A class action settlement has been reached in a class action lawsuit against 21st Century Insurance Company (“21st Century Insurance” or “21st Century” or “Defendant”) in the Superior Court for the State of California, County of Los Angeles (styled Amber Mackay and Jacqueline Leacy v. 21st Century Insurance Company, Class Action Case No. BC297438) alleging, among other things, that 21st Century engaged in unfair business practices that purportedly violated California Business and Professions Code section 17200, based on the contention that 21st Century applied their Persistency Surcharge and Accident Verification Surcharge in violation of California law and that policyholders paid higher premiums for their automobile insurance policies than they should have paid when 21st Century surcharged them because they did not have prior insurance, according to the 21st Century Insurance Persistency Surcharge & Accident Verification Surcharge class action settlement website and settlement notice.

21st Century Insurance Persistency Surcharge & Accident Verification Surcharge class action settlement class members reportedly include the following persons, unless otherwise excluded:

“Class” means every person who purchased automobile insurance from 21st Century at any time from October 1, 1997, and before October 31, 2005, and who paid increased premiums due to a lack of prior insurance involving the application of a Persistency Surcharge and/or Accident Verification Surcharge.

The proposed 21st Century Insurance Persistency Surcharge & Accident Verification Surcharge  class action lawsuit settlement reportedly provides for, among other things, the following settlement benefits:

(1) If you were charged the Persistency Surcharge only, you are entitled to receive $12.00 in cash, upon completion and return of a valid and timely Claim Form (no later than March 31, 2011).

(2) If you were charged both the Persistency Surcharge and the Accident Verification Surcharge, you are entitled to receive $115.00 in cash, upon completion and return of a valid and timely Claim Form (no later than March 31, 2011).
