Apple iPhone 4 Antenna & Reception Class Action Lawsuit Settlement

If you are or were the original owner of an Apple iPhone 4, you could be entitled to benefits under an Apple iPhone 4 class action settlement.

A class action settlement has been reached in a class action lawsuit against Apple, Inc. (“Apple” or “Defendant”) in the United States District Court for the Northern District of California (styled In re Apple iPhone 4 Products Liability Litigation, Class Action Case No. 5:10-md-02188-RMW) alleging, among other things, that Apple iPhone 4’s signal quality attenuates when users handle the phone and that Apple engaged in misrepresentations regarding the iPhone 4, according to the Apple iPhone 4 Antenna & Reception class action settlement notice.

All United States residents who are or were the original owners of an Apple iPhone 4 as of February 17, 2012 are reportedly part of the settlement class. The Class reportedly does not include Apple; any entity in which Apple has a controlling interest; Apple’s directors, officers, and employees; Apple’s legal representatives, successors, and assigns; and all persons who validly request exclusion from the Settlement Class.

Under the Apple iPhone 4 settlement, Apple will provide a $15 cash payment to Class Members who have (a) experienced antenna or reception issues with their iPhone 4; (b) been unable to return their iPhone 4 without incurring any costs; (c) been unwilling to use a case or free bumper for their iPhone 4; and (d) completed the troubleshooting steps on http://www.apple.com/support/iphone/assistant/calls/ or be unable to complete the troubleshooting steps because they no longer own their iPhone 4.

To qualify for a cash payment under the Apple iPhone 4, class members must send in a Claim Form by August 28, 2012.

According to the Apple iPhone 4 settlement website, since July 2010, Apple has offered a free bumper to iPhone 4 owners who have experienced antenna or reception issues. Class Members reportedly can continue to request a free bumper as described at http://support.apple.com/kb/HT4389.

The Court will hold a Fairness Hearing at 9:00 a.m. on July 13, 2012, at the United States District Court for the Northern District of California, San Jose Division, Courtroom 6 (4th Floor) located at 280 South 1st Street, San Jose, California 95113. At this hearing the Court will reportedly consider whether the Apple IPhone 4 settlement is fair, reasonable, and adequate.
