American Express Travel Related Services, Inc. (“American Express” or “AMEX” or “Defendant”) has reportedly agreed to a proposed settlement of a class action lawsuit against American Express in the U.S. District Court for the Northern District of Illinois (captioned as Kaufman v. American ExpressCase No. 07-01707) alleging, among other things, that American Express failed to notify persons who purchased and used AMEX gift cards of the full terms and conditions that applied to the AMEX gift cards including that American Express gift cards could not be used in “split-tender” transactions (when someone uses an Amex gift card plus another form of payment), thereby allegedly preventing Amex cardholders from using up a gift card’s full value and resulting in leftover value being used up by monthly fees unless the AMEX cardholder paid a “check issuance” fee, according to the American Express AMEX Gift Card class action settlement notice.
Who Is Included In The American Express AMEX Gift Card Class Action Settlement?
The American Express AMEX Gift Card settlement class reportedly includes, unless otherwise excluded, all persons who purchased, received, held or used a gift card issued by American Express between January 1, 2002 and September 21, 2011. Gift cards with an American Express logo on them are reportedly included in the settlement. Certain gift cards such as “Be My Guest” dining cards; and gift cards sold at a Westfield shopping center in California (or online in California) between November 1, 2000 and October 1, 2009 and have the word “Westfield” or a “Westfield” logo on it are not included in the settlement.
What Settlement Benefits Does The American Express AMEX Gift Card Class Action Settlement Provide?
Under the American Express AMEX Gift Card class action settlement, American Express has reportedly created a settlement fund of $6,753,269.50. The settlement reportedly offers from $5 up to $20 per gift card (up to $40 per person) and allows those persons holding an American Express gift card with a $25 or less value on it to get a refund of the unused balance at no charge.
