A class action settlement has been reached with Anthem Blue Cross of California, Anthem Blue Cross Life and Health Insurance Company, The WellPoint Companies, Inc., WellPoint California Services, Inc. and WellPoint Behavioral Health, Inc. (together called “WellPoint / Anthem Blue Cross” or the “Defendants”) in a class action lawsuit in the Superior Court of the State of California, County of Orange, (styled Blue Cross of California Website Security Cases,Civil Class Action Case No. 5JCCP 4647) alleging, among other things, that by March 2010, WellPoint / Anthem Blue Cross was aware that its customers’ health applications and information was potentially publicly accessible, including stored personal information (such as Social Security numbers, home and office addresses, telephone numbers, credit card numbers and financial information used for premium payments, personal health information, and other information people may have provided on their health insurance applications to WellPoint / Anthem Blue Cross) and/or electronic versions of individual health insurance applications for over 600,000 customers, enrollees or subscribers, without username, password and encryption protections, according to the Anthem Blue Cross Wellpoint security data breach class action settlement notice.
The Anthem Blue Cross Wellpoint security data breach Settlement Class reportedly includes everyone in the United States, including Puerto Rico, U.S. Virgin Islands and Guam (1) whose Private Information was on WellPoint / Anthem Blue Cross’ Affected Servers from August 15, 2008, through March 10, 2010, or (2) who received a notification letter from WellPoint / Anthem Blue Cross regarding the alleged failure of WellPoint / Anthem Blue Cross to secure their confidential personal and private information.
The settlement reportedly offers credit monitoring, identity theft insurance, additional time to make a claim for identity theft reimbursement, cash reimbursement for identity theft losses and out‐of‐pocket expenses that are more likely than not the result of the alleged disclosure, enhanced security measures, and donations to local and national non‐profit entities.
The Court will hold a Fairness Hearing at 9:00 a.m., on November 14, 2011, in Department CX103 of the Orange County Superior Court (Complex Litigation Division), located at 751 West Santa Ana Boulevard, Santa Ana, California 92701 to consider whether the proposed Anthem Blue Cross Wellpoint security data breach settlement is fair, reasonable, and adequate.
