Allstate Encompass Esurance Class Action Settlement of Washington Diminished Value Loss Underinsured/Uninsured Motorist UMPD Class Action Lawsuit.

If you had an auto insurance policy in Washington issued by Allstate, Encompass, or Esurance and received payment to cover damage to your vehicle after July 6, 2009, you may be entitled to a payment from the Allstate, Encompass Esurance class action settlement.

Allstate Fire & Casualty Insurance Company, Allstate Insurance Company, Allstate Indemnity Company, Allstate Property and Casualty Insurance Company, Encompass Insurance Company Of America, Encompass Indemnity Company, Esurance Insurance Company and Esurance Property & Casualty Insurance Company have reportedly agreed to a class action settlement of a lawsuit filed against Allstate Fire and Casualty Insurance Co. in the United States District Court for the Western District of Washington, styled as Kogan v. Allstate Fire & Cas. Ins. Co., Class Action Case No. 15-cv-05559-BHS, alleging, among other things, that Defendants failed to pay or pay adequately for “diminished value” loss under their Washington insurance policies’ UMPD coverage, and that such an alleged failure to pay is a breach of the Settling Defendants’ automobile insurance contracts.

The Settling Defendants reportedly contend that they did nothing wrong and that they paid the full and appropriate amounts for diminished value, where applicable, as part of their regular claim adjusting processes.

Who Is Included In The Washington Allstate Encompass Esurance Underinsured/Uninsured Motorist (“UMPD “) Coverage Diminished Value Loss Class Action Settlement?

The Washington Allstate Encompass Esurance Underinsured/Uninsured Motorist (“UMPD “) Coverage Diminished Value Loss class action settlement reportedly includes, unless otherwise excluded, the following settlement class:

All insureds of Defendants with Washington policies issued in Washington State between July 6, 2009 and the date of preliminary approval of this Settlement for insureds of ALLSTATE FIRE & CASUALTY INSURANCE COMPANY, between January 11, 2019 and the date of preliminary approval of this Settlement for insureds of ALLSTATE INSURANCE COMPANY, between March 10, 2017 and the date of preliminary approval of this Settlement for insureds of ENCOMPASS INSURANCE COMPANY OF AMERICA and ENCOMPASS INDEMNITY COMPANY, and between November 25, 2014 and the date of preliminary approval of this Settlement for insureds of ALLSTATE INDEMNITY COMPANY, ALLSTATE PROPERTY AND CASUALTY INSURANCE COMPANY, ESURANCE INSURANCE COMPANY and ESURANCE PROPERTY & CASUALTY INSURANCE COMPANY, where the insured’s vehicle damages were covered under the policy’s underinsured/uninsured motorist (“UMPD “) coverage and,

    1. The repair estimates on the vehicle (including any supplements) totaled at least $1,000; and
    2. The vehicle was no more than six years old (model year plus five years) and had less than 90,000 miles on it at the time of the accident; and
    3. The vehicle suffered structural (frame) damage and/or deformed sheet metal and/or required body or paint work.

What Settlement Benefits Does The Allstate Encompass Esurance Underinsured/Uninsured Motorist UMPD Coverage Class Action Lawsuit Settlement Provide?

The Washington Allstate Encompass Esurance Underinsured/Uninsured Motorist UMPD Coverage Diminished Value Loss class action lawsuit settlement reportedly provides for the creation of a Settlement Fund of $10,092,600 to pay class members who submit valid claims and to pay for certain settlement expenses, including attorneys’ fees and costs and incentive payments to the Class Representative.

Each settlement Class Member who submits a valid claim form will reportedly receive a payment that will depend on his or her vehicle repair costs.  According to the settlement notice, the average payment for qualified Class Members will likely be in the range of several hundred dollars per Class Member, depending on how much, if any, payment for diminished value the Claimant has already received. 

In order to get paid under the Allstate Encompass Esurance settlement, class members must file claim forms online or via mail by September 30, 2021.
