended to cover repair or replacement, by an authorized Audi dealer, of various CVT transmission part(s) during the 10 year or 100,000 mile period.

The Audi A4 & Audi A6 CVT Transmission settlement also provides for certain documented trade-in reimbursement benefits for Settlement Class Members who traded-in their 2002, 2003 or 2004 Audi A4 or Audi A6 Settlement Class Vehicle instead of paying the cost of replacing the entire CVT transmission.

    I have a 2005 Audi A4 Cabriolet with a CVT transmission. Although our car only has 38,000 miles on the odometer, the transmission has started to slip and lurch forward when cold, runs normal when warm. The Audi dealer diagnosed and confirmed the problem. they recommend replacing the transmission at a cost of $6,600 !!

    Audi USA was contacted and said that they will not assist or extend the transmission warranty. Sorry, on your own as we do not cover 2005 models, only up to 2004 according to the settlement. I already had the TCM replaced last year, but did receive a refund of the cost, now I may need a whole new transmission!! My wife is afraid to drive her Audi for fear of getting into a crash or breaking down on the highway. I’m sure the 2005 CVT transmission is no different than the 2004, especially a beautiful convertible with such low mileage.

    Todays ago my check engine light a well as a lite PRDNS came on in 2004 A4 Cabriolet. It’s well under the 100,000 miles but days away from time expiration.
    I had the tech at my local auto parts store run a diagnostic which produced: P0706.
    I just dropped it at Audi to be serviced today.
    I’ll be sure to update.

      I bought a 2004 A4 convertible and the transmission is failing… took it to an audi dealership and they told me I’m not eligible for this settlement because the 10 years expired from a few months.. My car has 50000 miles and I just bought it from a private dealer… any advise?! Donovan, did you get an exception? If yes, what did you do?

        I have 2004 Audi A4 Cabriolet 3.0L and replaced the Transmission Control in 2011 and paid the dealership around $2, 500; and came to know recently that I can claim for a reimbursement and I have submitted the receipt from the dealer along with all other supporting documents to the above mentioned address (CVT Claims Administrator, P.O. Box 2987, Faribault, MN 55021-2987), but the mail came back to me.
        I tried to call the above number as well but it says not in service.
        It would be great if anyone can guide in this regard ?

          Found out that the settlement was for 100,000 or 10 years old car, whichever came first. Needed to send all info in by Nov 2013! Not surprising mail was returned to you. Bought 2004 A4 in Dec 2014 and out of luck! Can have TCM repaired info on EBAY for about $250 and local trans shop can change it in about 3 1/2 hours. Do not need to reprogram the TCM since out of your car otherwise with new one need to “flash” the TCM for $150. Total cost estimate at Audi is $2500-3000 but at local tranny shop $350+$250(TCM repair). The TCM alone is $1300 at Audi. I do not believe one can file an exception for the lawsuit since the office is now closed for filing paperwork! Might be worth one’s time to go by Audi and try to negotiate for a better price but not holding my breath!
